RESOLUTION NO. 743
A RESOLUTION APPROVING AN APPLICATION FOR
REAL PROPERTY TAX DEDUCTION
WHEREAS, I.C. 6 -1.1- 12.1 -2(j) provides that an application for
property tax deduction may not be approved when the property is
located in an allocation area as defined in I.C. 36- 7- 14 -39, unless
the Redevelopment Commission, which designated that allocation area,
adopts a resolution approving that application; and
WHEREAS, the South Bend Common Council has received a petition
for real property tax abatement consideration from Old Lathe Works
Partnership for real property tax abatement consideration for the
property located at 475 N. Niles Avenue in the South Bend Central
Development Area, the legal description of which is attached hereto,
marked Exhibit "A" and incorporated herein; and
WHEREAS, this Commission declared the South Bend Central
Development Area by Resolution No. 737 adopted May 10, 1985 and in
the same resolution declared the South Bend Central Allocation Area
(South Bend Allocation Area No. IA); and
WHEREAS, property located at 475 N. Niles Avenue is located
within the South Bend Central Allocation Area (South Bend Allocation
Area No. 1A);
NOW, THEREFORE, BE IT RESOLVED by the South Bend Redevelopment
Commission as follows:
1.) The Commission finds that the application of Old Lathe
Works Partnership for real property tax abatement consideration for
real property tax abatement on property located at 475 N. Niles
Avenue in the South Bend Central Allocation Area (South Bend
Allocation Area No. 1A) is hereby approved.
2.) That a copy of this resolution be forwarded to the South
Bend Common Council to indicate the Commission's approval of Old
Lathe Works Partnership petition for real property tax abatement.
Approved this 28th day of June, 1985, at the regularly
scheduled meeting of the South Bend Redevelopment Commission.

LEGAL DESCRIPTION
AREA COMMONLY KNOWN AS 475 N. NILES AVENUE
SOUTH BEND, INDIANA
Beginning at a corner post situated at the corner formed by the junction of the
West line of Emerick Street (now Niles Avenue) with the North line of Madison
Street in the city of South Bend, Indiana; thence running West on the North line
of Madison Street 251 feet; thence running North on a line parallel to the West
line of Emerick Street (Niles Avenue) 694.43 feet, more or less, to a point that
is 235 feet South of the North line of Lot 3 in Cottrell's Second Addition to
Lowell, now a part of the City of South Bend, as measured oft a line parallel to
the West line of Emerick Street (Niles Avenue); thence West parallel to the
North line of said Lot 3 a distance of 191 feet, more or less, to the Easterly
bank of the St. Joseph River; thence Northerly. along the Easterly bank of the
St. Joseph River to a point on a line that is parallel to and 22.45 feet South
of the North line of said Lot 3; thence East along the said line that is
parallel to and 22.45 feet.South of the North line of said Lot 3 a distance of
153 feet, more or less, to a point of intersection with a line drawn 251 feet
West of and parallel to the East line of said Lot 3; thence South parallel to
the East line of said Lot 3 a distance of 20 feet; thence Easterly a distance of
251 feet, more or less, to a point on the East line of said Lot 3 (also the West
line of Emerick Street (Niles Avenue) that is 39.74 feet South of the Northeast
corner of said Lot 3; thence South along the West Line of Emerick Street (Niles
Avenue) 789.69 feet, more or less, to the place of beginning, being the same
property conveyed to South Bend Lathe Works by deeds, one from H. D. Lee
Mercantile Company dated May 21, 1920, and recorded May 28, 1920, in the
Recorder's Office of St. Joseph County, Indiana, in Deed Record 163, at page
368, one from Artificial Ice Company, dated June 9, 1952, and recorded June 9,
1952, in the Recorder's Office of St. Joseph County, Indiana, in Deed Record
500, at pages 424 -5, and one from Artificial Ice Company, dated June 9, 1952,
and recorded April 23, 1959, in the Recorder's Office of St. Joseph County,
Indiana, in Deed Record 588, at pages 306 -7 be designated as an Economic
Revitalization Area under the provisions of Indiana Code 6 -1.1- 12.1 -1, et seq.
