The Board of Public Works, at its meeting held on February 12, 2019, approved the above
referenced contract for Liberty Tower Exterior Renovations, Division C in the amount of
$304,000.
Please forward the following documents in one submittal by February 26 201.9 to my
attention for Board of Public Works approval:
1) Labor & Material Payment Bond
2) Performance Bond (125% of Bid Amount)
3) Certificate of Insurance naming the City of South Bend as an additional insured

On J'anua 22 2019 the Board of Public Works opened and read bids for the above project.
For Division C, involving storefront -style glass and window work, Environmental Glass was the
only contractor to submit a bid package. The bid amount was $299,000.
Upon review of the bid package, it was determined Environmental Glass did not acknowledge
Addendum No. 1, and therefore submitted an incomplete bid package. The bid was rejected at
the 2/7/19 Board of Public Works Agenda Review session. Further review of the bid package
noted the contractor does not belong to an apprenticeship program recognized by the U.S.
Department of Labor. As such, the bid would have been rejected even had Addendum No. 1
been acknowledged.
Subsequently, as no bids were received for Division C, the Open Market contracting method
was used to secure a quote from Environmental Glass in the amount of $304,000. Addendum
No. 1 from the bid package added $5,000 to the contract value for unforeseen conditions,
meaning this Open Market contract is for the same value as the `intended' bid price, had
Environmental Glass acknowledged Addendum No. 1 during the public bid process.
The project schedule does not allow for a 2nd re -bid, and rebidding is not expected to generate
interest from any additional contractors.
Sufficient funds have been appropriated from RWDA TIF (324-1050-460-42-02).
