absent.
This being the date set for deferred hearing on assessment, roll
and final estimate for pipe sewer on Columbi& Street from Inds ana Avenue to 70 feet
north of Dubail°Avenue, under Improvement Resolution No. 582.
In the above matter property owners appeared and Attorney Goo.
Schock appeared'r.epresenting property owners interested in ass*ssment against Lot
92 Bowman Place .Addition and objected to part of this lot being assessed.
The Board after due consideration decided to modify assessment on 1®t 92 and ordered
the assessment on the east half of lot 92 Bowman Place Add. be assessed to the City
and thewest haff to Grace A. Dubail property owner as shown in red on assessment
roll, and the Board therefore finds that 'all other property assessed in said rolls:
filed Dec ember '28th. ,1918 is benef itted in tho amount of assessments as shown on
said rolls, and'the Board further find that the assessment roll filed December 28th.,
1918 and the_firial estimate allowed December 28th:,1918 should be and the same is
hereby in all things ratified, confirmed and approved as modified.
T74is being the date set for -the consideration of the advisability
of the paving of Lincoln Way West from Olive Street to the City Limits.
Mr. Joseph Kaley, Mr. C. W. Hyde,Mr. Drain , E�, T. Bonds and Mr. Ridinnur , property
owners on said street met with the Board and stated that they were in favor of this
pavement going in, ill' the City would see. -that all other underground work was put in
first. The Board advised those property owners that this would be given consideration.
This being the date set for the consideration of the advisability
of paving South Bend Avenue from Eddy Street to City Limits. Attorney Wm. Bergan,
representing a number of property owners appeared before the Board and objected to this
pavement being put in at this time. Mr. Behr property owner stated he was against
pavement . Pro. Greene representing his brother -Jerome Green and Mr. Luce against this
pavement going in at the present time. Delbert Thompson and ' G. W. Arehart, property
owners on said street appeared for said improvement, and also informed the Board
that some of the other property owners not present were in favor of the pavement
going in, but they did not want to see a narrow strip in the middle of the street,
but wanted a first class pavement from curb to curb when the same was put in.
Attorney Stuart McKibben and Engineer McClellan representing the County explained
how the County intended to improve their part of this road and showed the property
owners the advantage it would be to have this street paved at this time when the
C ount.p is paving theirs as to the grade and the filling in. of their dirt.
The Board after due consideration ordered a resolution prepared for a 12 foot
Concrete roadway on South Bend Avenue from Eddy Street to.City Limits, and to sot
same for hearing, and if property owners wanted other type of pavement to present
an 80% petition before the night of the hearing or before Wed. February 19th.,
1919.

LOCAL SEWER IMPROVEMENT RES OLUT ION NO. 597.
Resolved by the Board of Public Works of the City of South Bend, county
of St. Joseph County, St#te of Indiana. That the construction of a local sewer, intended
and adapted only for local use by the property holders whose property abuts thereon,
and not' intended or adapted for receiving sewerage from collateral drains , be and the
same is hereby ordered in and along Brookfield Street from Ford Street to a point 110
feet s puth of the south line of Div is ion Street as follows, to -wit: -
Beginning at the
intersection of the center line of. Ford Street and Brookfield Street ; thence north along
the center line of Brootfield Street at a port 110 feet south of the south line
of Division Street with a 12 inch vitrified pipe sewer. Together with .the .necessary
manholes, storm water inlets, conddts, flush tanks and house connections to the curb
line along the line of said improvement, all as is more particularly shown and all in
accordance with the plans, profiles, detail drawings and sFee if icat ions on file in the
off ice of the department' of Public Works of the City of South Bend, Indiana, and said
sewer, with all its appurtenances hhall be constructed in accordance with the profile
and, spec if ications now on. f ile inthe off ice of the Publie Works of said City. The cost
of 3sid_ improvement -hall be apportioned against d6hd paid by the property holders whose
property abuts thereon, and upon the -City of South Bend if the City is benef itted
by :raid improvement., all according to the method and manner provided for in_ Act of the
General Assembly of the State of Indiana, entitled ".An Act Concerning Municipal
Corporations, "approved March 691905. Assessments, if deferred, are to be paid in
ten equal , annual installments, with interest at the rate of. Six per cent per_ annum. A
bond or bonds shall be issued to the contractor in payment for such work, unless the
property owners pay said assessments before said bond are issued. Under no c1rcumstances
shall the City of South Bend be or be hold responsible for any sum or sums due from
said property owner or owners for -said work, or for the collection of same, or for the
payment of any bond or bondsm certificate or certificates, issued to said contractor
in payment for such work except for such moneys as shall bbeen received by the City
from the assessments for such improvement, or such moneys as said City is by said above
en'4itled Act required to pay. All proceedings had, and work done in the making of said
improvement, assessment of property, collections of assessments and issuance of bonds,
tharef or, shall be as provided for in said above entitled Act;
Notice of this ].reaolut ion shall be published on the 25th. , day of
January 1919 and on the 1st.9 day of February 1919 in the South Bend Daily Tribune.

Resolved by the Board of Public Works of the City of South Bend,
County of.St. Joseph, State of Indiana, That the construction of a local sewer,
