Hearing had on assessment roll and final estimate for pipe sewer on Chapin :L.Gabst.V°end Kendall Street from Prairie Avenue to Indiaaa Avenue, under Improvement Resolution No, 524, In the City of South Bend, Indiana. In the above natter np remenstrators appeared and no written remonstrances were filed. The Board Uerefore find that the property assessed in, said rg11 filed Dec,. 5th.`, 1917 is benefitt3'dl. in the. emount of assessments as shown an the, said roil, and the Board further .find that the . assessment roll f ilid Decembers 5th. �,1917 and the final estimate' allowed December 5th. ,1917 should be and the same is in all things ratified, c onf irsaddand approved. The following guarantee bonds were reported on by the City Attorny as alright and the Beard approved same, The Williston 'Construction Company as principal and the London and Lancashire Indemnity Company of America, as susrety for the five year guarantee of pavement on Howard Street from Niles Avenue to Notre Dame Avenue. The Williston Construction Company as principal and the London, and Lancashire Indemnity Company of America as sureties, for a, five year guarantee of pavement on Niles Avenue from Leeper Avenue to Howard Street,. The Williston Construction Company as principal anal the London and Lancashire Indemnity Company of America as'su#reties , for pavement improvement ®n pavemonts in Harter Heights, L Vie White Construction Company as principal and the National Surety Company of New York as sureties for the pavement improvement on Dubail Avenue from I•ichigan Street to fxdtzxx Miami Street. Honerable Board of Public Works, South Bend, Indiana, L Gentlemen: - I beg to report ,that the White Construction Company laid 3628.4 square yards of brick pavement using a mortar 'cushion on Mishawaka Avenue. Rice., Gentlemen: - Since talking to you this menrixg, I have been in telephonic communicatin' with Mr. Ripple in Chicago and stated to him the facts as you gave them to me . He had advised me to issue a revised Invoice to cover the amount which you agreed was fair to you, viz; $ 33.75. This is one halt' of the not amount originally blled you on our inveiee being $ 75.00 total net 60 days with lo% discount for payment within 30 days from date of invoice. I an enclosing :.herewith revised invoi-e for $33.75 net and would thank you to issue payment in order that we may close our files on this transaction before the first of the year. It is agreed that the contractor shall not assign this contract, or sub -let the work or any part thereof to be done 'hcrt:mder, wiih, l' the written consent of the Board of Public Works. x It is nurcrier agreed acid stipulated that the contractor shall give to residents of said city and county preference in the employincnt of all labor necessary in the performance of this contract, and failing to do so, shall forfeit to the city the sum of ten dollars for each failure -to observe this stipulation. And upon the performance of all the terms and conditions of this contract, and things to be done and performed by said contractor the said city agrees to cause the cost of doing such work to be assessed, col- lected and paid to said contractor in the manner fixed by the statute governing the making of such improve.• ments.
