F. J. Anderson City Civil Engineer and Attorney T. W. Slick, City Attorney present.
This being the date set for purpose of considering the advisability
of considerring the resolution now on'' file and on -record for the Opening of a.
Highway from Sample Street to Ewing Avenue. under QmndemnatIon Resolution No. 20
adopted. 19th., day of November 1912, In the above matter Judge W. A. Funk,
ind W. B. Calvert appeared for said .opening, Attorney W. F. Dinnen, representing
the New York Central Railway Company, Attorney W• G.. Crabill, A. D. McKnight,
Agent and an Engineer appeared for the Grand Trunk V. Ssystem and objected to
opening of this highway, No written objections being filed. 'the Board decided
to defer all action on this proceeding indefinitely. Dr. C. H. Meyers appeared
before the Beard being: late for the hearing , and as he is one of the interested
petitioners informed the Board he would file a never petition in the near future
for the opening ;of a highway from Sample Street 'Ewing Avenue, the same as the one
mentioned in Crademnation Resolution No. 20 adoptT�Nov. 19,1912. this meeting
was called on request of interested petitioners for said opening.
The Board discussed the matter of erecting a new hose house
some place in River Park,; and decided to look around for a suitable site.
The following resolutions were aoppted: by the Board.
LOCAL SEXIER IMPROVEMENT RESOLUTION NO. 619.
Resolved by the Board of Public Works of the City of South Bend,
County of St. Joseph, State of Indiana.That the construction of a local sewer,
intneded and adapted fnly for local use' by the property holders whose property
abuts thereon, and not intended or adavted for receiving sewerage from collateral
drains, be.and the same is, hereby ordered in and along Lincoln Way West from a
point approximately 1436 feet west of the center line of Olive Street to the
westerly City Limits as follows, towit: _
Beginning sk the center line of Lincoln.
Way West approximately 1436 feet westerly from the center line of Olive Street
thence westerly along the center line of Lincoln Way hest to the center of the
Crumstown Road with a 15 inch vitrified pipe sewer; thence still westerly along the
center line of Lincon Way West to the westerly City Limits.. with a 12 inch vitrified -
pipe sewer;togethrrwith the necessary manholes, storm water water inlets, con-
duits, flush tank and house connections to the curb line along the line of said
improvement, all ds is more particularly shown and all in accordance with the
plan, profiles, detail drawings and specifications on file in the office of the
Department of Public !forks of the City of South Bend, Indiana,, and said sewe4,
with all its appurtenances shall be constructed in accordance with the profile, -
and specifications now on file in the office of the Department of Public Works of -
said City, he cost of said improvement shall be apportioned against_ and. -paid .by
the property. holders whose property abuts thereon, and upon the City of South Bend,
if the City is benefitted by said Improvement, all according to the method and
manner provided for in Act of_the General Assembly of the State of Indiana, entitled
" An Act Concerning Municipal Corporations, " approved March 691905. Assessments,
if deferred, afire to be paid in ten equal annual installments with interest at
the rate of Six pe;r ecnt per e.nnum. A bond or bands shall be issued t-otthe con-
trActee in:payment for such wolk, unless the property owners pay said assessments
before said bond or bonds are Issued. Under no circumatances shall the City of
South Bend be ter be held respoyisible for any -sum or sums due from property owner
or owners for said work, or for the collection of same, or for the payment of any
bones ar bonds; certificate or certificates, issued to said contractor in payment
for'such work, except such moneys as shall have been actually received by the City
from the assessments for such improvement, or such moneys as said City is by
said above entitled Act required to pay,

STREET OR ALLEY 'TMPHOVEI1wNT RESOLUTION NO. 620. -
Be. 1t, ites_olv.ed, by, the, Board, of, Public Works of the; City of SSouth Bend,
St. Joseph County, State of Indiana, that it is desired and deemied necessary to improve
Keasey Street from,Carroll Street to Sigh Street as follows, ttowit: -
Said atrtat shall be
graded and the roadway thereof shall be paved; and also the roadway of certain portions
of the streets and alleys which enter or intersect said strec-t shall be graded and
paved. The paving material to be used in making 'said improvement -shall be Sheet
Asphalt, Bitulithid, Asphaltic concrete or Brick and the foundation shall be Portland
ceraenitconcrete five (5) inches thick fbrc he sheet asphalt, bitulithic, a.sphaltie
concrete a,nd brick, gar rolled gravel six (6) inches thick for the Bricks alss the cement
curb now In place on said street shall _be taken out and a concrete combination curb
and gutter shall be constructed along s&;id street; storm water inlets and conduits
shall be constructed where necessary; all manhole tops and storm water inlets shall be

alleys where necessary, all as is more particularly shown and all in accordance with
the prof Iles, plans,.. detail, drawings and spec if icat ions on f ile in the, off ice of the
'Department of Public Works of the City of South Bend, Indiana.
The Cost of the improvement herein provided except street and alley lntenv-0mis, shall be paid hy_,

The cost of all street and alley intersections, including one-half of the width .of the improvement,. oppo-
site Street and alleys which run into, but do not cross said roadway herein proposed to be improved aild that

assessment, shall be paid by the City in cash out of its general fund, it able to do so, or from a fund ore-

Asger-sments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual in-
