A RESOLUTION APPROVING AN APPLICATION FOR
REAL PROPERTY TAX DEDUCTION
WHEREAS, I.C. 6 -1.1- 12.1 -2(j) provides that an application
for property tax deduction may not be approved when the property is
located in an allocation area as defined in I.C. 36- 7- 14 -39, unless
the Redevelopment Commission, which designated that allocation area,
adopts a resolution approving that application; and
WHEREAS, the South Bend Common Council has received a
petition for real property tax abatement consideration from Lowes,
Inc. for real property tax abatement consideration for the property
located at 350 S. Columbia in the South Bend Central Development
Area, the legal description of which is attached hereto, marked
Exhibit "A" and incorporated herein; and
WHEREAS, this Commission declared the South Bend Central
Development Area by Resolution No. 737 adopted May 10, 1985 and in
the same resolution declared the South Bend Central Allocation Area
(South Bend Allocation Area No. 1A); and
WHEREAS, property located at 350 S. Columbia is located
within the South Bend Central Allocation Area (South Bend Allocation
Area No. 1A);
NOW, THEREFORE, BE IT RESOLVED by the South Bend
Redevelopment Commission as follows:
1.) The Commission finds that the application of
Lowes, Inc. for real property tax abatement
consideration for real property located at 350 S.
Columbia in the South Bend Central Allocation Area
(South Bend Allocation Area No. 1A) is hereby approved.
2.) That a copy of this resolution be forwarded
to the South Bend Common Council to indicate the
Commission's approval of Lowes, Inc. petition for real
property tax abatement.
Approved this 13th day of September, 1985, at the
regularly scheduled meeting of the South Bend Redevelopment
Commission.

A parcel in the Southeast Quarter of Section 12, Township 37
North, Range 2 East, also being a part of Block 8 of the
recorded Plat of River Bend Addition, City of South Bend, St.
Joseph County, Indiana, more particularly described as follows:
Commencing at the intersection of the East right -of-
way line of Columbia Street and the North right -of -way line of
Monroe Street as shown on said Plat of River Bend Addition;
thence North 0 030'18" West along said East right -of -way line of
Columbia Street 293.20 feet; thence continuing on said East
right -of -way line of Columbia Street northward along a curve to
the left, having a radius of 421.97 feet and subtended by a '
long chord with a bearing of North 2 022'43" West a distance of
27.60 feet to the POINT OF BEGINNING; thence continuing on said
right -of -way line northward along a curve to the left having a
radius of 421.97 feet and subtended by a long chord 137.68 feet
in length with a bearing of North 13 038'34.5" West 138.30 feet;
thence North 52 000100" East 86.74 feet; thence South 38 000'00"
East 255.00 feet; thence South 52 000100" West 69.00 feet;
thence North 39 035'12" West 98.62 feet; thence South 75 020'48"
West 78.20 feet to the Point of Beginning.
