The matter of condition of rant LaSalle Avenue sewer between Notre Dame Avenue and St. Peter Street, in regard to repair of same as per contract let to Bruno De Peape was discussed by the Board with the City Engineer. Mr. Bruno DePaepe having contract for repair of same appeared before the. Board and explained about the c and it ion of the sewer and it was mutually agreed that both parties agree to release each other from the contract as per the following release. WITNESSETII: Wheread, said first party did on the 16th., day of July 1918 let a certain public improvement contract to.said Brunei De Peape, party of the second part to relau the. sewer on East La Salle Avenue between St.'Peter Street and Notre Dame Avenue in the City of South Bend, and Whereas, said parties hereto are willing to proceed with said contract, but the condition of said sewer make the carrying out of said contract useless and the contractor reports that my further work that he might do would be of no value. NOW THEREFORE; Each of said parties hereto mutually release each otherfrom any liability -under any of the terms of the contract. It is further agreed that , the contractor will stop work as ofthis date, leave all materials in their present conditions and that the City of South Bend will relief the contract from any future l iab it ity under any City Ordinance for the guarding of any dpenings in the streets. It is further agreed that the Board of Public Works will allow Bruno De Peape the sum of 50 cents ($.50) per day from this date for the use of the material as it stands on the job until a contract i '. lot for the installing of said sewer. The Board adopted the following Trunk sewer. TRUNK SEWER IMPROVEMENT RESOLUTION NO. 583. RESOLVED BY THE BOARD OF PUBLIC WORK OF THE CITY OF SOUTH BEND, COUNTY OF ST. JOSEPH, STATE OF Indiana, That is desired and deemed necessary to construct a sewer in La Salle Avenue from the alley east of St. Louis Blvd. to the alley east of St. Peter Street, all in said City, which, from its size and character, is.not only intended and adapted for use by property owners whose property abuts along the line of said sewer, but is klos intended and adapted for receiving sewage from collateral drains already constructed or whisk may be hereafter con- structed, and the same is hereby ordered constructed inand along the following line in said City, to -wit: - Beginning at the intersection of the center line of the First alley east of St. Louis Boulevard and La Salle Avenue; thence east along the center line of La Salle Avenue to the first alley east of St. Peter Street with an 18 inch vitrfied pipe sewer. Together with the necessary manholes, storm water inlets, and conduits. Existing house connections shall be connected with the new sewer along the line of said improvement, all as is more particularlly shown and all In accordance with the plans, profiles, detail drawings and specifications an file in the office of the Department =of Public Works of the City of South Bend, Indiana. And to be built in accordance with the profiles, specifications detail plans, maps and estimates now on file in the office of the Department of Public Works of said City, which includes an estimate of the proportion that the cost of an 2.6 9. adequate local sewor4 built along the above line, bears to the cost ag the main surer, to be built as follows;- The cost of an adequate local sewer, built along the line above deser ibed, is hereby eat iwated and f ixod to be of the cast Of the main sewer to' be built along said line as above set forth, which proportion, as herein estimated and fixed, shall be taken and adeopted in all computations requiring a knowledge of the cast df such local sewer if buSlt along the line where the main sewer is to be built. Assessments' if' deferrad;' are to be paid in ten equal annual installments, with interest, at° the' rate° of sin` por' cent per' ennum. A bond or bonds shall be issued to the eontraotor in payment for` saki' 1Ybkk, unless the property owners pay said assessments before said bond or bonds are issued. Under no crieu®stanees shall the City of South Bend be or be held responsible for any sum or sums due from said property owner or owners for said work, or for the collection of the .same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by said City from the assess- ments for such improvements. All proceedings had and work done in the Instruction of said main sewer and its appurtenances, manner of assessment of property collection of assessments and issuance of bonds therefor, shall be as provided for in an Act of the General Assembly of, the State of Indiana, entitled " An Act Concerning Municipal Corporations, " in matters pertaining to the constitution, alteration and mai ntenanei of public drains and sewers, provid-l-ng for the construc-tion, alteration and maintenance of such sewers and drains, in such cities and within four miles thereof, also providing for the assessment of pro- perty specially benef itted thereby for the payment thereof, in whale or in part, and for 270 the collection of such assessments, repealing all laws and parts of laws in conflict therewith,, and declaring an emergency, approved March 6,1905, and all acts supple- mentary and amendatory thereto, passed by the General Assembly of the State of Indiana. Notice of this resolution shall be published on the 14th.g' day of 1 August 1918 nd on the 21st-0 day of August'1918 in the South Bend Daily Tribune,, This Board will give a hearing on this resolution at its office in the City - Hall on the 29th.0 dZy' of August 1918 at 7:15 P.M.
