HomeMy WebLinkAbout01-28-08 Public Works and Property Vacation CommitteePublic Works and Property Vacation Committee 2008 South Bend Common Council The January 28, 2008 meeting of the Public Works and Property Vacation Committee of the South Bend Common Council was called to order by its Chairperson, Council Member David Varner at 4:30 p.m. in the Council's Informal Meeting Room. Persons in attendance included Council Members Rouse, Henry Davis, Varner, White, Dieter, LaFountain, Kirsits and Puzzello, Mayor Stephen Luecke ,Interim City Controller John Murphy, Public Works Director Gary Gilot, City Engineer Carl Littrell, Don Inks, Elizabeth Leonard, Michael Danch, Martha Lewis, Mrs. Kopola, Nancy Sulok of the South Bend Tribune and Kathleen Cekanski-Farrand, Council Attorney. Dr. Varner noted that the Committee members include Council Members Derek Dieter, Henry Davis, Tom LaFountain and himself. Dr. Varner then called for a presentation on Bill No. 01-08 requesting a vacation of the northwest corner of Napoleon Street and Eddy Street right-of-way. The Council Attorney that since Bill Nos. 01-08, 02-08, 03-08 and 04-08 are all related to the same project that they may be heard together. Dr. Varner then called for a presentation on the vacation requests set forth in Bill Nos. 02-08, 03-08, and 04-08. Bill No. 01-08: Vacation Request for the Northwest Corner of Napoleon Street and Eddy Street Right-of-Way Bill No. 02-08: Vacation Request for the Southeast Corner of Eddv Street and Angela Boulevard Right-of-Way Bill No. 03-08: Vacation Re uest for the alley located as the 1St east-west alley north of St. Vincent Steet from the East Right-of-Way Line of Burns Street to the West Riaht-of-Way Line of Duev Street Bill No. 04-08: Vacation Request for the Alley Located as the first East-West Alley North of St. Vincent Street from the east Right-of-Way Line of Georaiana Street to the West Right-of-Way Line of Burns Street Michael J. Danch, Presidnet of Danch, Harner & Assoicates with offices located at 1643 Commerce Drive in South Bend made the formal presentation on each of these Bills. Mr. Danch provided individual, maps of each of the four (4) areas as well as an additional map depicting all four (4) of the proposed vacation areas. He noted that a Public Works and Property Vacation Committee Meeting Minutes January 28, 2008 Page 2 new 20' ingress/egress easement will be given to address the needs of trash trucks and residents in the areas. In response to a question raised by Council Member Puzzello, Mr. Danch stated that the orange color on the combined map indicates that this area has already been vacated, however the proposed ordinance provides further clarification. He requested a favorable recommendation on all four (4) bills. Council Member Puzzello noted that one (1) resident had contacted her, but will not be directly affected by the proposed vacations. Council Member White noted that in a report included with Bill No. 03-08 it discusses a needed turning radius. Mr. Danch stated that the 20' ingress/egress easement will satisfy that concern. In response to a question from Council Member Kirsits, Mr. Danch stated that the alleys will be paved. City Engineer Carl Littrell stated that the city concurs with ingress/egress easement and recommends each of the Bills favorable. Council Member LaFountain made a motion, seconded by Council Member Dieter that Bill Nos. 01-08, 02-08, 03-08 and 04-08 be recommended favorably to Council. The motion passed.
