A RESOLUTION APPROVING AN APPLICATION
FOR REAL PROPERTY TAX DEDUCTION
WHEREAS, I.C. 6 -1.1- 12.1 -2(j) provides that an application
for property tax deduction may not be approved when the property
is located in an allocation area as defined in I.C. 36- 7- 14 -39,
unless the Redevelopment Commission which designated that
allocation area adopts a resolution approving that application;
and
WHEREAS, the South Bend Common Council has received a
petition for real property tax abatement consideration from Park
Point Associates for real property tax abatement consideration
for the property known as Disposition Parcel No. 5 and a portion
of Disposition Parcel No. 7 of the Monroe - Sample Development
Area, the legal description for which is attached hereto, marked
Exhibit "A ", and incorporated herein; and
WHEREAS, this Commission declared the Monroe - Sample
Development Area by Resolution No. 633, adopted February 2, 1981,
and declared South Bend Allocation Area No. 3 by Resolution No.
633, adopted February 2, 1981.
WHEREAS, Disposition Parcel No. 5 and a portion of
Disposition Parcel No. 7 of the Monroe Sample Development Area
are located within South Bend Allocation Area No. 3.
NOW, THEREFORE, BE IT RESOLVED by the South Bend
Redevelopment Commission, as follows:
1. The Commission finds that the application of Park
Point Associates for real property tax abatement
consideration for real property tax abatement on
Disposition Parcel No. 5 and a portion of
Disposition Parcel No. 7 in the Monroe - Sample
Development Area, more fully described in Exhibit
A, attachd hereto and incorporated herein, is
hereby approved.
2. That a copy of this resolution be forwarded to the
South Bend Common Council to indicate the
Commission's approval of Park Point Associates
petition for real property tax abatement.

A parcel of land being a part of Lots 91 -98 and 99 -106
J. Rush's 4th Addition, and part of Lots 124, 125, and
132, E.H. Rush's Addition, City of South Bend, Indiana, and
being more particularly described as follows:
Beginning at the intersection of the new South
right -of -way line of Bronson Street(60 feet
R/W ) and the centerline of the now vacated
Clinton Street; thence South 89 -49�- 00" East
along the new South right -of -way line of Bronson
Street (60 feet R /W), a measured distance of
249.00 feet; thence South 440-56' -31" East,
a measured distance of 28.35 feet to the new West
right -of -way line of Marietta Street (60 R /W);
thence South 0= 03' -24" East along said West
right -of -way line of Marietta Street, a
measured distance of 359.00 feet; thence North
89- 49' -00" West, a measured distance of 269.02
feet to the centerline of the now vacated Clinton
Street; thence North 003' -24" West along said
centerline of now vacated Clinton Street,
a measured distance of 379.00 feet to the
place of beginning containing 2.3361 acres
more or less.
