Accept two properties from the Redevelopment Authority
Date: July 26, 2012
While preparing to take the remaining seven Housing Development Corporation (HDC)
properties in the Monroe Park area through the disposition process, staff discovered there
are two vacant lots that should also be taken through this process. Both lots are next to
properties with houses on them, and can be combined with those houses when sold.
Like the other HDC properties, these lots are titled in the name of the Redevelopment
Authority (Authority), and need to be transferred to the Commission for disposition
purposes.
A resolution authorizing this transfer was approved by the Authority on July 18, 2012. Once
both bodies have approved their resolutions, deeds will be prepared to transfer these lots in
to the Commission's name.
Resolution No. 3050 approves the acceptance of these lots from the Authority, thereby
allowing their eventual disposition.
Staff requests approval of Resolution No. 3050.

RESOLUTION NO. 3050
A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
ACCEPTING THE TRANSFER OF REAL PROPERTY
FROM THE SOUTH BEND REDEVELOPMENT AUTHORITY
WHEREAS, the South Bend Redevelopment Authority (the "Authority ") is the owner of
certain property identified herein; and
WHEREAS, pursuant to I.C. 36- 1 -11 -8, the Authority, may transfer or exchange property
with another governmental entity upon terms and conditions agreed upon by the two (2) entities as
evidenced by the adoption of substantially identical resolutions of each entity; and
WHEREAS, the South Bend Redevelopment Commission (the "Commission "), the
governing body of the South Bend, Indiana, Department of Redevelopment (the "Department ") and
of the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment District "),
exists and operates under the provisions of I.C. 36 -7 -14, as amended from time to time (the "Act ")
and is a body corporate and politic; and
WHEREAS, the Department, by and through the Commission, has presented to the
Authority, a request for the transfer to the Commission of certain real property previously acquired
by the Authority as follows:
1. 518 Rush Street (vacant lot)
2. 632 Lincoln Way East (vacant lot)
(referred to as the "Property"); and
WHEREAS, the Authority, desires to transfer the Property to the Commission for the
redevelopment purposes of the Commission; and
WHEREAS, on July 18, 2012, the Authority adopted resolutions consistent with the
requirement of Indiana § 36- 1 -11 -8.
NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
COMMISSION AS FOLLOWS:
1. The transfer of the following real property situated in St. Joseph County, Indiana:
1. 518 Rush Street (vacant lot)
2. 632 Lincoln Way East (vacant lot)
by the Authority to the Commission, without consideration, shall be, and hereby is, approved and
authorized.
2. The Director of Redevelopment for the City of South Bend shall cause the recording
of each quit claim deed conveying all of the right, title and interest of the South Bend
Redevelopment Authority in and to the Property to the City of South Bend, for the use and benefit of
its Department of Redevelopment.
3. This Resolution shall be in full force and effect upon its adoption.
ADOPTED at a meeting of the South Bend Redevelopment Commission held on July 26,
2012, at 1308 County -City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601.
