Board met in Special session at 1:30 P.M. All members present.
The following communication- received read and placed on file from
Mr. E. M. Morris: `

Attention , Board of Public Works.
South Bend, Indiana,
Dear Sirs: -
A few weeks ago Mr. J. V. Mellette of Anderson, Indiana requested me to
assist him .in securing a bond for the contract -which -he has with the City for the
purchasing of garbage.
I had the matter under cons iderat ion with your board and C ity attorney.,
but from a recent conversation. with Mr. Melett and from a telegram I gust received
I am led to believe that Mir. Ifellett is not going to proceed with this contract,and
I feel it my duty to so advise you. I give you this information so that you can
proceed as you see f it. I

I wish you to understand that I do not represent him in making this
statement, but am only offering the information for your consideration.

The matter of the contract was_discuse*d and motion was made by Mr. Z
John B. De Haven that the Board notify Mr. J. H. Mellette to appear before the
Board at meeting to be held by the Board March 15th. ,1918 at 10: 00 A.M. and file
his bond. Said notice also maintained instructions to Mr. Melettee that in the
event he failed to file his bond at this time, the Board would take action to
forfeit the certificate of deposit* on file. Which motion was carried unanimously.
.The Board's notice was then signed by full Board and sent to Ur. J. H. Mellette
Anderson, Indiana by registered mail.
The following is a copy of notice sent.

Dear Sir
On December 10,1917 you entered into a written. contract with the City
of South Bend through its Board of Public Works covering the collection and dis-
posal of garbage for a period Of ten (10) years effective April lat., 1918. This
contract was rat if fed by the Common Council of the City of South Bend on tht 3rd.
day of January 1918 by Ordinance No. 1933• In compliance with Article 6 of "
Instructions to Bidders" attached to said contract you filed with the Board of -
Public Works a certificate of Depos ite ,#3575 Farmers Trust Company payable to the
City of South Bend, in the sum of $500.00, as ascertained and liquidated damages for
failure to file proper bond in the sum of $59000.00approved by the Board of Works,
within 10 days after acceptance of the bid. The records of the Board of Works fail
to show where you have complied with Article 7 of the " Specifications" attached to
said contract covering the item of the above bond.
We hereby notify you.to appear before the Board of Works of the City of
South Bend, on Friday March 15,1918 at 10: 00 A.M. and file a bond in compliance with
the terms of this contract. In the event of your failure to file a .proper bond at th
the above time, this Board will proceed to declare forfeited to the City of -South
Bend, the Certificate of Deposit& of $500.00 now on file, and take such other
action in regard to the contract as this Board may deem advisable.

and construction of a building in the City of South Bend, Indiana,, said bond being in fav o7
of the City of South Band, Indiana,, tnd in the penalty of FIVE THOUSAND DOLLARS. -
THAT the said NEW AMSTERDAM CASUALTY COMPANY, as surety - aforesa id des ire&
and elects to terminate its liability under the said bond and the object of this notice
is to so notify the said CITY OF SOUTH BEND, IND IANA:
THEREFORE, BE IT KNOWN, that from and after the expiration of thirty
days after receipt of this notice the said NEW AMSTERDAM CASULLTY COMPANY shall not
consider itself liable upon . the aforesaid bond.

Clerk instructed -to write to Indiana & Michigan Electric Company
requesting them to submit figures for cluster 1 ight ing system the same, as downtown,
on Jefferson Blvd. from St. Joseph Street to Lincoln Way East. Taking into consideration
when making said price that the area be eliminated.
The Board instructed D. C. Layton, Street.Commissioner to make temporary
repairs on East Jefferson Blvd. from Sunnyside Avenue to Greenlawn Avenue.

lights to be present at regular session of the Board to be held Tuesday March 12th. ,1918
at 10:00 A.M.
Renewal notice of excavations bonds of L. E. Albright and J. H. Hawbl itsel
for the year 1918 received from The Aetna Casualty & Surety Company of Ind ianapol is,
Indiana. Same read and placed on f ile.
The Bard ordered that the 'Are light At the intersection of Bridge .Street
and La Salle Avenue should be d iseont inued and that the�Ind iana & Michigan Electric Co
be notified to d isc ont inue same, and to install four eighty (4-80) C. P. lamps on
the La Salle Avenue Race Bridge, same type of lamp as on Lafayette Btvd.,
President.
