RESOLUTION OF THE SOUTH BEND REDEVELOPMENT
COMMISSION GOVERNING BODY OF THE CITY OF
SOUTH BEND, DEPARTMENT OF REDEVELOPMENT,
REGARDING SALE OF LAND TO AN EMPLOYEE OF
THE CITY OF SOUTH BEND
WHEREAS, the Department of Redevelopment is the authorized
agency under the Closeout Agreement with the United States Department
of Housing and Urban Development ( "HUD") for the LaSalle Park Urban
Renewal Area, IN R -57, dated June 22, 1977; and
WHEREAS, the South Bend Redevelopment Commission is the
governing body of the Department of Redevelopment under Indiana Code
18- 7 -7 -4; and
WHEREAS, the South Bend Redevelopment Commission, on May 16, 1980,
approved the "LaSalle Park Disposition Plan," the procedures for the
IL disposition of real estate in IN R -57; and
WHEREAS, the Department of Redevelopment has carried out the
provisions of the LaSalle Park Disposition Plan and, in carrying out the
provisions of the LaSalle Park Disposition Plan, a parcel of land is to
be sold to an employee of the City of South Bend; and
WHEREAS, the sale of said parcel of a City employee does not
violate any local, state or federal statute, but HUD regulations restrict
the sale of land to employees of the City;
NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Commission of
the City of South Bend that:
In order to provide full disclosure, the Department of Redevelopment
publicly acknowledges and approves the sale of land to Lynn Coleman of
the South Bend Police Department and directs the staff of the Department
to obtain a Waiver from HUD of its regulatory proscription against the
sale of land to Lynn Coleman, an employee of the City.
Adopted at the Regular Meeting of the South Bend Redevelopment
Commission held on the 22nd day of August, 1980, in the Office of the
Commission, Room 1200, County -City Building, 227 West Jefferson Boulevard,
South Bend, Indiana.
