JOSEPH C0 DEVELOPMENT AREA TO BE BLIGHTED AND AMENDING THE INDIANA DEVELOPMENT PLAN FILED FOR RE !!W` Whereas, the South Bend Redevelopment Commission ( "Commission "), governing body of the City of South Bend Department of Redevelopment ( "Department ") did, on February 3, 1981, adopt Resolution No. 633 declaring the following area to be a blighted area within the meaning of the Redevelopment of Cities and Towns Act of 1953 (I.C. 18 -7 -7) ( "Act "): A parcel of land being a part of the City of South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described as follows, viz: Beginning at the intersection of the centerlines of Michigan Street and Monroe Street in said City; thence East, along said Monroe Street centerline, to the centerline of Lincolnway East; thence Southeasterly along said centerline to its intersection with the centerline of State Road 23; thence Southwesterly and Westerly along said centerline (being, in part, also known as the centerline of Sample Street) to its intersection with the centerline of Michigan Street; thence North along said centerline to the place of beginning. WHEREAS, the Development Plan adopted by Declaratory Resolution No. 633 adopted on February 6, 1981 and confirmed by Resolution No. 635 adopted on March 20, 1981 has been amended by the following: (1) Resolution No. 636 adopted on April 16, 1981 and confirmed by Resolution No. 641 adopted on June 12, 1981; yep (2) Resolution No. 648 adopted on November 24, 1981 and confirmed by Resolution No. 651 adopted on February 5, 1982; and WHEREAS, it has been found that certain parcels within the Monroe Sample Development Area should be added to the acquisition list and that certain changes need to be made to fulfill the purpose of the Design Review Committee; and WHEREAS, there was presented to this meeting of the Commission for its consideration and approval, copies of the amended pages 6 and 12 of the Monroe Sample Development Plan, copies of which are attached hereto; and WHEREAS, the Development Plan and the conditions under which relocation payments will be made was reviewed and considered at the meeting, and the additions to the acquisition list were considered; and WHEREAS, the Commission desires to add parcels to the acquisition list and it is therefore necessary to amend the Declaratory Resolution No. 633: NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT: 1. That the Monroe Sample Development Area, which is described in the first "WHEREAS" clause hereof, is blighted and constitutes a menace to the social and economic interest of the City of South Bend and its inhabitants and that it will be of public utility and benefit to acquire land within such area and redevelop the same under the provisions of the Redevelopment of Cities and Towns Act of 1953, as amended. 2. The Redevelopment Commission proposes to acquire land and the interest therein within aforementioned boundaries as designated in the Monroe Sample Development Plan, as amended, and under the conditions set out therein. 840,101211 3. That it is hereby found and determined that the objectives of the Monroe Sample Development Plan cannot be achieved through more extensive rehabilitation of the Project Area. 4. That it is estimated that the cost of acquiring the property being added to the acquisition list is $750.00. 5. That the Monroe Sample Development Plan, as previously amended and as amended by pages 6 and 12 of said plan as attached hereto, is hereby in all respects approved and the Secretary is hereby directed to file a certified copy of said Development Plan, as amended, with the minutes of this meeting. 6. That the United States of America be, and hereby is, assured of full compliance by the South Bend Redevelopment Commission with regulations of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964, as amended. Auburn, Assistant Secretary —21 840/ 021 MONROE- SAMPLE DESIGN REVIEW COMMITTEE In order to achieve a high level of design and insure a feeling of continuity throughout the development area, a Design Review Committee is hereby established. The following paragraphs explain the makeup and duties of committee. A. Establishment of Committee A Design Review Committee of five (5) members shall be established consisting of the Executive Director of the Department of Redevelopment, who shall serve as Chairman of the Committee, the City Engineer, the Director of the St. Joseph County Area Plan Commission, the City Building Commissioner, and one member appointed by the Redevelopment Commission. To this Committee the Commission will appoint two individuals from the Monroe Sample Development Area who will vote on all matters pertaining to the Monroe Sample Development Area. B. Terms Members of such Committee shall serve without pay for the duration of this Development Plan. Members shall serve at the pleasure of the Commission. Vacancies occurring through death, resignation or other causes, shall be filled for the unexpired term in the same manner as original appointments. C. Rules The Committee shall adopt such rules and procedures as are necessary to conduct its business. Among other things, such rules may provide for the dates and times of meetings and hearings. D . Powers and Duties The Committee shall function in an advisory capacity to the Redevelopment Commission. It shall review the proposals of the developers from the point of view of architecture, site planning, open space and other applicable considerations, and for compliance with the standards set forth in the Monroe Sample Design Guidelines. In exercising these duties the Committee shall follow the procedures and act within the limitations established in subsequent sections. E. Design Guidelines The Redevelopment Commission shall, by Resolution, adopt a set of Design Guidelines for use by developers as they are planning their project. The Design Review Committee will base their recommendation to the Redevelopment Commission on how well the proposals have followed these guidelines.
