GUARANTEE BOND. . KNOW ALL MEN BY THESE PRESENTS, That the White Construction Company as principal, and THE AETNA CASUALTY & SURETY COMPANY AS SURETY, are hereby held and bound unto the CITY 'OF SOUTH BENd, INDIANA, in the penal spa of THIRTEEN THOUSAND TWO HUNDRED FIFTY DOLLARS ($13,250.) for the payment of which, Well and truly to be made, they'jointly and severally bind themselves, their heirs, executors,-adminstra- tors and assigns by these presents. M CONDITIONS OF THE ABOVE OBLIGATION ARE SUCH, That whereas, the above bound THE WHITE CONSTRUCTION COMPANY on the 23rd. day of August,1917, entered into contract with the City of South Bend, Indiana, for the improvement of Eddy Street and Mishawaka Avenue from Jefferson Boulevard to the center of Nineteenth Street in trte City of South Bend, Indiana, with Sheet As halt and the Roadways of all Intersecting streets and alleys, under Improvement Resolution No. 5441, adopted by the Department of Public Works of the City of South Bend, Indiana, on the 3rd. day of July 1917, and Whereas, the said ' contract, plans, profile and specifications prov idd for the maintenance of said pavement for a period of five years from the date of acceptance, NOW THEREFORE,If the above bound THE WHITE CONSTRUCTION COMPANY shall for a period of five years from the date of acceptance by the Board of Public Works of the City of South Bend, Indiana, of such pavement, maintain such pavement, and during such time shall make all repairs which may be necessary from any rotting crumbling or disintregation of the materials, or which are caused by any imperfection in workmanship, and shall strictly observe and abide by Section 41 to 45 inc lus ive of the General Specifications (Form C for Street Improvements, hereto attached, adopted by the department of Public Works 8 the City of South Bend, Indiana, and steal fulfill all the c and it ions and st ipul at ions therein contained, these obl igat ions shall be void; otherwise to remain in full force and effect. The Board instructed the Clerk to get prices on two dozen chairs and three tables and have same for meeting Tuesday August 6th.,1918 at 10:00 A.M. Partial estimate allowed Alex Bukowski on grade, curb and walk on Lincoln Way West for the imountof................................114.d2 Representative of the Chicago, Lake Shore & South Bend Railway Company appeared before the Board and took up the matter of closing of La Porte Avenue from La Salle Avenue to Colfax Avenue for two days. The Board granted that said La -Porte -Avenue -could be closed July 313t.,1918 and August lst.,1918. This was granted so that said company could repair their right of way properly. The Fire Chief to be notified of said street being closed The Board ordered that the intersection of Si E. Corner of Catalpa Avenue and Donlad Street (old Warren) should be put in, and H. N. Barnes ordered to put in same under city contract. 2.05 Condemnation Resolution No. 52. 1918. Resolved by the Board of Public Works of the City of South Bend, Indiana That the follewibg described property be appropriated for the use of said City. Beginning at a point on the west line of Lafayette Blvd. 132 feet south o he south line of Marion Street; thence south 14 feet; thence west i65 feet; thence north 14 feet; thence east 165 feet to the place of beginning. Resolved, that notices as to the amounts of assessments be published for six c onsecut ive days in the South Bend Doily Tribune, commencing on the 5th. , day of August-1918, stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 21st. , day of August 1918 at 7:15 P.M. Resolved further, that the entire work under the above contract be accepted and approved and the final estimate thereon allowed. The Beard adopted the follw*4gg resolution. LOCAL SEWER I PROVEMENT RESOLUTION RESOLUTION NO.. 582. 1918, resolved by the Board of Public Works of the City of South Bend, County of . St.. Jos6pk, State of Indiana, That the construction of a local sever, intended and adaped only for local use by the property holders whose property abuts thereon, and not intended or adalbted for receiving sewerage from collateral drains, be and the same is hereby ordered in and along Columbia Street from Indiana Avenue to a point 75 feet north of thenorth line of Dubail Avenue as follows;to:Wit. ° Beginning it the intersection of the center line of Indiana Avenue and Columbia Street; thence south along the center line of Columbia Street to a point 75 feet north of the north line of Duba it Avenue with a 10 inch vitrified pipe sewer. Together with the necessary manholesm storm water inlets, conduits, and mouse con- nections to the property line along the line of said improvement, all as is more particularly showy and all in accordance with the pPofiles, plans, detail drawings and specifications on file in the office of the De artment of Public Works of the City of South Bend, Indiana, and said sewer, with all its ap; urtenances shall be constructed in accordance with the profile and specifications now on file in the off is a of the Department of Public Works of said City. The cost of said improvement shall be a portioned against and paid by the property holders whose proerty abuts thereon and upon the City of South Bend if the City is benefitted by said improvement, all according to the method nd manger provided for in Act of the General Assembly of the State of SndIana, entitled " An Act Concerning Municipal Corporations," approved March-,1918, Assessments, if deferred, are tg be #old in ten equal annual installment with interest at the rate of Six -per cent per annum. A bend or beads will be issued to the contractor in payment for such work, unless the property owners pay said assessments before said bond or bonds are issued. Under No circumstances shall the City of SouthLBend be or be held responsible for any sum or sums due from said pro- perty owner or owners .for said work, or for the collection of same, or for the pay- ment of any bond or bonds, certificate or certificates, issued to said contract in payment for such work, except for:such moneys as shall kjtnx have been actually received by the City from the assessments for such work, except for such moneys as sittdlOiEtyelit eby saidai6bove entitled Act required 'to pay. All proceedings had, and w-or k none in the making of said improvement, assessment of property, collections of assessments and issuance of bonds therefor, shall be as provided for,in said above entitled Act. Notice of this resolution shall be published on the lat., day of August and on the 8th., day of August 1918 in the South Bend Daily Tribune.
