REDEVELOPMENT COMMISSION AND THE SOUTH BEND
BOARD OF PUBLIC WORKS
REDEVELOPMENT RESOLUTION NO. 706 -84
BOARD OF PUBLIC WORKS RESOLUTION NO. 11 -1984
WHEREAS, the South Bend Redevelopment Commission
(Commission) is the public body charged with redevelopment of
districts within the City of South Bend declared blighted under IC
36 -7 -14; and
WHEREAS, the Central Downtown Urban Renewal Area, R -66, has
been declared blighted by the Commission; and
WHEREAS, the Commission has acquired parcels of land
(Sites) in the Central Downtown Urban Renewal Area, R -66, more fully
described as:
All of Lots Thirty -One (31), Thirty -Two (32),
Thirty -Three (33) and Thirty -Four (34) of the
original plat of the Town (now City) of South
Bend, St. Joseph County, Indiana, except a strip
of land 21 feet in width east and west, taken off
of and from the entire east end of said lots,
together with all that part of a 14 -foot alley
lying between said Lots Thirty -Three (33) and
Thirty -Four (34), more particularly described as
follows:
Beginning at the southwest corner of Lot
Thirty -One (31), thence North on and along the
west line of Lots Thirty -One (31), Thirty -Two
(32), Thirty -Three (33), and Thirty -Four (34), a
distance of 278.60 feet to the northwest corner
of lot Thirty -Four (34); thence East on and along
the north line of Lot Thirty -Four (34) a distance
of 144.73 feet to a point that is 21.0 feet west
of the northeast corner of said Lot 34; thence
South a distance of 278.51 feet to a point on the
south line of said Lot Thirty -One (31) that is
21.0 feet west of the southeast corner of Lot 31,
thence West on and along the south line of said
Lot Thirty -One (31) a distance of 144.68 feet to
the point of beginning.
(Site I) and
(Site II)
Lots Numbered Thirty -Five (35) and Thirty -Six (36)
as shown on the recorded Original Plat of the Town,
now City of South Bend, St. Joseph County, Indiana,
except a strip of land 21 feet in width East and
West, taken off of and from the entire East end of
said lots, more particularly described as follows:
Beginning at the Southwest corner of Lot 35, thence
North on and along the West line of Lots 35 and 36,
a distance of 132.45 feet to the Northwest corner
of Lot 36; thence East on and along the North line
of Lot 36 a distance of 144.73 feet to a point that
is 21.0 feet West of the Northeast corner of said
Lot 36; thence South a distance of 132.45 feet to a
point on the South line of said Lot 35, that is
21.0 feet West of the Southeast corner of Lot 35;
thence West on and along the South line of said lot
35 a distance of 144.73 feet to the point of
beginning.
which have subsequently been sold to the South Bend Public
Transportation Corporation ( TRANSPO) for its public transportation
center (Site I) and to Teachers Credit Union (TCU) for its main
offices (Site II); and
WHEREAS, TRANSPO and TCU require access from a service
drive which shall run from East Jefferson Street, due East of Site I,
then turning to run due South of Site II and due North of Site II to
exit onto South Main Street (Drive); and
WHEREAS, the Commission has agreed to sell twenty one feet
(21') of the Drive to TRANSPO on condition that TRANSPO dedicate that
twenty -one feet (21') together with an additional twenty -eight feet
(28') along the North of TRANSPO's site and a required turning radius
to the City of South Bend for use as a public way; and
WHEREAS, the South Bend Board of Public Works (Board) is
the public body with jurisdiction over public streets and ways within
the City of South Bend, including the Central Downtown Urban Renewal
Area, R -66.
NOW, THEREFORE, BE IT RESOLVED by the South Bend
Redevelopment Commission and South Bend Board of Public Works, as
follows:
1. The paragraphs above are incorporated into and made a
part of this resolution.
2. The South Bend Board of Public Works recognizes the
necessity of continued accessibility by TRANSPO and TCU to their
sites from the Drive as long as they retain the use of their sites in
a mannner requiring access from the Drive.
3. The Board will not initiate, recommend, or authorize
any action which would cause the Drive to be vacated so long as
TRANSPO and TCU continue to require accessibility from the Drive to
their sites.
4. The Board will designate the Drive one way north and
will not initiate, recommend, or authorize any action which would
cause the vehicle direction on the Drive to be changed from one way
north to two way or to one way south so long as TRANSPO's and TCU's
use of the Drive and their sites require the Drive to be one way
north, unless both TCU and TRANSPO agree in writing to such change.
5. The Board will prohibit parking along the Drive.
6. The Board will erect signs along the Drive regarding
the one way traffic and parking ban, to provide a legal basis for
South Bend Police Department enforcement of these requirements along
the Drive.
7. The Board, on behalf of its Department of Public Works,
will keep the Drive in good and workable condition, including but not
limited to sweeping and snow removal as well as repair and other
maintenance.

8. The Commission will sell the portion of the Drive
currently owned by it to TRANSPO, on condition TRANSPO simultaneously
dedicates the entire Drive as a public way.
9. The Board will accept dedication from TRANSPO of the
Drive as a public way.
10. The Commission will require that any development of the
parcel across the Drive to the east of TRANSPO's site provide on -site
loading and unloading facilities in conformity with the South Bend
Municipal Code and that it use the Drive only for building service
and not as an entrance to a customer or tenant parking facility.
11. The Commission will not sell or authorize any sale of
the parcel across the Drive to the east of TRANSPO'S site for any
purpose which will require vacation of the Drive.
12. The Commission and the Board provide the above
assurances in particular to provide TRANSPO and TCU with specific
assurances of their desire, intention and obligation to carry out
these public responsibilities in the above matters affecting
TRANSPO's and ICU's sites.
