Chief Tim Lancaster ervice Bravery P ride Dedication SECOND AMENDMENT TO LEASE BETWEEN SHEIN REALTY AND THE CITY OF SOUTH BEND, AS AGENT FOR THE ATF DISARMED TASKFORCE THIS SECOND AMENDMENT TO LEASE is effective January 1, 2019, by and between Shein Realty LLC ("Landlord") and the City of South Bend, as agent for the ATF Disarmed Taskforce ("Tenant"). WHEREAS, Landlord and Tenant are parties to a certain lease effective January 1, 2017, (the "Lease") affecting that part of the Jefferson Hill Building, Lot 1 Jefferson and Hill Minor subdivision located at 125 S. Hill Street, South Bend, Indiana, 46617, as described in the Lease (the "Premises"); and WHEREAS, the Parties entered into a First Amendment to the Lease which was dated the 12th day of December 2017, (the "First Amendment") and which extended the term of the Lease for an additional One (1) year term, commencing on January 1, 2018 and ending on December 31, 2018 (the "Renewal Term"); and WHEREAS, Landlord and Tenant desire to extend the term of the Lease and to modify the terms of the Lease as hereinafter set forth. NOW, THEREFORE, in consideration of the mutual promises and obligations set forth herein, the parties make this Second Amendment to the Lease as follows: 1. Section 1. "TERM" shall be modified to extend the term for a period of one (1) year, commencing January 1, 2019 and ending December 31, 2019. 2. Section 3. "Rent" shall be modified as follows: The Tenant shall pay the Landlord as rent, without any setoff or deduction whatsoever, the sum of $10,795.00, payable in one lump sum payment on the first day of February during the term of this Lease. Unpaid rent shall bear interest at the rate of 12% per annum from the date due until paid." 3. The Parties acknowledge and agree that except as modified herein, all terms and conditions of the Lease remain in full force and effect. PURPOSE: This Inter —Governmental Agreement (IGA) sets forth the terms and conditions for the use of office space in South Bend, Indiana between the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the South Send, Indiana Police Department. 2. AUTHORITY: a. ATF is responsible for investigating criminal and regulatory violations of thcFedeml firearms, explosives, arson, alcohol, and tobacco smuggling laws. See 28 U.S.C. § 599A(b). b. The activities of ATF maybe carried out through any means including through contracts, grants, or cooperative agreements with non -Federal parties. See 28 U.S.C. § 530C(a). 3. DESCRIPTION OF SERVICES: ATF is requesting the use of shared space with the South Bend Police Department in support of the ATF Task Force: Project Disarm. 4. PERIOD OF PERFORMANCE: This Agreement shall become effective January 1, 2019, and remain in effect until December 31, 2019. 5. PAYMENT: Under the terms and conditions of this agreement, ATF shall make payment to the South Bend Police Department in an amount not to exceed $10,795. 6. BILLING PROCEDURES: The South Bend Police Department will invoice ATF on an annual basis. A copy of the invoice may be submitted electronically to ATF Point of Contact (POC). The invoice shall clearly identify the IGA agreement number (19-823-P/AMV#19AHDQ00521) and billing period. Payment of funds will be from 2019-700D-FO-772075-LEO-G I P-25205. 7. MODIFICATION: This IGA may be modified at any time upon written agreement of both parties. S.
