All members present, Hear ing , had .ton ImDr ovement Res olut ion No. 642, f or 'the s idewalk on Le Salle Avenue from the Bridge over the St. Joseph River -to the.Bridge over the East Race, 3n the C it r of South Bend, Indians. Upon said hear in-g .aoremonstrator appeared , and no written remonstrance was filed And the Board being fuller, advised in the premises, decides that the bene- f its to pro erty liable to be assessed for said: improvements are equal to the- estimated cost of same, as reported by the City Civil Engineer, and thereupon takes final action on sale res olut ion as or ig inally adopted, and the same is hereby in all things, ratified, c on:f irmed and approved. Resolved further, that., notices be published on the 18th. , day of April 1919 and on the 25th., day of .April 1919 in the South Bend Daily Tribune, in said City, stat ing , that this Board will receive bids for the construction of said ' improvements up to 10: 00` A.M. on the 6th. , day of May 1919 L The Board reserves the right to reject any and all bids. t, Hearing given on Condemnation Res glut ion' r-ENO. for the Opening of Huron Street from. Alley West of Farris Street to alley east of Kosciusko Street ,-n the City of South Bend, Ind Iana. , In the above natter a large number of property owners appeared but no written remonstrance was filed. The property owners objected to paying any benefits for this opening, and the Board thereupon being fully advised in the matter takes final action on said resolution confirmjdg without modification all former action taken on the same. The, Board therefore declares the above property in all things conddmned and a.ppropjifated for public use, the Board now ordered that a list or roll be prepared of all theowners. or holders of property and of vaulable interests therein sought to be taken or - o be injuriously affected, which said list or roll shall also describe the property benef is iallk -affected, Property owners res id ing on Smith Street River 'Park from Wall Street to 2nd. alley North appeared before the Board and presented petition for water main, Same was referred to the City Water Department. This -being the date set for the consideration of bids received for the pavement of South Bend Avenue from Eddy Street to City Limits, the Board decided to defer al action on same until Tuesday April 22nd.,1919 at 10: 00 A.M. By unanimous consenn of the Board it was resolved that Improvement Resolution No. 587 for the pavement on Bartlett Street from Michigan Street to Lafayette Blvd be and is hereby resddnded, and a new resolution ordered prepared. By unanimous consent of the Boated it was resolved that improvement Resolution No. 589 for the pavement of Allen Street from Van Buren Street to Portage Avenue be, and is hereby rescinded, and a new resolution orderdd prepared. By unanimous consent of the Board Lit was resolved that improvement Resolution No. 590 for the psLvement of. -California Avenue from Portage Avenue to Blaine Avenue be, and is hereby ordered rescinded and a new resolution ordered prepared. - By unanimous consent of -the Board it was resolved- that improvement Resolution No. 592 for the pavement of Miami Street from ziorth line of Ewing Avenue to south City Limits be and is hereby rescinded. By'snanimous- consent of the Board it was resolved that improvement Resolution No. 595 for the pavement on Haney Avenue from Michigan Street to High Street be and is hereby rescinded. By unanimous consent of the Board it was resolved that improvement Resolution No. 610 for the pavement on Linden Avenue from Walnut Street to Anthony Street be and is hereby rescinded and. sew resolution ordered prepared. This Agre ment, Made this 16th ., day of April 1919 by and between White omb and Kell r party of the f ills t part and the City of South Band, Indiana, by and :through its -Board of Public Works, 'party of the sec cad part, W.ITNESSE'T'H: - ' That, Whereas-, the party of the first part is the owner of certain 9dd ions in the C ity - of S outh Bend known as Edgewater Place Add it ion to said City, and that all the lots and land in said Add it ion is owned by the party of the first part, and said° party of the first part desires to haveall the streets running through said addition aved, and has petitioned the Board of Public Works df the party of the second part to have' the same done and to have the cost thereof assessed against the land in the f orm and manner as pr ov ided by law. And, Whereas, the said party of the second part does not now have money suffic ient in its intersection fund to pay all the post of paying street intersections which cost would".be assessed against the City: - Therefore, in con iderat ion that the said party of the. second part, through its Board, shall cause said streets to be paved during the year 1919, then the party of the f irst part agrees t o pay upon the c omplet ion of sa id work and the approval of the assessment roll therefor, one-half of the cost of paving all street intersections as aforesaid, or said Board may at its option assess said one-half of the cost of paving street intersections against the lots and land of the party of the first part in add it ion to other assessments to which such land is subject. It is hereby understood that the cost of ,all improvements on Edgewater Drive shall be assessed against the lots of Edgewater Add it ion . I City Civil Engineer F. J. Anderson reported the following tabul at ions can bids received Tuesday April 15th. ,1919 and the awards were made : as follows: - Concerning the Improvement of the roadway of Calvert Street .from Michigan Street to High Street with asphalt, as�040ti_cconcrete, Bitulithic enneret a or brick in pursuance to res olut ion No.. 621 the Board on the 15th. , day of April 1919 pub; icly opened and read and considered all bids, and then continued their meeting to this 16th. , day of April 1919. Now On the last named date the Board designated Asphaltic concrete'µ' as the. kind of pavement with which said street is to be improved and fixes the 28th. day : of April 1918 at 10: 00 A.M. as the time when petition for changing the kind of Pavement must --be filed, s'Lnd the Board hereby c ont inues this matter until the 29th. , dp day of April 1919 at 10:00 A.M. Contracts for pipe sewers were awarded .on Fisher Street, Jackson Street and Fcllflws Street to L. H. Webster. Bids on High Street pipe sewer above estimated cost, bids rejected and by unanimous consent of the Board resolution was rescinded. Mr. Fred W. Keller appeared before the Board in regard to agree- ment for street intersections on Edgewater Place as follows:-
