RESOLUTION NO. 762, DESIGNATING THE

DECLARING THE STUDEBAKER CORRIDOR DEVELOPMENT- �.;;¢
AREA TO BE BLIGHTED, APPROVING A DEVELOPMENT -�• ••
PLAN AND CONDITIONS UNDER WHICH RELOCATION
PAYMENTS WILL BE MADE, AND ESTABLISHING AN
ALLOCATION AREA FOR PURPOSES OF TAX
INCREMENTAL FINANCING.
WHEREAS, the City of South Bend, Indiana, Redevelopment
Commission (Commission) at its regular meeting January 10, 1986,
approved and adopted Resolution No. 762, designating the area
described below as the Studebaker Corridor Development Area (Area),
declaring the Studebaker Corridor Development Area to be blighted,
approving the Studebaker Corridor Development Plan (Development
Plan) and the South Bend Central Relocation Policy (Relocation
Policy), which specifies conditions under which relocation payments
will be made, and establishing an allocation area for purposes of
tax incremental financing:
A parcel of land being a part of the City of South
Bend, Portage Township, St. Joseph County, Indiana
and being more particularly described as follows:
Beginning at the intersection of the centerline of
Prairie Ave. and the northerly right -of -way line
of the New York Central Railroad; thence,
southeasterly along said line to the southeast
corner of Lot #20 in the recorded plat of "Martin
& Tutt's Addition to the City of South Bend "; as
recorded in the records of said county; thence,
southeasterly to the southwest corner of Lot #12
in said plat; thence, east along the line between
Lots 12 & 13 in said plat to the centerline of a
north -south alley lying between Main and Michigan
Streets; thence, south along said centerline to
the centerline of the first alley north of Tutt
Street; thence, east along said line 35.00 ft. to
the centerline of the first alley west of Michigan
Street; thence, south to the centerline of Sample
cr Street; thence, west along said centerline to the
alley lying between Michigan and Main Streets;
thence, south along said line to the centerline of
Indiana Street; thence, west long said line to the
centerline of Franklin Street; thence, north along
said line to the centerline of the South Bend &
St. Joseph Railroad; thence, west along said line
to the centerline of Kendall Street; thence, north
along said line to the centerline of Cotter
Street; thence, west along said line to the
centerline of Prairie Ave.; northeasterly along
said line to the centerline of Chapin Street as
shown on the recorded plat of "Inter Belt
Industrial Park" as recorded in Book 21 of plats
on Page 1 in the records of said county; thence,
north along said line to the centerline of Prairie
Ave. as shown on said plat; thence, east along
said line 363.11 ft. to a point of curvature;
thence around a 286.48 ft. radius curve to the
left an arc distance of 302.26 ft. to a point of
tangent; thence, northeasterly along said
0 centerline to the point of beginning.
WHEREAS, the Commission submitted its Resolution No. 762
and the Development Plan to the Area Plan Commission of St. Joseph
County for approval pursuant to the provisions of I.C.36- 7- 14 -16;
and
WHEREAS, the Area Plan Commission of St. Joseph County at
its regular meeting January 21, 1986, approved its Resolution No.
87, which Resolution constituted the written order of the Area Plan
Commission of St. Joseph County approving Resolution No. 762 and the
Development Plan pursuant to I.C.36- 7- 14 -16; and
WHEREAS, the Commission submitted to the South Bend Common
Council, legislative body for the City of South Bend, St. Joseph
County, Indiana, Resolution No. 87 of the Area Plan Commission of
St. Joseph County, constituting the Area Plan Commission's written
order approving Resolution No. 762 and the Development Plan and its
certification that the Development Plan conforms to the master plan
of development for the City of South Bend; and
WHEREAS, the South Bend Common Council, at its regular
meeting, January 27, 1986, adopted its Resolution No. 1398 -86
approving the order of the Area Plan Commission of St. Joseph County
with regard to the Studebaker Corridor Development Area; and
WHEREAS, after receipt of the written order of approval of
the Area Plan Commission of St. Joseph County, Indiana, and approval
of the South Bend Common Council, the Commission caused to be
published notice of the adoption and substance of Resolution No.
762, in accordance with I.C. 5 -3 -1, with such notice also stating
that maps and plats have been prepared and can be inspected at the
office of the Redevelopment Department and naming February 14, 1986,
at 10:00 a.m., at 1200 County -City Bldg., South Bend, Indiana, as
the date, time and place of the Commission's receipt and hearing of
remonstrances and objections from persons interested in or affected
by the proceedings pertaining to the proposed project and to
determine the public utility and benefit of the proposed project for
the Studebaker Corridor Development Area; and
WHEREAS, the Commission caused to be filed a copy of the
notice of the hearing on the proposed project for the Studebaker
Corridor Development Area in the office of the Area Plan Commission
of St. Joseph County, Indiana, the Board of Zoning Appeals, the
Board of Public Works, the South Bend Board of Park Commissioners,
and the South Bend Building Commissioner, as well as any other
departments, bodies, or offices of the City of South Bend having to
do with unit planning, variances from zoning ordinances, land use,
or the issuance of building permits; and
WHEREAS, at the hearing held by the Commission February
14, 1986, at 10:00 a.m., at 1200 County -City Bldg., South Bend,
Indiana, the Commission heard all persons interested in the
proceedings and received Q written remonstrances and objections
that had been filed, and considered those remonstrances and
objections, if any; and
WHEREAS, the Commission is cognizant of the conditions
that are imposed under Title VI of the Civil Rights Act of 1964, as
amended, providing that no person shall, on the grounds of race,
age, sex, color, religion, or national origin, be excluded from
participation in, be denied the benefits of, or be subjected to
discrimination in the undertaking and carrying out of any
federally- assisted project.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND
REDEVELOPMENT COMMISSION, as follows:
1. After considering the evidence presented at its hearing
February 14, 1986, the Commission confirms the blight found and
declared by it in its Resolution No. 762, within the Studebaker
Corridor Development Area, and adopts and confirms the Findings of
Fact for that Area, Exhibit A, attached to this resolution and made
a part thereof.
2. The Commission finds and determines that it will be of public
utility and benefit to proceed with the Development Plan for the
Studebaker Corridor Development Area, as set forth in Resolution No.
762, adopted by the Commission on January 10, 1986.
3. Resolution No. 762 is hereby approved, ratified, and confirmed
without change.
4. This Resolution consititutes final action, pursuant to
I.C.36- 7- 14- 17(c), by the Commission determining the public utility
and benefit of the proposed project and confirming Resolution No.
762, pertaining to the Studebaker Corridor Development Area.
S. The Secretary is directed to record this resolution pursuant to
the requirements of I.C.36- 7- 14- 17(c).

EXHIBIT "A" TO
RESOLUTION NO. 764
STUDEBAKER CORRIDOR DEVELOPMENT AREA
FINDING OF FACTS
February 14, 1986
The South Bend Redevelopment Commission has conducted a study
of the Studebaker Corridor Development Area ( "Area "). Based upon
that study and following the other procedures required by I.C.
36 -7 -14 (the "Act ") including public hearing conducted this day,
pursuant to I.C. 36- 7 -14 -17 and after notice published as requested
thereby, the Redevelopment Commission hereby finds that the Area has
become blighted to such an extent that such conditions cannot be
corrected by the regulatory process or by ordinary operations of
private enterprise without resort to the provisions of the Act and
that the public health and welfare will be benefitted by the
acquisition and redevelopment of the area under the provision of the
Act. This finding is based on the following facts found by the
Redevelopment Commission in its study and hearing:
1. Almost half (48.6 %) of the total building floor area in
the Studebaker Plant Complex is vacant or
underutilized.
2. Over 60% of the total building floor area in the north
section (i.e., north of Sample Street) of the
Studebaker Plant Complex is vacant or underutilized.
3. The condition of buildings in the Studebaker Plant
Complex is deteriorating. Almost half (46 %) of these
buildings have an exterior condition that is "poor" or
"very poor" while about 30% are classified as being in
"poor" or "very poor" overall condition.
4. Over one -third (33.9 %) of the land and buildings in the
areas (Sub -Areas A and B) adjacent to the main plant
complex are vacant or underutilized. This is
especially prevalent in Sub -Area A (i.e., Franklin and
Lafayette Streets) where 43% of the land and buildings
are vacant or underutilized.
5. Over 28% of all buildings in the adjacent area are
classified as being in "poor" or "very poor" condition.
The majority of these deteriorating structures are
residential.
