�'� RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT
COMMISSION DESIGNATING THE EAST BANK DEVELOPMENT
AREA, DECLARING THE EAST BANK DEVELOPMENT AREA TO
BE BLIGHTED AND APPROVING DEVELOPMENT PLAN AND
CONDITIONS UNDER WHICH RELOCATION PAYMENTS WILL BE
MADE
WHEREAS, the City of South Bend Department of Redevelopment
has, pursuant to the Redevelopment of Cities and Towns Act of 1953,
as amended (the "Act "), conducted surveys and investigations and
has thoroughly studied that area in the City of South Bend, County
of St. Joseph, State of Indiana, hereby designated as the East Bank
Development Area which is more particularly described by a line
drawn as follows:
A parcel of land being a part of the City of South
Bend, Portage Township, St. Joseph County, Indiana
and being more particularly described as follows,
viz:
Beginning at the point of intersection of the North
right -of -way line of Sorin Street with the East
right -of -way line of Niles Avenue in said City;
thence South along said East right -of -way line of
Niles Avenue to the centerline of the first fourteen
(14) foot alley lying North of Cedar Street and
between Niles Avenue and Hill Street; thence East
along said centerline, to the centerline of Hill
Street, a sixty -six (66) foot right -of -way; thence
South, along said Hill Street centerline, to the
centerline of Jefferson Boulevard; an eighty -two and
one -half (82.5) foot right -of -way; thence West,
along said Jefferson Boulevard centerline to the
center of the St. Joseph River; thence in a
Northwesterly and Northeasterly direction along the
centerline of said River to its intersection with
the projected North right -of -way line of said Sorin
Street; thence East, along said projection and
along said North right -of -way line to the East
right -of -way line of Niles Avenue which is the
place of beginning.
' WHEREAS, upon such surveys, investigations and studies
being made, it has been found by the City of South Bend Redevelop-
ment Commission that the above - described area has become blighted
to an extent that such blighted conditions cannot be corrected by
regulatory process or by the ordinary operations of private enter-
prise without resort to the provisions of the Act, and it has been
further found that the public health and welfare would be bene-
fitted by acquisition in and redevelopment of such area under the
provisions of the Act; and
WHEREAS, the Commissioners have caused to be prepared maps
and plats showing the boundaries of such blighted area, the location
of the various parcels of properties, streets and alleys and other
features affecting the acquisition, clearance, replatting,
replanning, rezoning and redevelopment of such area, and indicating
the parcels of property to be included or excluded in the
acquisition and portions of the area to be acquired which are to
be devoted to streets, alleys, levees, sewerage, parks, playgound
and other public purposes under the redevelopment plan; and
AV- WHEREAS, there was presented to this meeting of the Gover-
.�' ing Body of the City of South Bend Department of Redevelopment for
its consideration and approval, a copy of Development Plan for the
project area dated October 3, 1980, which plan is entitled:

"DEVELOPMENT PLAN
EAST BANK DEVELOPMENT AREA
SOUTH BEND, INDIANA"
and consists of 24 pages; and
WHEREAS, Title VI of the Civil Rights Act of 1964, as
amended, and the regulations of the Department of Housing and Urban
Development effectuating that title, provide that no person shall,
on the grounds of race, age, sex, color or national origin, be
excluded from participation in, be denied the benefits of, or be
subjected to discrimination in the undertaking and carrying out of
any federally assisted projects;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND
REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND
DEPARTMENT OF REDEVELOPMENT:
1. That the East Bank Development Area, which is described
in the first "WHEREAS" clause hereof, is blighted and constitutes a
menace to the social and economic interest of the City of South
Bend and its inhabitants and that it will be of public utility and
benefit to acquire real estate in such area and redevelop the area
under the provisions of the Act.
2. That the Department of Redevelopment proposes to
acquire such real estate and the interests therein within the
aforementioned boundaries as designated in the Development Plan
and under the conditions set out therein.
3. That it is estimated that the cost of acquiring the
properties in the area will be $884,800.00.
4. That it is hereby found and determined that the
objectives of the Development Plan cannot be achieved through more
extensive rehabilitation of the Project area.
5. That the Development Plan is hereby in all respects
approved and the Secretary is hereby directed to file a certified
copy of said Development Plan with the minutes of this meeting
and to have a certified copy of said Plan recorded in the Office
of the Recorder of St. Joseph County, Indiana.
6. That the United States of America be, and hereby is
assured of full compliance by the City of South Bend Department
of Redevelopment with regulations of the Department of Housing and
Urban Development effectuating Title VI of the Civil Rights Act of
1964, as amended.
Adopted at the Regular Meeting of the South Bend Redevelop-
ment Commission held on October 3, 1980 at the office of the
Commission, 1200 County -City Building, 227 West Jefferson Boulevard,
South Bend, Indiana.

Introduction
The East Bank Development Area offers the City of
South Bend a unique opportunity. The Area, consisting of approx-
imately 52 net acres, is located directly to the east of the
Central Business District and is presently greatly underutilized..
The Development Plan that follows provides for a coordinated
effort on the part of both the public and private sectors to
convert this largely vacant area to a vibrant, urban, residen-
tial community with compatible commercial and retail uses.
With a concept based on the reopening of the East Race of the
St. Joseph River, the Area is envisioned as a pedestrian oriented
community, combining park improvements, pedestrian paths and open
spaces with re -use of certain existing structures as well as
encouraging new construction.
In prior redevelopment projects large amounts of public
sector actions were necessary to spur private development. Such
is not the case with this particular project. The location and
setting of the Area gives it a quality that is inherently
In attractive to private developers.
The major public sector investment will be the acquisition
and reopening of the East Race and creation of a park along the
banks of the race to complement the attractive riverfront envir-
onment in the downtown area. South Bend Park Department plans
for the race itself provide for recreational amenities in the
form of canoeing and white water kayaking as well as providing
for a fish ladder and pedestrian pathway system.
Other acquisition, relocation and clearance activities
will be limited as the primary emphasis will be on private
sector participation. Thus, the role of the Department of
Redevelopment becomes one of controlling the type and degree of
c development as well as leveraging the public monies that are
spent.
South Bend finds itself in a position to transform this
currently underutilized area, with the cooperation and involve -
ment of the private sector, into a vital residential and commer-
cial neighborhood that complements the downtown area and adds
significantly to the tax base of the City.

I. History of Project Area
The East Race of the St. Joseph River played an
important role in the early development of
South Bend as an industrial city. Originally
constructed in the 1840's, the raceway provided
hydraulic power to local industries such as the
Singer Corporation and the A.C. Stanley Manu-
facturing Corporation. The East Race served a
useful function for over one hundred years until
it was filled in during the 1950's and 1960's.
The memory of the race did not fade with its
destruction. City residents, community groups,
business leaders and public officials began to
investigate ways of reopening the race to provide
recreational opportunities. The concept of
reopening the race was formally proposed in the
"St. Joseph River Corridor Study" prepared by
Lawson Associates in 1973. In that study recom-
mendations were made to improve the riverfront
throughout the central area of South Bend, pro-
viding parks and pedestrian ways along the river's
path. At that time, the study suggested a re -use
of existing structures in the East Bank Area,
along with compatible new construction, to create
a predominately residential community with a mix
of businesses and offices connected by a system
of green spaces and pedestrian ways.
Since that time the City of South Bend, through its
Department of Redevelopment and Division of Planning,
has been continuing this study and looking into
existing conditions and land utilization in the Area.
This Development Plan is the culmination of those
efforts and sets forth the Cit -'s goals and plans
for the re- emergence of the mast Bank Area as a
more vital part of South Bend.

II. Description of Project
A. Boundaries of the East Bank Development Area
A parcel of land being a part of the City of
South Bend, Portage Township, St. Joseph County,
Indiana and being more particularly described
as follows, viz:

B. Development Plan Goals & Objectives
Goals and objectives for the redevelopment of
the East Bank Development Area are:
1. To reverse the underutilization of
existing land and structures
through the creation of a downtown
residential /mixed use area which
will include:
a. A medium density, pedestrian
oriented residential development;
b. Supporting neighborhood oriented
commer_�al and retail development;

C. Adaptive re -use of certain
existing buildings; and
d. New construction.
2. To create an attractive park setting,
to complement the riverfront environ-
ment.
3. To stimulate private sector partici-
pation and investment consistent with
overall goals and objectives.
4. To increase the tax base of the area.
C. Types of Proposed Redevelopment Activities
Realization of East Bank Development Area
objectives will be accomplished by a combination
of public and private actions. These actions
include, but are not limited to, the following:.
property acquisition, relocation, clearance,
vacation and dedication of public rights -of -way,
provision for public facilities and improve-
ments and any other activity pertaining to
planning and implementing an urban redevelop-
ment plan.

III. Land Use
A. Designation of Sub -Areas
While the entire East Bank Development Area
is envisioned as a residential /mixed use
area as described in the Development Plan
Goals and Objectives, two sub -areas have
been designated in order to emphasize develop-
ment priorities. The sub -areas are identi-
fied on Map I.
Area A: The highest priority shall be on
Multi- Family residential with
secondary emphasis on Commercial
development.
Area B: The highest priority shall be on
Commercial development with
secondary emphasis on Multi - Family
residential.
B. Development Controls
The controls and regulations for the Development
Area are designed to provide for development that
is consistent with Plan Goals and Objectives and
to assure a high level of urban design.
1. Within the Development Area the following
uses will be allowed:
a. Residential: multi - family and two
family dwelling units
b. Commer-al:

2. All proposed development is subject to
review and approval by the East Bank
Design Review Committee.
3. Minimum building height shall be two
stories.
4. Height and area requirements shall be the
same as those in the "G" Height & Area
District as identified in Chapter 21,
Article 4, Division 8 of the Municipal Code
of the City of South Bend.
5. Off- premise signs may not be erected or
placed within the East Bank Development
Area. Sign size, design and placement
shall be subject to review and approval
by the East Bank Design Review Committee.
6. The Department of Redevelopment recognizes
that there presently exist in the Area
certain uses which do not conform to the
Development Plan Goals, Objectives and
Controls. q,:ch uses will be allowed to
continue unless the Department acquires the
subject property through its regular acquisition
procedures.
a. Such uses may only be expanded within
existing buildings.
b. If such uses are damaged by fire or
other means to an extent of less than
50% of its replacement cost, the use
may be reconstructed, but if such
damage is in excess of 50% of the
replacement cost, the use may not be
reconstructed except in accordance with
the provisions of this Development Plan.
7. When feasible, utility lines shall be
placed underground.
C. Parking Regulations
I. No surface parking lots may be allowed
along any waterway.

2. Surface Parking lots of over ten spaces
shall be screened from view as per adopted
Design Guidelines.
3. Whenever possible, required parking shall
be on site. However, off site parking
will be allowed up to a distance of 500
feet from the main entrance of such use.
4. The construction of parking structures is
recommended.
5. Multiple standards are recommended for
parking stalls to accomodate compact as
well as full -size automobiles.
D. Transportatio-:

1. The arterial streets of Jefferson Blvd.,
Colfax Avenue, LaSalle Street and Hill
Street will remain.
2. Portions of existing streets will be
closed to through traffic to encourage
a residential environment and allow for
additional parking. (Neap II)
The portions to be closed are:
a. Niles Avenue between Jefferson Blvd.,
and Washington Street;
b. Niles Avenue between Madison Street
and Cedar Street with the rerouting
of Niles to Cedar Street;
C. Hydraulic Avenue between LaSalle
Avenue and Madison Street;
d. Ginz Avenue between Colfax Avenue
and Washington Street right -of -way
extended.
3. Colfax Bridge and street between
St. Joseph Street and Hill Street shall
be improved per State Highway Department
plans.
4. Transpo bus routes are encouraged to remain.
It is recommended that bus shelters be
placed in strategic locations.

E. Public Improvements
1. In addition to the construction of the East
Race the following public improvements are

recommended:
a. The closed portion of Niles Avenue
between Jefferson Boulevard and
Washington Street is to be widened
to 52 f_P ^t to facilitate the
construction of a 450 parking area;
b. Construction of a continuous
pedestrian pathway along the East

Bank of the St. Joseph River on an

easement that is to be dedicated to
the City.

IV. East Bank Desi
Review Committee
,r In order to achieve a high level of design and insure
a feeling of continuity throughout the development
area; an East Ban]' jesign Review Committee is hereby
established. The following paragraphs explain the
makeup and duties of that committee.
A. Establishment of Committee
An East Bank Design Review Committee of five
members shall be established consisting of the
Executive Director of the Department of Redevel-
opment who shall serve as Chairman of the
Committee, the City Engineer, the Director of
the St. Joseph County Area Plan Commission, the
1 City Building Commissioner and one member
appointed by the Redevelopment Commission.
B. Terms: Members of such committee shall serve
wi out pay for the duration of this Develop-
ment Plan. Vacancies occurring through death,
resignation or other causes, shall be filled
for the unexpired term in the same manner as
original appointments.
C. Rules: The Committee shall adopt such rules
and procedures as are necessary to conduct its
business. Among other things, such rules may
provide for the dates and times of meetings and
hearings.
D. Powers and Duties: The Committee shall function
in an advisory capacity to the Redevelopment
Commission. It shall review the proposals of
the developers from the point of view of
architecture, site planning, open space and other
applicable considerations, and for compliance
with the standards set forth in the Fast Bank
Design Guidelines. In exercising these duties
the Committee shall follow the procedures and
act within the limitations established in
subsequent sections.
E. Design Guidelines
The Redevelopment Commission, shall by
Resolution, adopt a set of Design Guidelines for
use by developers as they are planning their
project. The East Bank Design Review Committee
will base their recommendation to the Redevelopment
Commission on how well the proposals have followed
these guidelines.

The Design Guidelines may be reviewed and
revised as necessary by Redevelopment Commission
action.
F. Building Permits: No permit shall be issued by
the South Bend uilding Department for the
construction of any building in the project
area or the reconstruction, alteration, or
rehabilitation of any building in the area
unless the application for such permit shall
bear an endorsement by the Committee that such
proposed construction is appropriate and
conforms to the standards set forth in the
East Bank Design Guidelines.
G. Review: All development plans filed hereunder
shams —be accompanied by preliminary and final
architectural plans and. /or engineering
drawings and specifications for the work
involved. Such plans shall be reviewed for
compliance with the standards and objectives
of the Development Plan and Design Guidelines.
Within thirty days from and after the date
on which a development plan is filed with
the Committee, Saturdays, Sundays and legal
holidays excluded, the Design Review Committee
shall submit its recommendations in writing
to the Redevelopment Commission, stating in
the case of a disapproval, the reasons therefor,
and a copy of such recommendation shall be
given to the applicant(s), the Building
Department and the Executive Director of the
St. Joseph County Area Plan Commission. In
addition, the Committee shall indicate what
modifications in plans or specifications are
necessary to accomplish compliance.
H. Amendments to Disapproved Plan: Within not
more than thirty days after a disapproval,
the applicants filing a development plan which
has been disapproved, may file with the Com-
mittee an amendment to such plan or an amended
plan which shall be limited exclusively to
changes made necessary to accomplish compliance
with the gro,,nds for disapproval stated by
the Committee. An amendment or amended plan
shall be approved or disapproved within not
more than thirty days after filing thereof.

I. Prevention of S eculation: Purchase contracts will
provide that the re eve oper agree that his purchase
of the property is for the purpose of redevelopment
and not for land speculation. Prior to the com-
pletion of his redevelopment project, the redeveloper
may not sell, lease, or otherwise transfer such
land (or improvements) without the prior written
consent of the City of South Bend, Department of
Redevelopment.
J. Adequacy of Zoning and Other Codes and
Regulations to Protect Protect Area.
As explained above, the new land uses in the project
area will be subject to the established provisions
of the South Bend Zoning Ordinance. All such uses
will also be subject to the requirements of the
Building Code and similar regulations. These codes
and regulations in conjunction with the land use
provisions, building requirements and restrictions
as well as the design and development objectives
established. by the Plan will adequately protect
the Development Area.
K. Signs
All proposals for signs within the Development Area
shall be reviewed by the Committee and evaluated
as to their keeping with the standards established
in the Design Guidelines.

V. Project Proposals
A. Land Acquisition
The Land Acquisition Plan Map (attached)and Tab-
ulation Sheets(pages 15 through 20) indicate real
property to be acquired for redevelopment. The
Tabulation Sheets also set forth parcel ownership
and square footage for such land.
Upon the acquisition of such properties, the City
of South Bend Department of Redevelopment will
either:
1. Demolish the structure or structures thereon
and dispose of the land for redevelopment at
its fair market value, excepting those cases
when land is sold or leased to another public
body pursuant to Indiana Code 18- 7 -7 -20, for
uses in accordance with the Development Plan;
or
2. Sell or lease the property to purchaser or
lessee at its fair market value, excepting
those cases when property is sold or leased
to another public body pursuant to Indiana
Code 18- 7 -7 -20, for uses in accordance with
the Development Plan subject to its being
rehabilitated in conformance with the East
Bank Design Guidelines.
B. Property Rehab itation
All properties in the East Bank Development Area
shall comply with the standards set forth in all
applicable statutes, codes and ordinances, as
amended from time to time, relating to the use,
maintenance, facilities, and occupancy of existing
property, including but not limited to, the
Building, Plumbing, Heating, Electrical and Housing
Codes.
All properties within the Development Area shall
be maintained so that the appearance of the
premises and all buildings thereon shall reflect
a level of maintenance in keeping with the standards
of the area.

C. Redevelopers' Obligations
Awk The land acquired by the City of South Bend Depart-
ment of Redevelopment will be disposed of subject to
an Agreement between the Department and the Redeveloper.
The Redeveloper will be required by the contractual
agreement to observe the Land Use and Building
Requirements and Objectives of this Development Plan.
They will further be required to submit a redevelop -
ment schedule satisfactory to the City of South Bend
Department of Redevelopment. The Redeveloper will
not be permitted to defer the start of construction
for a period longer than that required for the
preparation of necessary redevelopment plans, their
review, and approval by the City of South Bend
Department of Redevelopment.

1. In addition, the following provisions will be
included in the Agreement.
a. That the Redeveloper will submit to the
Department a plan and schedule for the
proposed development.
b. That the purchase of the land is for the
purpose of redevelopment and not for specu-
lation.
C. That the land will be built upon and
improved in conformity with the objectives
and provisions of the Development Plan.
d. That the building of improvements will be
commenced and completed within a reasonable
time.
e. That the redevelopers, their successors or
assigns, agree that there will be no dis-
crimination against any person or group of
persons on account of race, creed, color,sex, age,
national origin, or ancestry in the sale,
lease, sublease, transfer, use, occupancy,
tenure, or enjoyment of the premises therein
conveyed, or improvements erected or to be
erected thereon, nor will the Redeveloper
himself or any person claiming under or
through him establish or permit any such
practice or practices of discrimination
or segregation with reference to the selection,
location, number, use, or occupancy of tenants,
lessees, sublessees, or vendees in the premises
therein conveyed, or improvements erected or
to be erected thereon.

Renewal Plan
The East Bank Development Plan may be modified or varied
at any time by a resolution of the City of South Bend
Redevelopment Commission. Any change affecting any
property or contractual right can be effectuated only in
