Deferred hearing had on resolution for the opening of ally north of Madison Street from Lafayette Blvd. to lst. alley ,west under .Condemntion Resolution No. 52, In the City of South Bend, Indiana. In the above matter Mr. Bugbee and Mr. Harry Schock, property owners in favor of said opening, appeared before the Board also Attorney. H. W. We it representing the School Board was present. The Board after due consideration decided to, sustain the remonstrance ; iled by the School City under date of September 25t h. ,1918 and as shown on pa9e321 and 322 of this record, and informed property owners present that they would have the School Board give an easement to the City to toDke care of utilities wires if this is every ordered in the underground district. The Board therefore deferred the rescinding of said resolution until such an agreement was received from the School Board and deferred this matter until Wednesday October 16th. ,1918 at 7:15 P.M. Deferred hearing had on assessment roll and final estimate for High Street and Ewing'Avenue Trunk sewer system under Improvement Resolution No. 503 In the City of South Bend, Indiana. . In the above matter :remonstrators appeared and written remonstrances were filed. ( The Board waived Jill rules in regard to fhe filing of written remonstrances and allowed same to be filed at this hearing.) The Board after considering written remonstrances and lifter- hearing &LI interested property°owners present, the Board decided to defer this hearing until Wednesday October 16th., 1918 at 7:15 P.M. ( The following property owners present at above hearing Mr. J. Chillas and Wm. Studebaker representing the Studebaker Heirs, Attorney Miller Guy, and Forest Hillier and Charles Weidler.) The following remonstrances read and placed on file. CITY OF SOUTH BEND, IND IANA . IN THE UTTER OFTHEHIGH STREET AND EWING AVENUE TRUNK SEWER SYSTEM. BEHFRE THE BOARD OF PUBLIC WORKS, REMONSTRANCE OF CHARLES-WEIDLER. TO THE BOARD OF PUBLIC WORKS, Comes now Charles Weidler as the owner of the Lands and lots described in the assessment roll .for said improvement to which reference is had for greater certainty and description. And said Charles Weidler hereby bemonstrants against all indirect benefits assessed against all of his said lands; and says that his said lands and lots there- in described and -w-d11 not be benefited to the extent of the indirect benefits assessed him, against said lands. Chillas, Lydia S. Chillas, Clement W. Studebaker Edith V. Gingrich, Emma E. Bowman, William K. Studebaker, Peter E. Studebaker, and Arthur H. Studebaker, and say that they are the Owners of the following described real estate situate in South Bendy said County and State; The east one half (I`) of the West one- half )�) of the Northeast quarter (j) of Section 249 Township 37, Range 2 East, lying north of the South City Limits. f3 Your -petitioners further say that their land has been assessed the sum of $2,63L.34 for the immrovem&nt known as the High Street and Ewing Avenue Grand Trunk sewer system. Your pet it loners remonstrat against se.id assesment and say that the Xmount so assessed against said property, -as aforesaid, is excessive and that such real estate is not benef itted by such improvement° in 'such amount; that the land of remonstrators , as aforesaid, will not be benef itted ` by such improvement in an amount of more then Seven Hundred Dollars ($700.00) Wherefore these remonstrators pray your ,Honorable Board that their said assessment against said real estate be modif ied and reduced to Seven Hundred Dollars ($700.00).
