Board of Public Works
City of South Bend,
Fred F. Anderson
Gentlemen: -
We have this day received instructions from the City Engineer to lay all
brick pavement contemplated under the Improvement Itesolution governing the paving of
Eddy Street and Mishawaka Avenue from Jefferson Boulevard to 19th., Street, on a cement
grout cushion instead of a sand cushion, which we were preparing to use in the completion
of that work.
Our intention at the time of filing our bid in the above matter, and our
interpretation of our contract in view of our bid and the specifications governing the
contract, permitted us to lay the brick in question on sand cushion. We are, however,
proceeding to obey the instructions of the City Engineer and hereby desire to notify
you that we are doing the same under protest, with the expectation that we will be re-
imbursed for the additional cost of the grout cushion.
