TNDI NA FILED FOR REC; RO WHEREAS, the City of South Bend Department of Redevelopment has pursuant to the Redevelopment of Cities and Towns Act of 1953, as amended, conducted sur- veys and investigations and has thoroughly studied that area in the City of South Bend, County of St. Joseph, State of Indiana, designated as the Central Downtown Urban Renewal Area which is more particularly described by a line drawn as follows: Beginning at a point formed by the intersection of the north right -of -way line of LaSalle Avenue and the west right -of -way line of Main Street; thence south along the west right -of -way line of Main Street to the north right - of -way line of Washington Street; thence west along the north right -of -way line of Washington Street to the west right -of -way line of Lafayette Boulevard; thence south along the west right -of -way line of Lafayette Boulevard to the south right -of -way line of Jefferson Boulevard; thence east along the south right -of -way line of Jefferson Boulevard to the west right -of -way line of Main Street; thence south along the west right -of -way line of Main Street to the south right -of -way line of Monroe Street; thence east along the south right -of -way line of Monroe Street to the west right -of -way line of Fellows Street; thence south along the west right -of -way line of Fellows Street to the south right -of -way line of Monroe Street; thence east along the south right -of -way line of Monroe Street and proceeding in a northeasterly direction along said right -of -way to the center of the St. Joseph River; thence proceeding in a northwesterly direction along the center of the St. Joseph River to the north right -of -way line of LaSalle Avenue; thence west along the north right - of -way line of LaSalle Avenue to the west right -of -way line of Plain Street which is the point of beginning. WHEREAS, upon such surveys, investigations and studies being made, it has been found by the City of South Bend Redevelopment Commission, that the above described area has become blighted to an extent that such blighted conditions cannot be cor- rected by regulatory process, or by the ordinary operations of private enterprise without resort to the provisions of the Redevelopment of Cities and Towns Act of 1953, as amended, and it has been further found that the public health and welfare would be benefitted by the acquisition and redevelopment of such area under the pro- visions of such Act; and WHEREAS, the Commissioners have caused to be prepared maps and plans showing the boundaries of such blighted area, the location of the various parcels of prop- erties, streets and alleys and other features affecting the acquisition, clearance, replanning and redevelopment of such area, and indicating the parcels of property to be included in the acquisition and portions of the area acquired which are to be devoted to streets, parks, playground, and other public purposes under the redevelop- ment plan, and it has been found that certain land use provisions should be changed and updated to conform with current market conditions; and WHEREAS, in connection with an application of the City of South Bend Department of Redevelopment to the Secretary of the Department of Housing and Urban Development for financial assistance under Title I of the Housing Act of 1949, as amended, the approval by the Governing Body of the City of South Bend Department of Redevelopment of an Urban Renewal Plan for the project area involved in such application is required by the Federal Government before it will enter into a contract for loan or grant with the City of South Bend Department of Redevelopment under Title I; and 810; ;0 -,L "' WHEREAS, the rules and regulations prescribed by the Federal Government put suant to Title I require that the conditions under which the City of South Bend Department of Redevelopment will make Relocation Payments in connection with the Urban Renewal Project contemplated by the application be officially approved by the Governing Body of the City of South Bend Department of Redevelopment; and WHEREAS, the Urban Renewal Plan adopted by Declaratory Resolution adopted on April 4, 1968, and confirmed by Resolution No. 223 adopted 10, 1969, has been amended by the following: (1) Resolution No. 456 adopted on July 16, 1973, and confirmed by Resolution No. 460 adopted on August 8, 1973; No. 215, on October (2) Resolution No. 522 adopted on May 7, 1976, and con- firmed by Resolution No. 524 adopted on June 4, 1976; (3) Resolution No. 540 adopted on August 12, 1977, and confirmed by Resolution No. 542 on October 21, 1977; (4) Resolution No. 550 adopted on April 7, 1978, and confirmed by Resolution No. 553 on June 2, 1978; (5) Resolution No. 621 adopted on August 8, 1980, and confirmed by Resolution No. 629 on November 21, 1980. WHEREAS, there was presented to this meeting of the Governing Body of the City of South Bend Department of Redevelopment for its consideration and approval, a copy of the amended pages of the Urban Renewal Plan for the project area (Attachment "A "), including the changes in the land use provisions, which plan is entitled "URBAN RENEWAL PLAN CENTRAL DOWNTOWN URBAN RENEWAL AREA PROJECT NO. IND. R -66 SOUTH BEND, INDIANA" and consists of a typewritten document and a set of conditions under which the City of South Bend Department of Redevelopment will make Relocation Payments, which set of conditions is set forth in the Relocation Plan marked for the Urban Renewal con- templated by the application; and WHEREAS, the Urban Renewal Plan and the conditions under which the Local Public Agency will make Relocation Payments have been reviewed and considered, and the changes to the Urban Renewal Plan were considered at the meeting; and WHEREAS, Title VI of the Civil Rights Act of 1964, and the regulations of the Department of Housing and Urban Development effectuating that title, provide that no person shall, on the ground of race, color, sex, or national origin, be excluded from participation in, be denied the benefits of, or be subjected to discrimination in the undertaking and carrying out of urban renewal projects assisted under Title I of the Housing Act of 1949, as amended; NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT: 1.) That the Central Downtown Urban Renewal Area, which is described in the first "WHEREAS" clause hereof, is blighted and constitutes a menance to the social and economic interest of the City of South Bend and its inhabitants and that it will be of public utility and benefit to acquire such area and redevelop the same under the provisions of the Redevelopment of Cities and Towns Act of 1952, as amended. 2.) The Department of Redevelopment has acquired land and proposes to acquire land and the interests therein within aforementioned boundaries as designated in the Urban Renewal Plan, as amended, and under the conditions set out therein. 3.) That has been estimated that the cost of acquiring the properties in the area will be $15,742,220.00 which amount is based on the average of two independent fee appraisials. 4.) That the condition under which the City of South Bend Department of Redevelop- ment will make the relocation payments are hereby, in all respects, approved. -2- 84010k"12 i 5.) That it is hereby found and determined that the objectives of the Urban Renewal Plan cannot be achieved through more extensive rehabilitation of the Project Area. 6.) That the Urban Renewal Plan, together with the proposed amendments thereto, is hereby in all respects approved and the Secretary is hereby directed to file a certified copy of said Urban Renewal Plan, with proposed amendments, with the minutes of this meeting. 7.) That the United States of America and the Secretary of the Department of Housing and Urban Development be, and they hereby are, assured of full com- pliance by the City of South Bend Department of Redevelopment with regula- tions of the Department of Housing and Urban Development effectuating Title VI of the Civil Rights Act of 1964. Jay imtz, Presiden 8401OC2 1 RESOLUTION NO. 668 Attachment "A" "Area C" and "Area F" of the Land Use Plan for the Central Downtown Project, R -66 shall be deleted in their entirety and a new " Areac C" and "Area F" are adopted as follows: Area C (Wayne Street, St. Joseph Street, North Grain Street and Colfax Avenue a. Basic Objective This area forms the principal retail, service commercial, and office core of the Central Business District of the City. The basic objec- tive to be realized in this area is the development of a pedestrian - oriented environment for retail, service commercial and transportation uses that will revitalize the central core of the City. b. Land Use As indicated above, this area will be devoted to a broad range of com- patible retail, service commercial and transportation uses. Hotel - motel use which is oriented to and supports the city's cultural center development in Area D is also permitted in the block bounded by East Colfax Avenue, St. Joseph Street, East Washington Street, and Michigan Street. c. Physical Organization The physical organization of this area will be substantially modified by the physical closing of Michigan Street between Wayne Street and Washington Street. This will make possible the reorientation of the commerical development to a pedestrian mall with all service and vehi- cular access restricted to service alleys or drives. d. Parking Parking to service this area will be provided within the area by a series of parking structures located immediately to the rear of the principal retail commercial structures which will be fronting on the pedestrian mall. Parking structures are to serve the needs of devel- opments within Area C as well as providing parking facilities to serve some adjacent areas immediately to the rear of the commerical develop- ments on the east and west sides of the Michigan Street pedestrian mall from Washington Street south to Jefferson Boulevard. These public parking structures to be developed will be supported by the existing private parking facility located at the southwest corner of the area. To the fullest extent possible, commercial uses will be developed on the ground floor levels of the parking structures. In all areas where public parking is proposed, the city may elect to sell, or lease, areas for private commercial developments. In all such cases, the city may retain all necessary foundation and air rights to permit construction of parking facilities. e. Pedestrian Circulation Pedestrian circulation to Area C will be principally from the parking structures located within the area as well as from the service retail commercial developments in Areas A and G. A substantial amount of pedestrian circulation is also anticipated from adjacent Area D, the community cultural center. Pedestrian circulation within the area will be principally along the Michigan Street right -of -way a portion of which will become a pedestrian mall or open space and provide direct pedestrian access to all the existing and new developments surrounding the mall. Pedestrian access to Area G to the south may be by a ped- estrian bridge or walkway to be developed over Wayne Street. Pedestrian circulation from the cultural center to the east of Area C will be principally by an elevated bridge or walkway across St. Joseph Street. 84010 f. Vehicular Access and Service Vehicular access and service to and from this area will be available from a number of streets. The north -south streets providing access and service to the area are Main Street, carrying one way southbound traffic, and St. Joseph Street, carrying one way northbound traffic. East -west circulation movements will be provided by Wayne Street carry- ing one way westbound traffic and Colfax Avenue at the north of the areas, carrying two way traffic movement both east and west bound. In addition to the normal access and service provided by the boundary streets certain existing north -south alleys within the area will be widened to 40 feet to provide for direct service to the rear of all developments in this area. Area F (East Western Avenue, East Wayne Street, St. Joseph Street a. Basic ObJective The location of the area provides the opportunity for the development of a mixed use project incorporating residential and supporting com- mercial uses. b. Land Use As indicated above, this area will be devoted to mixed use development which is primarily residential with commercial as a supporting use. c. Physical Organization The physical organization of the area will be substantially modified from its present organization by the re- alignment of St. Joseph and Wayne Streets and the construction and re- alignment of Western Avenue as it passes through the area. These street modifications, in con- junction with the total clearance to be carried out in the area, will dictate the physical organization of the area. d. Parking Parking to serve development in this block shall be provided by facil- ities to be located within the area. e. Pedestrian Circulation Pedestrian circulation to the development in this area will be princi- pally from the parking facilities to be provided on the site in con- junction with the development in the area or from the parking facilities on adjacent Block G. f. Vehicular Access and Service Vehicular access and service to this block will be available from the streets bounding the area. North bound movements will be carried on St. Joseph Street and on the re- aligned Western- Jefferson route. Wayne Street will serve as a one way west bound traffic carrier and Western Avenue as re- aligned will serve as one -way east bound traffic carrier. -2- 8401032 CERTIFICATE The undersigned Assistant Secretary of the City of South Bend Redevelopment Commission hereby certifies that the attached Resolution is an accurate copy of Resolution No. 668 as passed at the November 19, 1982 meeting of the Redevelopment Commission.
