Board met in special session at 2:00 P.M. All ®embers present.
Mr. G. A. Elliott, President of the Board introduced the following
resolution which was unanimously adopted and approved by the Beard.
R E SOLUTION
Whereas, on December 10,1917, J. H. Mellott of Anderson, Indiana,
entered into a written contract with the City of South Bend covering the collbetibn
and disposal of garbage For a period of ten yeaks from April 1,191q; which contract
and specifications attached thereto was ratified by the Commen Council of the City
of South Bend on January 3,1918 by Ordiaeace No. 1933, and
Whereas, said J. H. Mellott has'f iled with the City of South Bead
a Certificate of Deposit No. 3575, Farmers Trust Co. in the sum of $500, 00
payable to City of South Bead, Indiana, as ascertained damages for failure to comply
with Section 6 of Notice and Instructions to Bidders, relative to the filing of a
proper bond for the faithful performance of said contract, and
Whereas, J. H. Mellott has been notified and ,.lam failed to file a
proper bond with the Beard of Public Wvks covering the terms and conditions of said
contract, now therefore,
Be It Resoly*d by the Beard of Public Works of the City of South
Bond that the said contract now existing between J. H. Mellott of Anderson,
Indiana, and the City of South Bend, Indiana, dated December 10,1917 is hereby
declared null, veld and of no effect, and the Certificate of Deposit No. 35759
Farmarts Trust Co., payable to City of South Bend, in the sum of $500.00 is hereby
declared forfeited to the City of South Bond, and the Clerk of this Board is hereby
ordered to pay the same to City Controller to be credited to the proper fund of
the City of South Bend.
