Commlinidation received from Wecher & Weyer agts. for the New Amsterdam Casualty Company of Indianapolis, Indiana, requesting that'the bond of P. C. Moles for ©ccuyiag streets in the°81ty for building purposes be released. Said communication was ordered referred to the Building Commissioner for a report to be filed at ne xt regular session of the 'Board Tuesday March 5th.,,1918 at 10:00 A.M. Petition for pipe sewer on St. Joseph Street from Pennsylvania Avenue to Broadway read and placed on file, The Board ordered that the Ind Tana & Michigan Electric Company be notified to place an 80 C.P. lamp on Neitsel Court at lst. alley south of East Wenge Street. v Petition received read_ and placed on file for electric light , , on Aurori Street between alley between MeadeStreetand Kaley Street.. The following resolution was adopted by the Board and set for hearig V SIDEWALK DIPROVEUENT RESOLUTION NO. 5669 RESOLVED BY -THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, STATE OF INDIANA, That it is deemed necessary to improve the._west one-half,of Ernsperger Street Prom Lincoln Way East to the Bridge over the St. Joseph River,, as follows, to -wit: - By grading said street from the property line to th-- center line of said Ernsperger Street to the established grade, and con- structing cement sidewalk and cement curb on the west side of said street, all as is more particularly shown, and all in accordance with the plans, profiles, and detail drawings on file in the Office of the Department of Public Works of the City of South Bend, Indiana in accordance with theprofiles , details, drain s and speci- f ications on file in the office of the ' Department of the Board dr Pubie Works of said City; and such improvement is now ordered. The cost of said improvement, including the cost of street and alley intersections, shall be assessed upon the real estate abutting on said west one- half of Ernsperger Street all aacording to the method and manner provided for ixr -an Act pf the General Assembly of the State of Indiana, entitled " Ah Act Concerning Munie ial Corporations, ' approved March 6,190% and in accordance frith and pursuant to the ppovidi.ons of all amendatory and supplemental acts theretei ,paksed by the General asetzhly of the State of Indiana. Assessments, if deferrod; are to be paid in ten equal annual installments, with interest at the rate of.Si.x per cent per annum. A bond or bonds shall be issued to the contractor in paymdht Of such work, unless the property owners pay said assessment before said bond or bonds are issued, Under no circumstances shall the City of South Bend, be, or be held responsible for any sum or sums due,.From said property owner or owners for said work or for the collection of the same, or for the payment of any b=d, bonds, certificate or certl- f icates, issued to &aid contractor in payment for such work, except for such moneys as nbail have been actually received by the City from the assssdments for such Improvement, or such moneys as said City is by said above entitled Act required to . pay. All proceedings had,and work done in the making of said.improvement, assess- ment of property, collection of assessments and issuance of bonds therofor, shall be as provided for in said above entitled -Act and amendments thereto. Notice of this resolution shall be published on the 27t4. day of February 1918 add on the 6th. , dlry of starch 1918 in the South Bend Daily Tribune.
