RESOLUTION OF THE CITY OF SOUTH BEND INDIANA
REDEVELOPMENT COMMISSION RATIFYING AND FILES FORRECCaD
CONFIRMING RESOLUTION NO. 678 WITH RESPECT TO
THE EAST BANK DEVELOPMENT AREA, REDECLARING THE
EAST BANK DEVELOPMENT AREA TO BE BLIGHTED AND
AMENDING THE DEVELOPMENT PLAN.
WHEREAS, the City of South Bend Department of Redevelopment has,
pursuant to the Redevelopment of Cities and Towns Act of 1953, as
amended (the "Act "), conducted surveys and investigations and has
thoroughly studied that area in the City of South Bend, County of St.
Joseph, State of Indiana, hereby designated as the East Bank
Development Area which is more particularly described by a line drawn
as follows:
A parcel of land being a part of the City of
South Bend, Portage Township, St. Joseph County,
``. Indiana, and being more particularly described
as follows, viz:
Beginning at the point of intersection of the
North right -of -way line of Sorin Street with the
East right -of -way line of Niles Avenue in said
City; thence South along said East right -of -way
line of Niles Avenue to the centerline of the
first fourteeen (14) foot alley lying North of
Cedar Street and between Niles Avenue and Hill
Street; thence East along said centerline, to
the centerline of Hill Street, a sixty -six (66)
foot right -of -way; thence south, along said Hill
Street centerline, to the centerline of
Jefferson Boulevard, an eighty -two and one -half
(82.5) foot right -of -way; thence West, along
said Jefferson Boulevard centerline to the
center of the St. Joseph River; thence in a
Northwesterly and Northeasterly direction along
the centerline of said River to its intersection
with the projected North right -of -way line of
said Sorin Street; thence East, along said
projection and along said North right -of -way
line to the East right -of -way line of Niles
Avenue which is the place of beginning.
WHEREAS, upon such surveys, investigations and studies being
made, it has been found by the City of South Bend Redevelopment
Commission that the above described area has become blighted to an
extent that such blighted conditions cannot be corrected by regulatory
process or by the ordinary operations of private enterprise without
resort to the provisions of the Act, and it has been further found
that the public health and welfare would be benefitted by acquisition
in and redevelopment of such area under the provisions of the Act;
and
WHEREAS, the Commissioners have caused to be prepared maps and
plats showing the boundaries of such blighted area, the location of
the various parcels of properties, streets and alleys and other
features affecting the acquisition, clearance, replatting, replanning,
rezoning and redevelopment of such area, and indicating the parcels of
property to be included or excluded in the acquisition and portions of
the area to be acquired which are to be devoted to streets, alleys,
levees, sewerage, parks, playground and other public purposes under
the development plan; and

WHEREAS, the Development Plan,.adoptedj ?y Declaratory Resolution
No. 626, adopted on October 3, 1980 and'cdn'firmed by Resolution No.
630 adopted on December 19, 1980 has been amended by the following:
(1) Resolution No. 632 adopted on January
16,1981 and confirmed by Resolution No. 634
adopted on March 2, 1981; and
WHEREAS, the Commissioners did, on March 11, 1983, adopt
Declaratory resolution No. 678 redeclaring, among other things, the
East Bank Development Area to be blighted and amending the Development
Plan by adding an additional parcel to the acquisition list; and
WHEREAS, as required by law, the St. Joseph County Area Plan
Commission and the South Bend common Council have considered and
approved said Resolution No. 678 and the Development Plan, and,
subsequently, the Commissioners did, on April 22, 1983, hold a public
hearing for the purpose of presenting said Resolution No. 678 and to
hear and consider remonstrances concerning said resolution; and
WHEREAS, said Redevelopment of Cities and Towns Act of 1953, as
amended, requires that the Commissioners, after such hearing and
consideration, shall take final action determining the public utility
and benefit of the project, either confirming, modifying, or
rescinding Resolution No. 678; and
WHEREAS, the Commissioners desire to confirm said resolution No.
678 with out modification;
NOW, THEREFORE, BE IT RESOLVED by the Commissioners of the City
of South Bend Department of Redevelopment that it will be of public
utility and benefit to proceed with the plan of redevelopment as set
forth in Resolution No. 678 referred to in the WHEREAS clauses above,
and that said Resolution No. 678 is hereby approved, ratified and
confirmed.
Adopted at a meeting of the South Bend Redevelopment Commission
held on April 22, 1983, at the Office of the Commission, 1200
County -City Building, 227 West Jefferson Boulevard, South Bend,
Indiana.
