RESOLUTION AMENDING PROCLAIMER CERTIFICATE
NO. 2 FOR THE SOUTH BEND CENTRAL DEVELOPMENT
AREA AND AMENDING RESOLUTION NO. 753 RELATING
TO ACQUISITION OF PROPERTY WITHIN THE SOUTH
BEND CENTRAL DEVELOPMENT AREA BY EMINENT
DOMAIN.
WHEREAS, the South Bend Redevelopment Commission (Commission)
did on November 22, 1985 adopt Proclaimer Certificate Number 2
establishing the fair market value of property in the South Bend
Central Development Area, including Parcels C15 -14 and C15 -15; and
WHEREAS, the Commission did on November 22, 1985 approve
Resolution No. 753 authorizing the acquisition of property within
the South Bend Central Development Area by eminent domain, including
Parcels C15 -14 and C15 -15; and
WHEREAS, the fair market value for Parcels C15 -14 and C15 -15
was established to be $8,350.00 and this value was based on
appraisals by two qualified, independent, professional real estate
appraisers; and
WHEREAS, these appraisals were based solely on exterior
inspections of the property because the appraisers were unable to
gain entry to the property although they had tried repeatedly to do
so; and
WHEREAS, subsequent to the Commission's actions on November 22,
1985, the property owner of Parcels C15 -14 and C15 -15 permitted the
appraisers to enter the property and the appraisers have updated
their appraisals and submitted a written and signed copy of those
updated appraisals; and
WHEREAS, each updated appraisal has been reviewed by the
Department and no corrections, revisions or additions were
requested; and
WHEREAS, the Commission wishes to amend the fair market value
for Parcels C15 -14 and C15 -15 by amending Proclaimer Certificate No.
2 and Resolution No. 753 authorizing a written purchase offer in
the amount of the Commission Approved Market Price;
NOW THEREFORE, BE IT RESOLVED, by the South Bend Redevelopment
Commission, as follows:
1. Proclaimer Certificate No. 2 for the South Bend Central
Development Area is hereby amended for Parcels C15 -14
and C15 -15 to delete the fair market value therein
shown and to add a new fair market value of $9,225.00.
2. Resolution No. 753 is hereby amended for Parcel C15 -14
and 15 to delete the Commission Approved Market Price
therein shown and to add a new Commission Approved
Market Price of $9,225.00.
3. Except for the amendments herein made, Proclaimer
Certificate No. 2 and Resolution No. 753 remain in all
respects as adopted on November 22, 1985.
