HomeMy WebLinkAboutNo. 0778 joint resolution of the SBRC and the Board of Park Commissioners of the park district of the COSBA JOINT RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION AND THE BOARD OF PARK COMMISSIONERS OF THE PARK DISTRICT OF THE CITY OF SOUTH BEND RESOLUTION NO. 778 OF THE SOUTH BEND REDEVELOPMENT COMMISSION WHEREAS, the South Bend Redevelopment Commission (Redevelopment) is the public body charged with the redevelopment of districts within the City of South Bend declared blighted under I.C. 36- 7 -14 -1, et seq.; and WHEREAS, by Resolution No. 737, Redevelopment declared the South Bend Central Development Area blighted under I.C. 36- 7 -14 -1, et seq.; and WHEREAS, Redevelopment has acquired certain parcels of land within the South Bend Central Development Area, more fully described in Attachments A and B, attached to and made a part of this resolution (Property); and WHEREAS, the Board of Park Commissioners of the Park District of the City of South Bend (Park Board) on November 29, 1985, adopted a resolution entitled "A Resolution pf the Board of Park Commissioners `r► of the Park District of the City of South Bend Declaring Its Intent to Acquire by Lease /Purchase a Stadium Facjlity, to Acquire Other Property and to Construct Improvements Ther_'eQn" , 'in which it declared its determination to acquire certain property (Park Resolution), and to make certain improvements and works of construction within the Park District of the City of South Bend (Park District), for the purpose of establishing a new park to be owned and operated by the Park District, to add the park to the plan of the Park District, and to name the park the Stanley Coveleski Regional Stadium Park (Park); and WHEREAS, in Section 3 of the Park Resolution, the Park Board determined to acquire for the Park, among other property, the property from Redevelopment; and WHEREAS, by a resolution adopted December 9, 1985, the Park Board ratified and confirmed in all respects the Park Resolution. NOW, THEREFORE, BE IT RESOLVED BY the South Bend Redevelopment Commission and the Board of Park Commissioners of the Park District of the City of South Bend, as follows: 1. The paragraphs above are incorporated into and made a part of this resolution. 2. Redevelopment agrees to sell to the Park Board for $1.00 and other good and valuable consideration and the Park Board agrees to accept the Property described in Attachments A through V. 3. As a condition of sale, Redevelopment and Park agree that Property conveyed and accepted herein will be cleared and excavated by Redevelopment to an extent to be agreed between the parties. %NW 4. The President of Redevelopment shall have authority to execute the deeds for the property and any other documents needed to carry out fully the intent of this resolution. 5. The President of the Park Board shall have the authority to accept the deeds for the Property and to execute any other documents needed to carry out fully the intent of this resolution. 6. This document shall be executed in two counterparts and each counterpart shall serve as an original document for all purposes. ADOPTED this 11th day of July, 1986 at a regular meeting of the South Bend Redevelopment Commission.
