HomeMy WebLinkAbout08/06/1918 Board of Public Works Minutes261 Board met in regular session at 10:00 A.M. All members present. Mr'. J. W. Vernon appeared before the Board in response to notice sent and . the matter of repairing sidewalk and refilling .alley along Eleventh Street River Park, where gravel was taken out of and as per contract with Fred Corporan was taken up, and the Board advised Mr. J. W. Vernon to see Mr. Fred Corporan and made the repair- to:sidswaik and refilling of public alley, or else the check for Two hundred and fifty- (25MO) Dollars now on file in the office would be used for the same. Fred Corporan,appeared before the Board in response to notice sent in regard to agreement signed in September 1917 in regard to excavation in alley and under sidewalk on Eleventh Street, River Park. Mr. Corporan agreed to get together with J. W. Vernon and report to the Board Tuesday August 13th.,1918 what had been taken care of. Attorney Chas. Hagerty appeared before the Board in regard, to release of Alex Bukowski contract on Wrnsperger Street Grade, curb and walk and,same,was approved as follo" MUTUAL RELEASE. THIS AGREEMENT made this 6-- ay of August,1918, between the City of South Bend, by and through its Board of Public Works, party of the first part, and Alex Bukowski, South Bend, party of the second part, Witnesseth: WHEREAS, said first party did on the 6th. , day of Apr i1,1918 let a certain contract to said second party for the construction of cement curbs and walks on Ernsberger Street in said City, and WHEREAS, said second party is ready and willing to perform said contract, and whereas disputes and differences have arisen between the City of South Bend and the Chicago, South Bend and Northern Indiana Ry. Co., as to the easement and title to the said. property on which said curbs and walks were to be laid, according to said contract, which disputed and differences will render the performance of said contract by secmd party impossible at this time. NOW THEREFORE, each of said parties hereto hereby release each other from the performance of said contract. Said first party likewise releases the United States Fidelity and Guaranty Company of Baltimore, Md., surety on said bond of said second party, all for the reasons set forth in the foregoing. Petition received for water main on Meade Street from Division Street south to Huron Street. Same referred to the Water Department. Mr. W. , D. Teeple, Acting Commissioner of Buildings appeared before the Board and took up the matter of the Hastings building , and the Board unanimously ordered that the Acting Bldg., Commissioner W. D. Teeple proceed to raise said building in compliance with section 1294 of the Building Codes and ordered to employ such persons as may be necessary to cause such bldg. to be torn down and to keep accurate account of the expense incurred and file accurate statement of same with City Controllerof this City. Mr., Chas. E. Starr, City. Electric inn ordered, by the Board to look over the electric wiring and replace and repair same if defective in the City Hail. Street Commissioner, D. C. Layton, took up matter of fixing up Olive Street near O'Brien Factory as per request of Geo. O'Brien. The Board advised Mr. Layton to notify. Mr. O'Brien to get a 'petition signed for said improvement, and present same to the Board. Mr. R. R. Smith, Gen'l. Mgr. Chicago, South Bend & Northern Indiana Ry. Company appeared before the Bmard.in regard to manhole severs between their tracks being to far up and touching motors on their cars. Permission granted Mr. Smith , that his company reset said manholes an the same to be underthm supervision of the City Engineer. 2 622 City Cmetery Sexton filed f inane ial statement for the month ending" July 31st . ,1918. Same° read and placed on file. The Board ordered notice given City Engineer .on Auly 16th. ,1918 for the preparing of a resolution for the opening of High Street from Dubail Ave to Dayton Street, rescinded and said report placed on file. Building Commissioner Teeple filed financial report of the Building Departmenf for the mnth of July 1918. The following communication with petitions received read and placed in file. August 2,1918. To the Han. Beard of Public Works, South Bend, Ind. Gentlemen: - Petitions are started for the improvements on South Michigan Street from Donmoyer Ave. to City Limits. one for street lights and the other for curb and sidewalk. We have been astonished to find 47 children of school age, 9 in the first half mile; and 38 in the second half mile. So marry large families have moved in recently and so malry start for their first year. Moreover, nearly half the frontage has been signed up in the second half mile with many to see yet. We expect to have both petitions in early next week. Very truly yours, Harvey S. Cover. Mr. E. T . Bonds appeared before the Board and the following written release was approved by the Board. South Bend, Indiana. May 9th.01918. WHEREAS, the South Bend home Telephone Company, as principal, and the American Surety Company of New York, as surety, did on the 28th.9 day of April 1910 file with the City Bf South Bend, Indiana its certain Contractors Bond known and number :�d as 779331 of the American Surety Company of New York; and WHEREAS, said South Bend Home Telephdne Company has been purchased by the Central Union Telephone Company and he South Bend Home Telephone Company has sur- renderedits franc hise: - NOWO THEREFORE, IT IS HEREBY ORDERED by the Board of Public Works of the City of South Bend, Indiana that said South Bend Home Telephone Company and American Surety Company of New York be released from any further liability on said bond and the said American Surety Company of New York is hereby released and discharged from fur- ther 1 iab it ity by reason of its said suretyship. DEHAVEN It was ;ananlmousl:yUordered by the Board that the City Attorney be notified to settle the claim against City of Mrs. Collie Bolin, also Anton Paslake, on basis as stated in his °letter of July 23rd.,1918 as follows: - July 23rd.,1918. Board of Public Works, South Bend, Indiana. Gentlemen: - I =m enclosing herewith the coarespondence in the above case. You will notice that the claim is one that erase under the former adminstrat ion, and Mayor Keller on Dec. 6,1916 offered to pay the doctor and hospital bill. Mr. Pattee in his letter of liar. 7th., makes the statement that the docbbr bill, hospital bill and X-ray expense ran in the neighborhood of One Hundred ($100.00) Dollars, and I am inclined to think that this amount is reasonable. ° I recommend the payment of one Hundred ($100.00)Dollars as a complete settie-- meat in this case Yours very truly, THOS. On June lot., I addressed a letter to your Beard In regard to the claim of Mrs. Bolin and advised an offer of $50.00 to settle this case. In my letter of June lot., I made the 'statement that in my opinion there is no liability. I intended to say that in my opinion the law of the case is with the City and not with the claimant, hence there would be no legal liability. This is; however, only an opinion and certain evidence might be introduced to change the law of the caser so that it would be with the claimant instead of the City. In view of these facts I suggested an offer to settle in the sum of Fifty ($50.00) and am still -of the opinion that it would save the City money to settle these claims. There'really.ire two claims, one in favor of Mrs. Bolin and one in favor of her husband., Alex-Badin- A- PT ovided lof course, that they can be settled for araud f ifty ($50.00)Dollars.
