Teeple Commissioner of Buildings appeared before the Board and presented copy of Ordinance for increase of salary_ for the City Electrician Which had been referred -back from the Common Council, and Mr. Teeple reemmended same, The Board placed same on file, no action taken. Pole and wire inspector made report on complaint about pale In alley in rear of 1200 block Clover Street.. The same read and placed on file_. The Board advised Mr. Corporan to get J. W. Vernon in to Board meeting Tuesday August 27th.,1918 at 10:)) A.M. ind have an underatan4ing at that time just what there is to be taken care of. The Board ordered that the gum of Five ($51=00) Dollars per month be paid Wm. Kr seder for house care ;and -the necessary repairs for .Steam Roller at the Central Puipp ing Station. The, -same to be paid out the Street and Alley Dept. , ,funds. , This being the date set for the deferred hearing on plans and specifications on Track Separation under Track Separation Resolution No. 2, it was unanimously resolved by the Board that this matter be deferred until Febrgary 18th.,1919 at 10:00 A.M..Clerk instructed is net ify all parties concerned for said meeting. No interested parties appeared in regard to the above on this date. The following waivers, with resolutions were approved by the Board. TO -THE HONORABLE MAYOR, BOARD OF PUBLIC WORKS AND CONTROLLER OF THE CITY OF SOUTH BEND, IND IANA: -- GENTLEMEN; The undersigned, Chicago, South Bend & Northern Indiana Railway Company desires to take advantage -of the prov is ion of an Act entitled " An Act Concirnin.g Municipal Crporat ions" approved starch 6,1905, and particularly Section 255, and all amendatory and supplemental acts thereto providing for the manner of paying for the paving e$dsforets and alleys in cities and towns, for the issuing and sale of bonds therefor and for the collections of same, and for such purpose hereby expressly waives all objections on account of illegality or irregulabry of the proceedings had for the improvement of by paving of Jefferson Boulevard from Michigan Street to the west and of the bridge over the St: Joseph River in the City of South Bend; Indiana, as designated in Improvement Resolution Number 564 adopted by said City, and request that said City take such action and do such things as may be necessary to entitled the undersigned to take advantage of the provisions of this act, and to include in the amount of the bonds to be issued or sold the ent ire cost of that part of the paving improvement properly chargeable and assessable against said company. WHEREAS, the City of South Bend, Indiana, by and through its Board of Public Works, heretofore by improvement resolution No. 564. caused Jefferson Boulevard, from Michigan Street to the west and of the bridge over the St. Joseph River, now in the City of South Bend, to be improved by pavng the same; and WHEREAS, the Chicago, South Bend & Northemt Indiana Railway Company occupies a portion of said street for the operation of its electric railway, and by the terms and c and it ions of its franchise is required to pave a portion of said street, and WHMMSm theportion of said street required to be paved by said Railway Company was paved by the Western Construction Company, a corporation of th z� City of Lafayette, County of Tippecanoe and State of Indiana, as contractor for such work, and same was completed by its as such contractor and accepted by the City of South Bend on the 7th.-, day of August 1918; and WHEREAS, the said Railway Company on the day of August ,1918 executed and filed with the said City of South Bend its st ipul at ion add agreement waiving objections on account of any illegality or irregularity in the proceedings had for such improvement of said street and requested the City to issue bonds to procure funds with which to pay that portion of the cost of said improvement chargeable against said railway company in the manner provided by an Act entitled , " An Act Concerning Munc ipal Corporations, " approved March 6th., 1905. and all amendatory and supplemental acts thereto: and 280 WHEREAS* its appears that the Amount chargeable to and payable to by said Railway Company by reason of said improvement amountd to the total sum of Six Thousand Thirty six and 62f 100(06, 036.62) Dollars with interest from_ the Be venth day of August ,1918 to the first day of December,1918; NOW THEREFORE, BE.IT RESOLVED, that ten bouds,be.issued in accord- ancewith the powers vested in said City by virtue of the provisions of said Act o the first of which bonds shall be In the sum of Six hundred four and 22k1O0 ($604. 22) Dollars, due November first, 1918, with interest evidenced by coupon attached to said bond onthe total east of said improvement, to -wit: --Six Thousand thirty six and 621100 - ($6036.62) Dollars from the 7th,mday of August .1917, to the -first day of December,1918, said interest being in the sum of One Hundred three and. 631100 ($103 63) Dollars. And the balance of which said bonds shall be due and payable respectively one (1) two (2) Three (3). Four (4) , five(5), six (6), seven(7) Eight °(8) and nine (9) y6ars after the said first day of. November ,1918 and each of said bonds (except said first bond) shall be in the sum of Six hundred three and 6glOO ($603.60) Dollars, end all said bonds shall be nymbered consecutively from o one to ten inclusive; and all of said. bonds (except the first thereof) shall have coupons attached evidencing the interest payable on said bonds, which interest shall be at the rate of Six (6,%) per cent per annum from the first day of December 1918, payable semi annually on presentatidn and surrender of the coupons as they severally mature,and the coupons of each bond shall be in the amount of the interest due semi annually on the unpaid balance of the total prinicipal sum of of all said bonds. Said bonds shall be payable in (awful money of the United States with- out relief from valuation and appraisement laws.,and attorneys' fees. Said bonds shall have the time priority over other liens as have assessments for other street improvements and shall be a f irst lien on all the property, assets and franchises of said Railway Company in the mariner and to the extent provided by law, Adopted by the City of South. WHEREAS, the City of South Bend, Indiana, by and through its Board of Public Works, heretofore by Improvement Resolution No. 544 caused Mishawaka Avenue -and Eddy Street from Jefferson Boulevard to Nineteenth Street now in the City of South Bend, to be improved by paving the same; and WHEREAS, the Chicago , South Bead & Northern Indiana Railway Company occupies a portion of said street for the operation ofs, its electric railway, and by the terms and c osd it ions of its franchise is required to pave a portion of said street; and WHEREAS, the portion of said street required to be paved by said railway Company was paved by the White, Construction Company, a corporation of the City of Milwaukee, Milwaukee County, State of Wisconsin., as contractor for such work, end same was completed by its as such contractcr and accepted by the City of South Bend on the 23rd.day of July 1918; and WHEREAS, on the 19th., dad ofeAugust,.1918, said Railway Company executed and filed with the said*City of South Bend, its stipulation and agreement wa iv ing objections on account of any illegality or irregularity in the proceedings had for such improvement of said street and requested the City to issue bonds to procure funds with which to pay that pottien of the cost of. sadd..imaprovement. chargeable against said. railway Company in the manner provided by an act entitled, " An Act Concerning Municipal Corporations,," approved March 6,1905, and all amendatory and supplemental acts thereto; and WHEREAS, it appears that the amount chargeable to and payable by said Railway Company by reason of said improvement amounts to the total sum of Eight -one Thousand five hundred fifty seven and 88 /100 ($81,557.88) Dollars with interest from the 23rd. day of July 1918, to the first day of December 1918. NOW THEREFORE, BE IT RESOLVED that ten bonds be issued in accordance with the powers vested . in said City by virtue of the provisions of said sect, the first of whit h bonds shall be in the total sum of Eight Thousand one hundred fifty six and 58/100 , ($8156.58) Dollars, due Novnamber first .1918, with interest evidenced by coupons attached to said bonds on the -total cost of *aid improvement to -wit:- Eight One Thousand Five Hundred fifty seven and 88/100 (*81,557.88)'Dollars, from the 23rd. day of July 1918 to the first day of December 1918, said interest being irithe sum of One Thousand Seven Hundred thirty nine and 91/100 (01739.91) Dollars. And the balance of which said bonds shall be due and payable respectively one (1)., two(2), three (3), four (4), five (5), six (6) seven (7), eight (8), and nine (9) years after the said first, day of November, 1918, and each of said bonds (except said first bond) shall be in the sum of eight Thousand One Hundred fifty five and 70/100 ($8155,70) Dollars, and all of said bonds shall be numbered consecutively from one to ten inclusive: and all of said bonds (except the first thereof) shall have coupons attached evidenc4Ag the interest payable on said bonds, which interest shall be at the rate of six (6%) per cent, per annum, from the first day of December,19180 payable semi annually on presentation and surrender of the coupons as they severally mature, and the coupons of each bend shall be in the amount of the interest due semi annually on the unpaid balance of the total principal sum of all of said bonds. 2 823 St d bands shall be payable in lawful money of the United Stares without relief from valuation and appraisement laws and attorneys' fees. Said bonds shall have the same priority over other l4fte as have assessments for other street Improvements and shall bea first lien on all property, assets and franchises -of said Railway Company in the manner and to the extent provided by law.
