Mr. D. L. Guilfoyle of -the Standard Oil Company met withthe Board and
presented petition for vacation of the alley running from Scott Street to Prairie Avenue,
with the following communication. 4.he Board.,ordered a resolution prepar-ed and presented
at session to be held Thursday November ° 8th. ,1917 at 7: 15 P. M.

Gentlemen:-
I herewith present petition -for -the vacation of the alley running from Scott
Street to Prairie Avenue., between two parcels of land owned by this company, the
parcel on which our present works are located and the parcel immediately adjoining us on
the South.# running�to a,peint,at,the intersection of Scott Street and Prairie Avenue.
All of --the dwellings on this land will be removed from the premises and it, is
the intention ofithis Company to erect on the Prairie Avenue side of our h.olaings
a large garage and repair shop to take care of the automobile equipment of the company.
,he size of the building will necessitate extending somewhat beyond the limits df the
alley. The construction will be modern, or concrete and brick, and will be^a, decided
improvement in the appearance of this section of the City.
Since this alley serves no particular use, I take it there will be no_
hesitancy on your part in granting this petit ion _

r. Vernon C Hastings appeared before the Board asper notice served on him,
in regard to defective frame shed �,t rear of 214 North Vichigan street. The Board
decided to defer ` this matter until Tuesday November '20th. ,1917 at 10: 00 A,-U.
Ur. A. W. White, Vice President of the White Construction Company,, Mr. J. T-
Doyle, Mgr and Attorney Wm. A'. UcInerny Counsel for said company met with the Board
J and distLu sed matter of mortar cushion on Eddy Street and Mishawaka Avenue from
Jefferson Blvd. to Nineteenth Street under brick of street car tracks. The following
resolution was approved on same. . o
R E S 0 L U T I 0 N.
Whereas, a dispute has arisen between the City of South fiend, Indiana,, and the
White Construction Company on the question whether the contract for the improvement
df Eddy Street and VishtwaRa Avenue in said city by said Company requires the use of a
sand cushion or mortar dushion under the brick pavement along the tracks of the Street
Railway on said street and avenue, and the Board of ?ubiic Works of said -City desires
th€,t said Company shall proceed with said work and prosecute.the, same with all diligence
✓ and shall use said mortar cushion, and it is hereby resolved and agreed the.t the said
Com.rerq in so doing -shell not waive any of its rights for axtra'campenaation for.%thc�l:aying_
bf-said mortar cushion; and if it shall be determined that said construction is not requirei
by the terms of said contract the said Board of Public Works shall allow as to extra, the
cost of laying such cushion over and above �=rhat it would cost to lay the sane cushion.
And the said Board of Public Works further agrees that it will finally deter-
mine whether said mortar cushion is required by the terms of said contract within and
before November 10th.,1917. '

Resolved by the Board of Public Works of the City of South Bend,
Indiana: That it is desirable ' to vacate the following i The Alley lying between
�l eta ' 2, 3 and 4 in Fords Sub -Division of the suth part of Bank Out lot 60 Des-
cribed as follows, to -wit:
Beginning at the south east corner of lot 3 in Ford's
Sub-Divison of the south part of Bank Out Lot 60, thence west on the south line
of.lots 3 and 4 in said Ford's Sdb-Division to the south west corner of lot 4,
in. said Ford's SAb-Division ; thence south 9.9 feet to the north west corner of
lot 2 in slid Ford's Sub -Division; thence east on the north line of said let 2
