Hearing had on assessment Poll and final estimate on Trunk Sewer System on High Street and Ewing Avenue, under Improvement Resolution No.. 503 adopted on the 28th.9 day of March 1917. In the City of South Bend, Indiana. a In the abovemat.ter remonstrators appeared -and x written remonstrances were filed. { Property owners -appearing were J. M. Chillas of the Studebaker_ Heirs, and Biller Guy representing property -owners.) The Board after due consideration decided to.defer this he_aring.until Wednesday October 9th.,1918. at 7:15 P.M. To the Honorable'Board of Woikss- We, the undersigned, property owners assessed for the construction of the High St and Ewing Avenue Trunk sewer system, do hereby object to the acceptance of said work until completed. As owners of the following described real estate in the City of South Bend, Indiana, towit: -- Beginning an the south line of Victoria Street 680 feet west of the center of Miami Street; thence south 815.3 feet; thence east 225 feet; thence north to.a point 225 feet east of the place of beginning; thence west to the place of beginning: I hereby remonstrate against the assessments of special benefits both direct and indirect, and for cause say, that Q27 WHEREAS,athe said Board of Public Works has assessed `against said real estate the sum of $336 122 dirF*ict and $487.57 indirect benefits. Upon said hearing no remonstrators appeared and no written remonstrance was filed. And the Beard` be ing fully advised in the premAses, decides that the benefits to property liable to be assessed for said improvements are equal to the estimated cost of the same, as reported by the City 8iv it Engineer, and thereupon takes final action on said resolution as originally adopted, and the same is hereby in all things ratified, c onf irmed and approved. Resolved further, that notice be published on the 4th , day of October 1918 and the llth., day of October 1918 in a newspaper of general circulation in s'aid City, stating that this Board will receive bids for the construction of said improvements up to 10:00 A.M. an the 22nd. day of October 1918. The Board reserves the right to reject any and all b ids . Deferred hearing had an Condemtiat ion Resolution No. 52 for the opening of an alley north of Madison Street from Lafayette Blvd. to the 1st. alley west, in the City of South Bend, Indiana. In the above matter Attorney Chas. Drummond, Wm. Clem and Dr. Dugdale Members of the School Board of this City, Attorney H. fit, Weir, representing said School Board appeared before the Board and obJected to the opening ad said alley, Attorney Weir stating that the School Board took• the!- pays it ion- hi at it will be a great harm to the School City and the Citizens of the City of Sduth Bend ors take aby part of these premises for an alley, and mead to the Board the remonstrance filed at hearing. held September 25th. ,1918 at 7:15 anal explained Im-me, and stated that the School Board was unanixous �, in objecting to the opening of said alley. B- gbee, Mr. Roessler and a number of other interested property owners appeared in favor of the opening of said alley The Beard after hearing all persons interested in said alley - and against the opening of said alley, decided to take the matter of opening said alley under advisement for one week or until Wednesday October 9th. ,1918 at 7:15 P.M. The following communication received read and placed on file. October 2nd,1918. Board of Public Works, South Bend, Indiana. Gentlemen: - There is still some surplus material that shodid be removed from the streets in which the High Street and Ewing Avenue Trunk sewer was constructed, and in the event the assessment roll is confirmed by your Board, I would recommend that the sum of $1500.00 be withheld from the contractor until this work has been done. &espectfuliy submitted, FRE,DERICK J.
