Board met in regular session at 10: 00 A.M. All members present.
The Board contracted ,With Miller & Snake for three (3) curs of Indiana
Egg 6 X � inch. at '$6.25 per tan and as much more as is necessary forth* City Halls use,
subject however, to all government orders governing the coal situation and subject to any
change in the market supply.
Engineer filed estimated cost 8 Columbia Street Pipe sewer from Indiana
Avenue to 75 feet north of north line of Dubaii Avenue at . .. ....:..... $740.00

placed on file.

Gentlemen: -
Be. Your Honorable Board's Resolution 8-8-18, a copy of which, together with
c o z>y of notice served on the writer by V. C. Hastings, is hereto attached, I wish is
respectfully report as follows: -
I took full file . of all documents in. the case, properly
arranged lettered and indexed, to th City Attorney, to ascertain our, oxaet status
and powers in the matter, I had already made arrangements, which still stand, for labor,
to do the wreaking.
Mr. Slick informs me° that the sir ig ina l c and emnat ion not is a of 6-5-16
is defective in that (1) it should have been served on all .owners and -the lessee, ,and was
only served on V. C. Hastings. (2) It does not order or .provide For° the vacation of the
condemned bui ding. (3) That V. C. Hastings cannot be considered agent or in control
of the premises.
It also appears -that said premises are not fully and adquately described
in said notice.
The preliminary Condemnat ion> loot ice being defect ivi, it follows tkat
all subsequent proceedings thereunder were equally so, and void except as to V. C. Hastings
ind iv idually as an owner.
I question the lesseeship of the H. L. Loehr Decorating Co._, as their
lease expired some time since. It was in force at the time of issuanee of notice. I would
at present consider them as tenants or occupants.
Mr. Slick told me that for reasons above stated, the wrecking of said
building, involving as it would the removal of certain property and stock of the H. L.
Loehr Decorating Co., Occupants, might invllve the City in suit by them for damages.
After. a tole hone discussion between Messrs Slick nd Hastings, the
former told me the latter informed him he would cause the H. L. Loehr Co. to vacate
forthwith, beginning to -day, and at once thereafter proceed with effective wrecking
operations himself. I have .the building under close observation, and if this is done, it
seems to me the main object will have been secured; i e., to get the danagerous building
down.
Should there be any delay, I am even now wr it ing a second c ondemnat ion
notice, and notice to vacate, correcting theeniginak defects, and will be ready to proceed
vigorously to completion should occasion rise. It is evident that proceedings under
or ignal notice can only involve us in further and perhaps worse difficulties.
It is insterest ing to note that I have carried to successful issue
two Other condemnations having -the sme defects as this,.made bfore my assuming charge
here. I shall at once look up and correct any I may find -in the office, and whatever mist&
occur, this one will not be repeated. I have been In error in trying to force this to a
issue.
I consider this case closed; howeverlithe case itself is by no means,
closed, and will probably develop itself this month.

R E S GLUT ION.
WHEtEAS, theBoard of Public Works has received complaints from. the
Fire Department relative to the condition as a fire hazard of the property owned
by George H. Vernon C. Hastings and Burdett Hastings Norton described as a one
story frame shed in the rear of 214 Worth Michigan Street on Lot 76 Original Plat
of South Bend.
AND: WHEREAS ` the Board of Public Works has Ordered the building,
Commissioner. ,to ,take .up *4thot'herewners of this building the question of tearing
dawn the same, apd Whereas the Building Commissioner that they notified the owners
to repair, tear down or remove said structure,wbich notice has been served on said
owners in compliance with the Building Code, and no effort has been made by the
owners of saild building to remedy the condition.
NOW THEREFORE,
Bel it resolved by the Board of Public Works that theBuilding Com-
missioner is herby ordered to emply such persons as may be necessary to causo
such building `tol be torn down and to keep an accurate account of the actual expense
incurred and file an accurate statement thereof and descr iptlen of the reel estate
on which said buildigg was located, with the City Controller of the City or, South
Bend, in compliance with Section 17 Paragraph 1294 of the Ordinance 1918 adopted
December 21st., 1915.
And said Building Commissioner is further ordered to make due report
of_ his .proceedings under this order to the Boar.

Mr. W. D. Teeple with Mr. Head of the State Fire Marshal 'office
appeared before the Board in regard to the matter of the Hastings building. Mr.
Headadvised the Beard that he would take this matter matter up with Mr. Hastings
through his department, also Board instructed Mr. Teeple to pr®cede with their
orders in regard to the same.
The follo*Ug guarantee bonds were approved by the Board,

KNOW ALL'MEN BY THESE PRESENTS, That the Western Construction Company
as Principal, and the Aetna Caseualty & Surety Company, as surety, are hereby held
and bound to the City of South Bend,, Indiana, in the sum of One Thousand Three
Hundred seventy-six ($1,376.00) Dollars, for the paymnAt of which Drell and truly to
be made, they jointly and severally bind themselves , their heirs, executors, admin-
istrators and assigns by these presentsy,
The cond it ions of the above obl igat ions are such, that whereas the
above bound The..Western.Censtruction Company has completed the work under the
contract for the paving of Jefferson Boulevard from the East line of Michigan
Street to the west line of Bridge over the St. Joseph River, in the City of South
Bend, Indiana,.under _Improvement Resolution No. 564, adopted by the Department of•
Public Works, of the City of South Bend on the l9th. , day of February ,1918.
NOW if the above bound The Western Construction Company shall for -&
period of five (5) years from date maintain such pavement, and during duch time
shall make all repairs which may be necessary from :any ratting, crumbling or dis-
intregration of the materials, or which are caused by any imperfection in workmansh6p
and shall strictly observe and abide by Seetione 41 to 45 „ inclusive, of the Genera
Specifications, (Form C.) for street improvements, hereto attached , adopted by the
Department of Public Works of the City of South Bend, and shall fulfill all the
conditions and stipul tions therein contained, these obligations shill be void other-
wise to remain in full force and effect.

of Five (5) years from date mf maintain such pavement, and during such time shall make

materials, or whisk are caused by any imperfection in.workmanship, and shall strictly

The Board ordered that H. N. Barnes, City Contractof ro repair work
in the City be notified to repair and place the following extensions.
Connect up extensions at Corner Mishawaka Avenue & Eddy Street.
Mishawaka Avenue and Oakland Street,.
Mishawaka Avenue and Thrush Street.
Mishawaka Avenue and St. W. side Match
Factory.
Mishawaka Avenue and Greenlawn Ave.
Repair extension at S . W. corner of North Lafayette Street & Madison St.
at N. E. Corner of Wood Street and Madison Street.
The Board also instructed Clerk to notify property owner of Oliver
Theatre to repair sidewalk in front of same on Main Street.
Mr. John Foots, Sr., appeared before the Board in regard to being unable
be locate sewer tap at 624 North Main Street. The Board ordered that the Street Commissioner
send men to look for tap at above number and if same is found the above property owner
to reimburse the City for the cost of locating same, if no tap is found the Board ordered
that the Street Cmmissioner have one put in.
The Board ordered that the Street Commissioner be notified to
fix un the north abutment of the Ernsperger Street Bridge immediately.
Tile Board instructed the City Engineer to notify the following
real estate men to aa�r'as 'appraisers on the valuation of property condemned on Oakland
Street from Mishaiwaka Avenue to the St. Joseph River, under Condemnation Resolution
No. -51. Horace M. Kauffman, Philip Bondurant and F. C. Raff.

RESODUTION FOR SERVICE CONNECTIONS WITH MAINS
No. 584.
WHEREAS, the Board of Public Works do the 2nd.{ day of July 1918 did
adopt a resolution ordering and -requiring the permanent improvement of Portage Avenue
from alley north of Kinyon Street to the City Limits, by paving the roadway of the
same, and
WHEREAS, the City Civil Engineer has prepared and filed in the office
of this Board a report shoving' the number' and location .of the service pipes, main$,
donduits, laterals and connections which are, or will be necessary to accommodate
the Abutting property and the owners thereof with gas, waer, sewer, and other
conveniences and necessaries; and also said City Civil Engineer has prepared and.
filed with said office spec if ieat ions showing the material to be used and the manner
of laying -said service pipes, mains, ;conduits , lateral and onnections from the
mains . to the points inside of the curb lines.
THEREFORE, be it resolved by the Board of Public Works of the City of
South Bend, Indiana, that the report of the City Civil Engineer is adopted, and said
report and the specifications prepared and filed by him are made a part of this
resolution as fully and effectually as if copied therein at full length; and it is
Further ordered that all of such private connections with the sewer,- gas and water
mains be made at said street by bringing them inside the curb lines thereof.,
And be it furtherresolved that notice by publications for two,
successive days in the South Bend Tribune, a newsppper of general c irulat ion
print" and published in the City of South Bend, Indiana, be given to the Owners':.
of the property abutting upon said street to be improved directing them to make'
such sewer and water connections on or before the 3rd. day of September 1918 and
that if `said conditions are not made on or before said time ardin accordance
with the specifications and report on file in the office of the Board of Public
Works, then said Board will cause will cause the same tube made a,Ld will assess*
the cost thrreof against the property abutting upon said street, and shall do all
other things pertai ning thereto according to the prvosisions and requirements
of Ordinance No. 1842 adopted by the Common Couneul of the City of South Bend on
July 24,1916, and all otherosdinancess and laws* relating thereto.
And, be it further resolved and ordered that after the 20 day period
has elapsed for the making of said connections by the property owners, a notice shall
be published for two weeks, once each week, in the South Bend Tribune, a newspaper
of general circulation published in said City, requdst ing bids from contractors for
the making of such connections as have not been made by the property owners, and such
notice shall fix >aL day not earlier than ten days after the first of such publ scat iong
when bids shall be opened and a contract let for the doing of said work .
And be it further ordered that the Northern Indiana Gas & Elea.
Company, which holds a franchise from, and is empowered by said City to furnish
art if ical gas to the citizens thereof, and is engaged in said business in said City,
is hereby directed to make and install all service connections with its mains in said
street in accordance with the prvossisions of Ordinance No. 1555, adopted June 27,1910
and such other ordinances or laws applicable thereto; which connections are shown
upon the report of the City Civil Engineer, and which are hereby declared to be
necessary in supplying gas to the owners of property abutting upon said street.
Adopted this 12th., day of August 1918.

Mr. Feaser met with the Board and took up matter of a seven foot
difference an his Sot located --set the dornekdf -Indiana Ave:nue.c nd;the Va,ndalia Railway
Company right of way. The Board advised Mr. Feaser that they would take this mat#tpr

All of the above claims allowed. The Board instructed clerk to
Hold up electric lights bills for the Street lighting until further date, also claims
for steamroller,- from the Buffalo Springfield Steam Roller Company.
