Mgr. of the Chicago, South 13en� &.Northern Indiana_Railway Company appeared before the Board at their request. And the_metter of the sidetrack on Greenlawn Avenue off of Mishawaka Avenue was discussed and he advised the Board that his company, intended to use this sidetrack for to, ruik cars into: their property, v petition -filed by John J.. Ol jniezak Councilman 6th. , Yard and Jahn Kush Councilman at large for lights on the following streets. Same were ordered placed.. Remove light from Corner Meade Street and'Poland Street to Dvm:ham Street and Meade Street, Place large light- at corner of Meade St. and Ford Street. Place small light at corner of Jackson and Ford Street. Place small light at corner of Brookfield and Ford Street. - place large light at 1st. alley cast of Walnut Street and Poland St. Place small Might at cor. Libert and Dunham Street. Petition received read and referred t_o the City Engineer for a resolution on the opening of Huron Street from Koscisuzko Street to Walnut Street. The Board ordered a thirty day (30) day notice sent to party owing . property at the corner of Brookfield Street and Huron Street on the north side, and if the same is not put in the Board will order this in under City contract. Resolved by the Board of Public Woks of the City of South Bend, St, Joseph County, State of Indiana, That it is deemed heeessary to improveVarious Streets in the City of South Bend, Indiana. That an improvement to be made of the kind s ize, location and terminal points as follows, to --wit: - That bids be received- for the construction and repairing of cement side -walks, curbs and for filling timid excavating; for said sidewalks and ourbs, on different streets in said City,'where the same have already been partly constructed, or defintely constructed, All such work to be done after the owners of abutting. property have been ordered and notified to construct or re- pair such sidewalks and curbs for a period of 30 days from the date. of any such notice, All.work to.be constructed or repaired in accordance with Standard Spec if icat ions on file in the office of the City Engineer of said City. All work to be done and assessments made as provided in Section 1 of an Act entitled " An Act Concerning Municipal Corporations, approved 19091, at pages 412 , 413. in accordance with the profile, details, drawings and specifications on file in the office of the Department of the Board of Public Works of said City; and such improvements is now ordered. ° The cost of said improvement, including the cost of street sand alley intersections a, shall be assessed upon the real estate abutting on Various Street all according to the method and manner provided for ' in an Act of the General Assembly of the State of Indiana,, -entitled " An -Act Concerning Munddopal Corporaiiions, " approved March 6,1905, and in ace ordanee with and pursuant to the prov is is ions- of all amendatory and supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual installlmentg, with in- terest -at tiie rate of Six per cent per annum. A bond or bonds shall ba- issued to. the contractor in paymen-t for such work, unless the property owners pay said assessment before said bond or bonds are issued. Under no circumstances shall be City of South Bend, it or be held responsible for any sum or sums due from said property owner or owners f v-P said work or for the collect ion of the Same, or for the payment 6h any bond, bonds, certificate or certificates, aissued to said entractor in payment for such work, exempt for such moneys as shall have been actually received by the City from the assess- ments- for such improvement, or such. moneys as said City is by said above entitled Act -required to pay. All proc-aedings had, and work done in the making of said improve- ment, assessment of property, collection of assessments and issuance of bonds therefor, shall be as provided fn in said above entitled Act and amendments thereto. It was further resolved by the Board that bids be advertised on the %th., day of March 1919 and on the 14th., dayof March 1919 in the South Bend Daily Tribune, stating that this Board will rec.e iye bids on March 25th. ,1919 up to 10: 00 A.M The Board reserzres the right to reject any and all bids. It was decided that G. A. Elliott President of the Board of Public Works and T. W. Slick, City Attorney should go to Indiinapolis in regard to certain features of` the -#rack elevation matters and consult with the.
