Fears appeared before the Board i7A regard to connecting sewer with private sewer in the alley between William Street and Taylor Street and Jefferson. Blvd. and Washington Avt3nue. The Board ordered that the Street Commissioner be notified to guild a manhole in the &ewer in above mentioned alley, The Board ordered that the salary of the Clerk in the Building Department be -1ncrea'sed from Fifty ($50,00)Dollars' per month to Sixty ($60,00) Dollars per month ✓ same to start October 15th.;1917. The Building Commissioner C. A. Perkins appeared befored the Board and presented application filed by the School City to move portable school now located at 15 22 W. Sample Street to corner of 9th. Street and Vine Street, The same was refused by the Board. The following communication was received, read and approved. October 61P.1917. Uorris, President Board of Public Works, City of South Bend, Ind.,, Dear Sir :- In regard to my request this morning asking permission for the Uichigan. Central Railroad Company to be allowed to move our siding which crosses Franklin Street, two and one harf feet in this street. . This track does not clear our buildings six feet from the outside rail / as required by the Indiana State Law and the railroad Company advises they will not J set cars for us on this siding until same is plate# in condition to comply with this law. We ask that the Board of Public Works grant us permission to shift this track two and one half feet in Franklin Street., The Michigan Central Railroad Co., to Flo the work and place street in first class shape. Attached please find sketch of our factory locution and railroad tracks into our plant. The siding marked N.Y. I advise you that I have filed motions in the Circuit Court to reinstate the causes of Joseph D. Oliver, Trustee, and Sanders -Egbert Company vs City of South Bend, in reference to the opening of Union Street The court has fixed October 12th., as the time of hearing said mot ions. Die amount of money required of the City to settle the Oliver case of $2,000.00 with interest at 6% per annum from July lot., 1912. The amount it the Sanders-Egbert Co. case is $500.00 with interest at 6% from July lot., 1912. And the city must pay the court costs in both cases. Board of Public Works, Sou t Bend, Indiana, Gent emen:- • Your records will show that some things like a year ago you granted permission to have a spur from the Vandalia Track rug across Grast Street and the alley so as to reset a car upon the corner of my lot which is occultied by the Kendallville Ufg. ; Co., The corner of the building has been removed leaving a place for the car. The railroad people are just now ready to run their track. There are poles for electric wires that are in the way and will have to be moved. Will you kindly see that this is done in a prompt way, so that when hhe railroad people are ready to lay the track, which they have promised to do without delay, they can do so uninterrupted. RESOLVEDby the Board of Public Works of the Cityfof South Bend, County of St. Josep#, State of Indiana, ghat the construction of a -local sewer, intended and adapted only for local use,by the property holders whose property abuts thereon, and not intended or adapted for reeeiv-ing sewerage from collateral drains, be and the same is, hereby ordered in and along Portage Avenue from alley north of Kinyon Street.to.Sucker Place as follows, to -wit: Beginning at the manhole located at the intersection of the center line of portage;Avenue an d the alley north of Kinyon Street; thence northwesterly along the center line of Portage Avenue to the center, of Stocker Place with a 12 inch vitrified pipe sewer. Together with the -necessary manholes, storm water inlets, conduits and house connections 'to the curb line along the 'line of said improvement; all as is more particularly shown, and all in accordance with the profiles, plans, detail drawings and specifications on file in the office of the Department of Public Works of the City of So -A, Bend, Indiana, and said sewer, with all its appurtenances shall be constructed .in accord.. anee with the profile and -specifications now on file in the office of the Department of Public Works of said City. ;he cost of said improvement shall be apportioned against and paid by the property holders whose property abuts thereon, and upon the City of -South Bend if the City is benef itted by said improvement, all according to the methos and manner provided for in Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations, " approved March 6,1905. The Board informed him that a news resolution with a higher estimate would be adopted, and set for a hearing. Hearing given on Condemnation Resolution No. 49. for the Widening of Miami Street from Ewing Avenue to City Limits, in the City of"South Bend, Indiana. - In the above matter no remonstrators appeared and no written remon- strance was filed. The Board therefore declare the above property in all things condemned and appropriated for public use. The Board further ordered that the City Engineer be instructed to .prepare a roll showing awards of damages and assessments of benefits in the hbove matter. Defferred hearing had on Vacation resolution No. 42 for the vacation of the lat. alley south of.Stull Street from main Street to 1st. alley went of train ,/ Street, in the City of South Bend, Indiana. In•the above matter remonstrators appeared but no further written remon- strance was filed. The Board after due consideration decided to defer all action on same until Tuesday October 16th.,1917 at 7:45 P.U. Hearing given on assessment roll and final estimate for grade, curb and walk,on Leer Street from Calvert Street to Ewing Avenue, under Improvement Resolution No. 531. In the City of South Bend, Indiana. In the above matter no remonstrators appeared and no written remonstrance was filed. The Board thereto& find that the property assessed in said roll filed September 18th.91917 is benefitted'in the amount of assessments as shown on said rolls filed September 18th.,1917 and the Board further find that the assessment rmll filed September 18th.,1917 and the final estimate allowed September 18th.,1917 should be and the same are hereby in all things ratified, confirmed and approved. Harter of the Harter• Realty Company appeared before the Board in regard to assessment roll for pavement on streets in Harter Heights. Engineer filed assessment roll and final estimate for pavement`s on Streets: in Harter Heights Addition , under Improvement Resolution No. 507. In the City of ci South Bend, Indiana. •R;esolved'by the Board that they would accept a waiver signed by the Hater Realty Company&Heber P. Harter waiving all sdtirtisemeiits for notices for hearing on $aid roll and that a notice send by mail shall be sufficient notice of the hearing upon the assessment made for said improvements, also stating that this Board will give a hearing in its office on the amount of suchassessments in the City Hall on the 16th. day of October 1917 at 7:45 P.M. Resolved further, that the entire work under the above contract be accepted and approved and the final estimate thereon allowed. The Board ordered that the the resolution for pipe sewer on Chestnut Street from Lake Shore & Michigan Southern Ry. Company to Napier Street be called up on October 23rd.1917 at:. 10:00 A.M. The Board finds that the bids received October 2nd.1917 for.the pipe sewer on Dayton Street from Marine Street to Ist. alley west of Leer Street undet Improvement Resolution No. 557, the same being deferred for consideration to this date are above the engineeres estimate, resolved by unanious consent that the resolution for same be rescinded and new resolution _ ande.stimate adopted. Also bids for the pipe sewer on Pleasant Street from Nineth Street to Eighth Street, under Improvement Resolution No. 547, the same being deferred until this date for consideration, are above the engineer's estimate, and it,,is hereby resolved by the unjnimuus consent of the Board that the said resolution and bids be rescinded and new resolution ans estimate adopted. WHEREAS, The Board of Public Works of the City of South Bend, Indiana did, on the 9th. day of October 1917 adopt, a preliminary resolution for the improvement of Dayton Street from:Marine Street to 1st. alley east in the City Of South Bend, Indian by construction pf a sewer, also the construction of the necessary manholes, and inlets, water inlets, conduits and resetting all manholes and inlets tothe proper grade. All' as shown on the planai and in accordance with the profiles, detail drawings and specif- teations on file in the office of the Department of Public Works-, And Whereas we the undersigned, are the only persons owing property on said str-eet to be-improved,, e improved, and that we are the sole owners of the separate parcels of land borderigg upon said street pro- posed to be improved. Therefore, in consideration that said Board of Hublic Works proceed t im rove aid street as proposed in said resolution, and for the further puppose o? saVing time abd expense, we, the undersigned, do hereby waive all objections and defense to any defect in said proceedings and to anyviola,tion in rocedure fair the construction of sewers as fixed by Section 7�2 of Burns revised Statues of 1914. JOSEP$, State of liana, hat the construction of a local sewer intended and adapted only -for local use=py the `property holders whose property abuts thereon and not fnttkddd or adapted for reciving sewerage from collateral drains, be and the same is, hereby ordered in and along Pleasant- Street from Ninth Street to Eigth Street, as -follows, to -wit: Beginning. at, the intersecti°on of the center line of Pleasant *Street, and Ninth Street ; thence west along the center of line of Ninth Street to a point 20 feet east of th.e �east.-line of Eigthth Street with a 12 inch vitrified pipe sewer. Gentlemen: - I advise you that I have filed motion in the Circuit Court to re --instate the causes of Joseph D. Oliver, Trustee, 4 and.Sandere-Egbert Company vs. City of South Bend;in reference to the opening of Union Street. The Court has fixed October 12th., as the time of hearing said motions. The amount of money required of the City to settle'the Oliver case is :t $2,000i00 with interest a 6%'-,)er annum from July Ist.,1919. The amount in the Sanders-Egbert Co.,case is $500.00 with interest P"t 61e, from July lst.j1912.
