Resolved by unanimous consent of the Board th9t the hearing on
the plans, estimates, specifications etc. for ' Track Separation No. 2 of the New York
Central Ry. Company tracks in, this City Aould be and is hereby set for hearing on
Tuesday November 20th.,1917 at 745 P'M. The Clerk instructed to riotify City Attorney
y E F. Seeb in to prepare not ices , for publication and servance on companies andhave
same for next session of Board or Tuesday ffetober 30th.`,1917. at 10: 00 A.M.
The City Civil Engineer brought up the question to the Board of
the protest filed by the White Construction Company in regard to using mortor cushion
v under street car tracks on Eddy Street and Mishawaka Avenue. This matter was d1scussed
but no action taken.

The City Civil Engineer filed estimated cost of Portage Avenue

The following communication was received from E. F. Seebirt, City
Attorney. No action taken on name.

Gentlemen: -
I have examined the contract a;nd bond in the matter of the construction of the
Michigan Street Trunk Sewer under Improvement Resolution No. 367. and it is my opinion
that the contractor and surety are liable in damages to the City for any failure to com-
plete the contract and perform the work in the* manner stated in the plans and speci-
fications. This would include the serer connections as well as any other work covered by the
olans and snef is iat ions.

Permission was granted the Central Union Telephone Company to install
a three sewer the lateral across Scott Street to enter the Werwinski apa.ratment building
in order that we may dismantle the poles on the street as ordered by you.
Fermissionalso granted to move the following poles.
One pole on the south side of Honroe St. between Main and Michigan
Sts. , to be moved -about thirty feet south in the alley;
One pole on the north side of South St., between Main and Michigan Streets,
to be moved about thirty feet north in the alley.
v The Central Union Telephone Company and the South Bend Home Telephone Co.,
ordered to remove anchor and wire from rear of 901 West Colfax Avenue as same is in way
of garage building property owner is about to erect.

Portage Avenue from Alley north of Kinyon Street to Stoker Place, in the City of
South Bend, Indiana.

the benefits to property liable to be assessed for,said improvement are equal to
the estimated cost of the same, as reported by the City C iv i1 Engineer, and thercupi
takes final °action on said resolution As originally adopted, and the same are hereby
in all things rat if ied, eonf irmed and approved.
Resolved further, that notices be published on the 27th. day of
October 1917 and on the 3rd. day of November 1917 in the South Bend Daily Tribune
stating that this Board will pizeive bids for the construction of said improvement
up to 10:00 A.M. on the 13th. day of November 1917 at 7:45 P.M. fhe Board reserves
the right to reject any and all bids
Hearing had on improvement resolution No. 562 for pipe sewer on
J Pleasant Street from Ninth Street to Eighth Street, in the Ctty of South Bend,
Iridia,na.
Upon said hearing ne remonstrators appeared and no written remon-
strance was filed. And the Board being fully advised in the premises, decides that
the benefits to property liable to be assessed for said improvements are equal to
the estimated cost of the .same, as re opted by the City Civil Engineer, and there-
upon takes final action on said resolution as originally adopted,. and the same are
hereby in all things, ratified, confirmed and approved.
Resolved further, that notices be published on the 27th, day of
October 1917 and on the 3rd. day of November 1917 in.a newspaper of general circu-
lation in said City, stating that this Board will receive bids for the construction
of said improvement up to 10:00 A.M. on the 13th. day of November 1917. ,he Board
reserves the right to reject any and all bids.
