It has been determined that Ordinance 9790-07 be amended to adjust the salaries of all non-bargaining employees. This Ordinance, by its amended Attachment "1 ", sets forth the maximum amounts to be paid to non-bargaining personnel employed by the City of South Bend for the calendar year 2008. This Ordinance establishes such compensation for approximately 420 non-bargaining employees by specific position and title, certain of which positions were inadvertently omitted in Ordinance 9790-07 and are specifically identified in this Ordinance. Indiana Code 36-4-7-3(c) provides that the Mayor may increase compensation fixed under the City's wage ordinance during the budget year for which it is fixed. The Mayor has confirmed that this ordinance will not increase the gross City budget for 2008, and that approval of this ordinance is in the fiscal best interest of the City. To achieve the intent of the relationship between the City and its employees, it is necessary that the effective date of this ordinance be January 1, 2008. This Ordinance is in the best interest of the City and the affected non-bargaining employees. NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, as follows: Section I. Section I. of Ordinance No. 9790-07 be and hereby is amended to read as follows: Maximum Compensation (a) The maximum amounts to be paid as compensation for non-bargaining employees for the City of South Bend, Indiana are hereby established as set forth in the amended Attachment "1", which is incorporated herein by reference. The amounts set forth are consistent with the recommended procedure of the State Board of Accounts dated March, 1993. Accordingly, Bi-Weekly amounts by alphabetical position are set forth as well as the annual salary for each position. Section II. The new positions of "Records Bureau Manager" and "Records Manager" for the South Bend Police Department were erroneously identified in the attachment to Ordinance 9790-07_as_two different positions The actual new single position shall be titled "Director of Records" with a 2008 salary of $40 000.00 rather than $38,872.00. Section IV. All other Sections and paragraphs ofOrdinance No.9790-07 are hereby reaffirmed and shall remain in full force and effect as provided for in Ordinance No. 9790-07. Section V. Effective Date In order to effectuate the intent of the City, this Ordinance shall be in full force and effective from and after its passage by the Common Council, approval by the Mayor, and made retroactive to January 1, 2008. The difference in this Ordinance and the two previous versions of this Ordinance is in Section II. It turns out there were fewer job positions than originally thought which were omitted from the original Salary Ordinance #9790-07. The other difference in this Ordinance and its two prior versions is the attachment which lists all City jobs. To assist the Council in identifying the changes in this list of City positions and the list previously furnished, I also enclose a version of the attachment which identifies the changes by strikes and lines along with a summary sheet explaining the changes.
