C. L, Burton of 826 E. :Ewing Avenue appeared before the Board
about putting up signet on Donald, Street, Fox Sheet, Eyeing Avenue and Seeberger
Street. The Board referred this matter to Mr. D. C. Layton, Street Commissioner
, t o place signs.
This being the date set for filing of petitions and --making final
awards on pavement Improvements on Hirer Street from Allen Street to Blaine Avenue
and Blaine Avenue from `Lincoln Way Vest to Portage Avenue, the Board after due
consideration decided to defer the awarding of said contracts until Monday May
20th. ,1918 at 7: 30 P.M*
The Street Commissioner filed the following report on notice
of defective walk and injury received from E. M. Morris, Attorney for Collia Bolen.
The description da correct, same is a flush water hydrant for
*x hose connection. The cover is off and gone, leaning a hole about 6 inches
square and about 11 inches deep.

The notice andrepor o Street Commissioner was ordered referred
to the City Attorney for a report.
The Board ordered the Indiana & Michigan Electric Company be not if id
to turn on all lights in City Parks. Tge matter of placing Are lights on drive
in Pottowatomis Park was ordered held up indefinitely.
The Board ordered that the motor used for fan in City.Hall be
d is onnected. for the summer or until Nov. 1st. ,1918.
The Building Commissioner presented the following communication
to the Board, same read and placed on file.

In regard to complaint abotit pole in yard at 1513 High Street, Pole and
Wire Inspector reported that this is an Indiana & Michigan Elec. Co. pole and
should be reset oUtt to the inside of the curb.
A release was received from the American Surety Company on the South Benxi
Home Telephone Company bond filed in this City April 28th. 1910 renewal certi-
f icates on which has been filed each year-, The Board ordered said release held
up until consolidation is completed.
The following c ommunicat ion received from the White Construction
Company in regard to e:Kten8 ion of time, on Contract for c ompletton of Eddy Street and
Mishawaka Avenue pavement. Same granted, until July lst.91918.

The following contract and bond approved by the Board.-
C O N T R A C T
THIS AGREkENT, Made., and entered into this llth. day of May 1918 by and
between Harry N. Barnes, party of the ° first part, and the City of S oubh Bend, Indiana,
by its Board of Public Works, party of the secnd part. WITNESSETH:
That for And in consideration of the prices hereinafter stated, to be
paid to the party of the first part by the party of the second part, the said party of
the first part, hereby agrees to repair all asphalt pavement in the streets of said
City, and -to furnish all'.mterials and labor required in doing said work until May 19t.9
1919. All of said repa it ing is to be done at places as directed by the Street Commissioner
of said City, or by his deputy, Said party of the first part agrees to use first class
material; in doing said work, and he further agrees to place barricades and red lights
at" the Places where said repair work is being done by him, in such manner as to 'protect
&.11-persons; in using said, street, from injury.
In cis iderat ion- of the performance of said work by the party' of the first
part, the said party of the second part agrees to pay him therefor the sum of Two
Dollars and fifteen cents ($2.15) per sq yd. for all resurfacing and repair mark, except
where the grouting or f ounda.t ion concrete is broken through or in such c and it ion that it
Cannot be used, iri:which instane:e the party of the first part shall receive two Dollars
and seventy ($2.75) • per square yard. Said sums are to be paid after said work has been
inspected and approved` by .the Street Commissioner of said City, or by the City Civil
Eng sneer .
The party of the first part further agrees that he will do all of said
work in a good and workmanlike manner, and that he hereby guarantees all of said repair
work to be and remain in good c and it ion for a period of one year from the time such
repair work is done; and if during said year, said re`pAir work so done should become
defective,' the party of the first part agrees to replace the same with good material
or upon failure to do so_, to refund to said City the amount receive by hom for such
repairing.
And said party of the first part frther agrees to indemnify and save
harnless the said party of the second part from all dama'as to any person or
property by reason of the negligent performance of said.work.by the party of the
first part. And said party of the first part further agrees that after repairing
any place in any of the streets of said City, he will immediately thereafter remove
all dirt and refuse to the curb of said street.
And it is further agreed that the party of . the first -part may use
all material taken o t of :the streets repaired by him, which material is in first
class condition and s stable to be used in doing said .repair work.
And said party of the second part, as a part of the consideration
of this contract, agrees to loan to said party of the -first pert asphalt plant,
all asphalt tools, which it now owns, and said party of the first part agrees to
pay for the use of the same and for such time as said tools are actually used,
Five cents (5cents) per sq. yd. of asphalt surface laid and said party of the
first part agrees to keep said todle and plant in good repair add return the same
to said party of the second part in good condition less natural wear and tear.
The said -party -of the first 'part agrees to do and execute said work
at times and places as. designated by the Street Commissioner of said City, ' and
under 'his direction. And if he should fail and refuse to do the same, as by
the terms of this contract required, then said party of the second part may at
Its option terminate this agreement. And if party of the first part should
fail to perform, this agreement or any of its terms and conditions, it ff he shall
fail to do any work within one week after he is directed so to do.' (except where
shortage of material is caused by railroad strike or freight embargo), then he
agrees to pay said party of the second part the sum of Fifty and no/100 Dollars
($50. 00) as liquidated damages for such fa ilyre, -and said party of the second
part may retain said sum out of any money due said party of the first part, said
sum to be paid to said first party upon the completion of the work to be done
under this contract.
And in addition to said sum above referred to, the said party
of the first part further agrees to give a One Thousand ($4000.00Doliars bond
with a good and sufficient surety thereon to be approved by the Board of -Public
Works of said City for the faithful performance of this contract.
IN WITNESS WHEREOF, the parties have hereunto set their hands in'
duplicate on the day and year first above mantioned.

WREAS, the Board of Public Works on the 13th ., day of March 1918
d id -adopt A ' resolut ion ordering and requiring the permanent improvement of Blaine
Avenue from. Lincoln Way West to Portage Avenue, by paving the roadway of the same,
and
WREREAS, -th City Civil Engineer has prepared and filed in the office
of this Board a report showing the number and.. location of the service pipes, mains,
conduits, laterals, and connections which are, or will be necessary to accommodate
the abutting property and the owners thereof with gas, water, sewer, and other
conveniences and necessaries; and also said City Civil Engineer has prepared and
filed i n said office specifications showing the material to be used and themanner
of laying said service pipes, mains, conduits, laterals and connections from the
mains to the points inside of the curb lines,
THEREPORE, be it resolved by the Board of Public Works of the City of
South Bend, Indiana, that the report of the City Civil Engineer is adopted, and
said report and the specifications prepared and filed by him are mode a part of this
resolution as fully and effectually as if copied herein at full length; and it is
further ordered that all of such private connections with the sewers gas and water
mains must be made in said street by bringing them inside the curb lines thereof.
And be it further resolved that notice by publication for two succesiv
days in the South Bend Daily Tribune, a newspaper of general circulation printed
and published in the City of South Bend, Indiana, be given to the owners of the
property abutting upon said street to be improved directing them to made such
sewer and water connections off. or before the 3rd. day of June 1918 and that if said
connections are not made on or before said time and in accordance with the speci-
f is a,t ione and report on file in the office of the Board of Public Works , then
said Board will cause the game to be made and will assess the cost thereof against
the property abutting upon said street, and shall do all other things pertaining
thereto according to the provisions and requirements of Ordinance No. 1842 adopted
by the Common Council of the City of South Bend on July 24,1916 and &J:i of all other
ordinances and lawsrelating thereto.
And be it further resolved and ordered that after 20 days period has
elapsed for the making of said connections by the property owners, a notice.shall be -
published for two weeks, once each week, in the South Bend Daily Tribune, a newspapa
of general circulation published in said City, requesting bids from contractors
for the making of such connections as have not been made by the property owners
and such notice shall fix a day, not earlier than ten days after the first of such
publications, when bids shall be opened and a contract let for the doing of said
work.
And be it further ordered that the Northern Indiana Gas & Electric
company, which holds a franchise from, and is empowered by sadd City to furnish
art if ical gas to the c itzens thereof, and is 'engaged in said business in said City,
is hereby directed to make to make and install all service conne etions With its
mains in said street in accordance with the provisions of Ordinance No. 1555,
adopted June 27, 1910, and such other ordinances or laws applicable thereto;
which connections are shown. uper the an report of the City Civil Engineer and which
are hereby declared to be necessary in supplying gas to the owners of property
abetting upon said street.
