REDEVELOPMENT COMMISSION RATIFYING AND
CONFIRMING RESOLUTION NO. 783
REDECLARING THE RUM VILLAGE INDUSTRIAL
PARK TO BE BLIGHTED AND AMENDING THE �

DEVELOPMENT PLAN.
WHEREAS, the City of South Bend, Indiana, Redevelopment
Commission (Commission) at its regular meeting September 12,
1986
approved and adopted Resolution No. 783 redeclaring an area known
as the Rum Village Industrial Park (Area), located within the
corporate limits of the City of South Bend, Indiana, more
particularly described by a line drawn as follows:
A parcel of land being a part of the City of
South Bend, Portage Township, St. Joseph
County, Indiana and being more particularly
described as follows:
Commencing at a point formed by the
intersection of the east right-of-way line of
Olive Street and the south right-of-way line
of Calvert Street; thence west along said
south right-of-way line of Calvert Street to
west line of the east 1/2 of the Southwest
Quarter (1/4) of Section Fifteen (15) Township
Thirty-seven (37) North, Range Two (2) East;
thence south to a point (intersecting with the
present city limits) two hundred (200) feet
south of the north line of Section Twenty-two
(22) Township Thirty-seven (37) North, Range
Two (2) East; thence west (along present City
limits) to the east line of Section Twenty-one
(21), Township Thirty-seven (37) North, Range
Two (2) East; thence north (intersecting with
the present city limits) to the south line of
Section Sixteen (16), Township Thirty-seven
(37) North, Range Two (2) East; thence (along
the present city limits) west along the south
line of said Section Sixteen (16) to the west
line of the Southeast Quarter (1/4) of said
Section Sixteen (16); thence north (along the
present city limits) along the west line of
the Southeast Quarter (1/4) of said Section
Sixteen (16) to the northeast corner of the
Southeast Quarter (1/4) of the Southwest
Quarter (1/4) of said Section Sixteen (16);
thence west (along the present city limits) to
the northwest corner of the Southeast Quarter
(1/4) of the Southwest Quarter (1/4) of said
Section Sixteen (16); thence north 1800 feet,
more or less, (along the present city limits)
to the north right-of-way line of the
abandoned Michigan Central Railroad; thence
west (along the present city limits) along
said right-of-way line to the west line of
said Section Sixteen (16); thence north 975
feet, more or less, along the west line of
said Section Sixteen (16) to the south line of
Belleville Gardens Second Addition; thence
east 1985 feet, more or less; thence south 30
feet, more or less; thence east 535 feet, more
or less; thence south 100 feet, more or less,
thence east to the west line of the west
one-half (1/2) of Section Fifteen (15),
Township Thirty-seven (37) North, Range Two
(2) East; thence south 800 feet, more or less,
along the west line of said Section Fifteen
(15) to the north right-of-way line of the
Penn Central Railroad (Old Pennsylvania
Railroad); thence east along said railroad
right-of-way to the east right-of-way line of
Olive Street; thence south along said
right-of-way line to the point of beginning.
to be a blighted area within the meaning of the redevelopment of
Cities and Towns Act of 1953, as amended, and amended the
Development Plan (Plan) for the Area by expanding the boundaries of
the Area; and
WHEREAS, the Commission submitted its Resolution No. 783 and
the Development Plan, to the Area Plan Commission of St. Joseph
County for approval pursuant to the provisions of Indiana Code
36-7-14-16; and
WHEREAS, the Area Plan Commission of St. Joseph County at its
regular meeting September 16, 1986 adopted its Resolution No. 90
which Resolution constituted the written order of the Area Plan
Commission of St. Joseph County approving Resolution No. 783 and
the Development Plan pursuant to IC 36-7-14-16; and
WHEREAS, the Commission submitted to the South Bend Common
Council, legislative body for the City of South Bend, St~ Joseph
County, Indiana, Resolution No. 90 of the Area Plan Commisison of
St. Joseph County, constituting the Area Plan Commission's written
order approving Resolution No. 783 and the Development Plan and its
certification that the Development Plan conforms to the master plan
of development for the City of South Bend; and
WHEREAS, the South Bend Common Council, at its regular meeting,
September 22, adopted its Resolution No. 1440-86 approving the
order of the Area Plan Commission of St. Joseph County with regard
to the Rum Village Industrial Park; and
WHEREAS, after receipt of the written order of approval of the
Area Plan Commission of St. Joseph County, Indiana, and approval of
that order by the South Bend Common Council, the commission caused
to be published notice of the adoption and substance of Resolution
No. 783, in accordance with IC 5-3-1, with such notice also stating
that maps and plats have been prepared and can be inspected at the
office of the Redevelopment Department and naming October 10, 1986
at 10:00 a.m.° at 1200 County-City Building, South Bend, Indiana,
as the date, time and place of the Commission's receipt and hearing
of remonstrances and objections from persons interested in or
affected by the proceedings pertaining to the proposed project and
to determine the public utility and benefit of the proposed project
for the Rum Village Industrial Park; and
WHEREAS, the Commission caused to be filed a copy of the notice
of the hearing on the proposed project for the Rum Village
Industrial Park in the office of the Area Plan Commission of St.
Joseph County, Indiana, the Board of Zoning Appeals, the Board of
Public Works, the South Bend Board of Park Commissioners and the
South Bend Building Commissioner, as well as any other departments,
bodies, or offices of the City of South Bend having to do with unit
planning, variances from zoning ordinances, land use, or the
issuance of building permits; and
WHEREAS, at the hearing held by the Commission October 101
1986, at 10:00 a.m. at 1200 County-City Building, South Bend,
Indiana, the Commission heard all persons interested in the
proceedings and received written remonstrances and objections
that had been filed, and considered those remonstrances and
objections, if any; and
WHEREAS, the Commission is cognizant of the conditions that are
�' imposed under Title VI of the Civil Rights Act of 196,4, as amended,

�� providing that no person shall, on the grounds of race, age, sex,
color, religion, or national origin, be excluded from participation
in, be denied the benefits of, or be subjected to discrimination in
the undertaking and carrying out of any federally-assisted project.

NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION, as follows:
1. After considering the evidence presented at its hearing October
10, 1986, the Commission confirms the blight found and declared
by it in its Resolution No. 783, within the Rum Village
Industrial Park` and adopts and confirms the Findings of Fact
for that Area, Exhibit A, attached to this resolution and made
a part thereof.
2. The Commission finds and determines

3. Resolution No. 783 is hereby approved, ratified, and confirmed
without change.
4. This Resolution constitutes final action, pursuant to IC
36-7-14-17(c), by the Commission determining the public utility
and benefit of the proposed project and confirming Resolution
No. 783 pertaining to the Rum Village Industrial Park.
5. The Secretary is directed to record this resolution pursuant to
the requirements of IC 36--7-14-17(c).

Commission held on October 10, 1986` at the office of the
Commisison, 1200 County-City Building, 227 W. Jefferson Boulevard,
South Bend, Indiana 46601.

Rum Village Industrial Park
Findings of Fact
October 10, 1986
The South Bend Redevelopment Commission has conducted a study
of the Rum Village Industrial Park (Area) and has found that the
Area is blighted to an extent that cannot be corrected by regulatory
processes or by the ordinary operations of private enterprise
without resort to the Indiana Redevelopment Law, IC 36- 7 -14 -1, et.
seq. Blight is found in the Area based on the following facts:
1. The Commission finds that the portion of the Area
previously designated as the Rum Village Industrial
Park continues to be blighted due to the continued
existence of the unstable soil conditions which was the
original blighting condition. The high cost of
removing and replacing the unstable soil has been a
deterrent to private business operations that can not
be overcome by the normal development process.
2. The Commission finds that the portion of the Area
designated in Resolution No. 783 as Expansion Area No.
1 is blighted due to lack of development, cessation of
growth, and obsolesence. These conditions are present
because access to the buildings is partially located on
an adjoining railroad's right -of -way rather than on
land owned and controlled by the building owners.
These conditions are compounded by the fact that the
buildings in the expansion area lack little accessible
land area to expand or to modernize their existing
facilities.
