referenced contract for Liberty Tower Exterior Renovations, Division B in the amount of
$296,950.
Please forward the following documents in one submittal by February 26, 2019 to my
attention for Board of Public Works approval:
1) Labor & Material Payment Bond
2) Performance Bond (125% of Bid Amount)
3) Certificate of Insurance naming the City of South Bend as an additional insured

On January 22, 2019, the Board of Public Works opened and read bids for the above project.
For Division B, involving masonry repair and coating, Mulder Waterproofing and Sealants was the
only contractor to submit a bid package. The bid amount was $296,950.
Upon review of the bid package, it was determined Mulder Waterproofing and Sealants cannot
meet the requirements of the Responsible Bidder Ordinance. The contractor does not belong to
an apprenticeship program recognized by the U.S. Department of Labor. As such, the bid was
rejected during the 2/7/19 Board of Public Works Agenda Review session.
Subsequently, as no bids were received for Division B, the Open Market contracting method
was used to secure a quote from Mulder Waterproofing and Sealants in the amount of
$296,950. The project schedule does not allow for a 2"d re -bid, and rebidding is not expected to
generate interest from any additional contractors.
Sufficient funds have been appropriated from RWDA TIF (324-1050-460-42-02).
