The Board ordered that the Indiana & Michigan Electric Company be notified to place an 80 C. P. Teeple (the building inspector j with gross neglect in building and inspection of*athe'chimney in house No. 723 and 725 Cottage Grove Ave. let. The contractor, James Brink, did not build according to contract or building code. 2nd. The inspector W. D. Teeple, as negligent as to duties and firs precautions. 3rd. The inspector failing to enforce the rules of the building.code, the City is responsible for damage and rebuilding of the chimney. The rebuilding of tl.e chimney and other necessary expense connected Faith sgme are about $190.00 for which I hold these three partIes responsible. The City or South Bend, James Brink and W. =D. Collins, together with mill available inspection records concerning same Violation of Cede is clear and supported by ample evidence. Responsibility of parties conce_-ned can better be determined by City AtterVey than myself. I personally reported chimney to C. A. Perkins and took him to Job myself twice where Mrs. Collins saw him. Inspection was hindered and obstructed by contractor in every possible way.- I strongly urged Mr. Perkins to prosecute at the time but he refused to do se, nor can I fInd any record of his. inspections or findings on file. I recommend that James H. Brink be prosecuted if statute of limitations hots not prevent, and confronted with jail seatnee in case he does not settle all damages.
