Freyermuth met with the Board and requested that the Board give the Health Department office two more off ice chairs. The same was granted. The following communication was received from the Board of Public Safety Clerk. February 5th.,1918. O THE HONORABLE BOARD OF PUBLIC WORKS. of the City of South Bend, Indiana. GENTLEMEN; - I- I. Was instructed by the Board of Public Works at its meeting held last Friday morning, to ask your Honorable; Body to purchase three chairs for the. The Board ordered that bids be received Tuesday February 12th.,1918 at 10:00 A.M. for tbase chairs for the Safety .Board offic! as per the above communication. Petition received for a large light at Corner of Orchard Street and Kendall Street. The Board ordered an are light placed at the above location. City Cemetery Sexton presented financial report For the month of January 1918, same read and placed on file. Building Commissioner presented financial report of the Building Department for the month of January 1918, same read and placed on file. Mr. E. M. Morris,,representing'J. H. Mallette, appeared before the Board and offered for file a bond in the sum of Five Thousand ($5,000.00)Dollars, .subject to the contract for the sale of Garbage Said bond referred to the City Attorney for approve as to the form of bond. `— Mr. Goo. Y. Urey, Sexton of the City Cemetery met with;the Board andrequested that he be allowed to purchase a lowering device for use in the City Cemetery, The Board instructed Mr. Urey to purchase said lowering device , and as soon as such device was in use in the City Come'tery that he should raise the pr ice, of vaults to $35, 00 with a $3. 00 discount if paid within Sixty- (66) days. The following resolution was adopted by the Board_, and ordered 'set for a hearing. , `-STREF,T Oil ALLEY IMPROVEMT RESOLUTION NO..564. BE IT RESOLVED BY THE BOARD OF PUBLIC- WORKS OF THE CITY OF SOUTH BEND, $T. fOSEPH COUNTY, STATE OF INDIANA, That it is desired and deemed necessary, to improve Jefferson Boulevard from the east line .of Michigan Street to the east_ line of the Bridge over the St.: Joseph River as follows, to -wit: - Said boulevard shall be resurfaced on the present foundation from'the east line E the bridge over the St Joseph River to the easterly line of Lincoln Way East; and said Boulevard from the easterly line of Lincoln Way East to the East line of Michigan Street shall b e graded,. and the roadway thereof shall be paved; and also the roadway of certain portion,* of the streets and alleys which enter or intersect said boulevard shall be graded; and paved. The paving material to be used in making said improvement shall be: Sheet Asoh It , Bitulithic, Creosoted Wooden Blocks or Brick, and the foundation shall be portlandcement concrete six (6) inches thick for the sheet asphalt, bitulithic, creosoted wooden blocks and brick; also cement curb shall be constructed along said boulevard where same is not already constructed;. storm water inlets and conduits shall be constructed where necessary ; all manh@Ie covers and storm water inlets shall be set .to the proper grade and cement marginal curb shall be constructed at all street and alleys `where necessary;. all as is more particularly shown, and all in accordance with the profiles, plans, detail drawings and specifications on file in the Office of the Department of Public Works of the City of South Bend, Indiana. The cost of the improvement herein provided for, except street and alley Int*rnae-bons shall be paid by special sesoament to he levied upon the property spsoil.y-bsnef'ittad:'Go thiamount"that. the }sue! may be -legally assessed therefor, in accordance with an Act of the General Assembly of the State of Indiana, entitled * An Act Concerning Municipal Corporationa, " approved March 6,29, and -in accordance with and pursuaht to the prov is ions of all acts amendatory and supplemental thereto. The cost of all street and alley intersections, including one-half of the width of the improvement oppositenstreet`and alleys which run into, but do not apbse said roadway herein proposed to be improved and that portion of .such street or alley abutting upon property belonging to said City, or upon property i3ot subject to such assessment, shall be paid by the City in cash out of its general fund, if able to do so, or,from a fund: created by a special' asses*ent to be levied under the provisions of Section 108 of the above entitled Act. a Assessments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual installments, with interest at the ;rate of Sig per cent per annum. A bond or bonds will be issued to the contractor to the amount of such deferred assessments in pro rate payment for such Improvement. Under no circumstances shall the City of South Bend be , or be held responsible for any sum or sums due from said property owner or owners for said work or forth* coll9ection of the same, or for the payment of any bond, bonds, 'eertifieate or cert if fcatea, ,issued to said contractor in payment for such work , except, For such moneys as, shall have actually been received by the City from the assessments for such improvement, or such moneys as said City is by said entitled Act and amendments and supplements thereto required to pay. All proceedings had, and work done in they making of said improvement, assessment or property, collection of assessments and -issuance of bonds therefor, shall be as provided for in said above entitled Act, and Acts .amendatory thereof . aiad supplemental thereto, BE IT FURTHER RESOLVED$ That the Board of Public forks fig the 6th.° da.y of lurch 1918 at the hour of 7:15 P.H. at the office of the Board of Public Works, Of this City,- as the time and place for the public consideration of said proposed im- provement , at which said Board of Public Works will hear all persons interested,, or whose property is liable to be ass9bood for said impfvement, and will decide whether the benefits to the property liable to be assessed for said improvement will equal the estimated cost thereof. BE IT _ FUR�AER RESOLVED, � Tha+t notice of the time and place° of -such public consideration be, published and -mailed in the manner provided by law. Notice of this resolution shall be published on the 6th. day of February 1918 and on the 13th. day of Februar, y 1918 in the South Bend Daily Tribune. ° Adopted this 5th. day of February 1918.
