The Board ordered that the City Contractor°be notified to place sidewalk extensions at corner of Franklin Street and Dubail Avenue. Pole and wire inspector reported on complaint on pole at west side of ,) live` Street north: of 'Orange Street and also pole on east of Olive Street in alley north of Orange Street as follows: The pole on Olive.Street is a South Bend Home Tel. Company pole and shoudl be moved to the north about four feet. ,he pole in the alley east of Olive Street is a Central Union Telephone Company pole and should'be removed to the north , or removed entirely and use the Indiana & Michigan Elea. Company pole jointly 30 feet south. The above report was approved by the Board. the Central Union Telephone Company was granted the following permit - To build a small manhole in the Isidewalk near the curb at the southeast corner of East La Salle Avenue and Emerick Street, and extend a two multiple lateral from this point outh on the west side of.Emerick Street between the sidewalk and curb to the first alley running west, then west in this alley to a proposed nea ole with a proposed eight foot anchor on the east side of this pole. You are ordered to place the manhole outside of the curb in the street and lay your lateral on an angle t,o the -inside of the curb back to the railroad ground. To build a small manhole in Taylor St., nearthe intersection of the alleys between Colfax Avenue and Washington Avenues, and to extend a two multiple lateral west from this poitit in the alley to the Indiana & Michigan Elea. Company pole and also extend a two,multiple lateral east from this manhole located as above to the second Indiana & Michigan Elea. Company pole. This work is to eliminate aerial wires and poles on Saylor Street at this point. You must place your distributing poles also your under- ground poles on the dividing lines between lots, both poles to be used, jointly by the South Bend Home Telephone Company and the Indiana & Michigan Ejectrip_Company. To install two multiple laterals across Riverside Drive from the alley between Forest Avenue and Park Avenues to the rear of properties on the north side of Riverside Drive. Your Company with the South Bend Home Telephone Coffipany and Indiana & Michigan Electric Company should use the same trench to lay your conduit jointly. The South Bend Home Telephone Company and Indiana & Michigan Electric Compny were ordered to be notified to place their distributing poles and under- ground poles located in the alley north of Washington Avenue between Taylor Street and William Street on the dividing lines between lots and'use same jointly with the Central Union Telephone Company. Hearing had nn Vacation Resolution No. JP for Vacation of a part of Huey -,"Street from Lincoln Way West to south line, -of Lot 40 Melrose Addition, under Vacation Resolution No. 41. In the City of South Bend, Indiana. In the above matter no remonstrators appeared and no written remonstrance was riled. The Board therefore sustain all former action taken and declare the above described property in all things vacated and this resolution in all things ratified, cnf irzAdand- approved. e Resolved further that the City Engineer be instructed to prepare a roll showing awards of damages and assessments of benefits to all parties and properties interested in the above matter. Hearing had on Imiprovement Resolution'No, 557 for pipe sewer on Dayton Street from Marine Street to 1st. alley west of Leer Street, in the City of South Bend, Indiana. Upon said hearing no remonstrators appeared and no written remonstrances were filed. And the Board being fully advised in the premises, decides that the benef i6 to property liable to be assessed for said improvements are equal to the estimated cost of. the 'same, as reported by the City Civil Eng,ineer, and thereupon takes final action on said resolution as originally adopted, and the same are hereby in all things ratified, confirmed and approved. Resolved further, that notices be published on the 19th. day of September 9 1917 and on the 26th. day of September 1917 ina newspaper of general circulation in said City, stating that this Board will receive bids for the, construction Of said improvemens up to 10:00 A.M. on the 2nd.' day of October 1917. The Board reserves the right to reject any and. all bids: 'Hearing had on assessmnt roll andfinal estimate for pipe sewer on Brook- / filed Street -from Lincoln Way West to Vassar avenue, under Improvement Resolution No. 221. In the City of South Bend, Indiana. In the above matter remonstrators appeared but no written remonstrance was filed. The Board therefore find that the property assessed in said roll filed August 316t, ,1917 is benef itted in the amount of assessments as shown on said rolls, and the Board further find that the assessment roll filed August 28th. ,1917 and the final estimate allowed August .3114t.,1917 should be and the same are hereby in all things ratified, cdlf firmed and approved. Engineer filed assessment roll and final estimate,for grade, curb and walk on Leer Street from Calvert Street to Ewing Avenue, under Improvement Resolution No, 531. In the City of South Bend, Indiana. Resolved, that notices as to the assessments be published according to law, for six consecutive days in the South Bend Daily Tribune, commencing on the 24th. day of September 1917 stating that this Board will give a hearing on the amount of such assessments at its office in the City Hall on the 9th. day of October 1917 at 7:45 P.M. Resolved further, that the entire work under the above contracts be accepted and approved and the final estimate thereon allowed. Notice of this resolution shall be published on the 24th. day of September 1917 in the South Bend Daily Tribune stating that this Board will give a hearing on the acceptance of such work at its office in the City Hall'on the 9th. day of October 1917 at 7:45 P.M. Engineer filed assessment roil of awards of damages and assessments of J benefits under Vacation Resolution No. 40. for the Vacation of a part of the alley between lots 10,11.12 and 13 Chapin's Sub. Division of Bank Out Lots 1 and 2. In the CiJr of South Bend, Indiana. That Board has ordered that notices of such awards of damages and assessmen of benefits be served by the police department according to law, and that a hearing be had on the 23rd. day of October 1917 at 7:45 P.M. for the purpose of hearing or receiving objections of any persons interested in said matter. Resolved that notices as to he assessments according to law be published an the 21st., da of September 1917 and on the 28th. day of September 1917 in the South Bend Daily Tribune, stating that this Board will give,a hearing on the amount of assessments at its office in the City Hall on the 2nd. day of October 1917 at 7: 45 P.U. It was resolved by -the Board that 'thefe °being no bids received on pipe sewers on Chestnut Street from -Napier :Street -to -the -Lake Shore Ry.' Company and pipe sewer on Pleasant Street from Vishawak& Avenue to -River -were under the engineer's estimate, that the same be advert°ised to bids in the South Bend Daily Tribune, same to be received October 2nd. 1917 at 10:00 A.M. The Board reser v'es the right to reject any and all bids. Board instructed the White Construction Company contractors for pavement on Eddy Street and Mishawaka Avenue to remove fence along S. M. Studebaker estate property it same should be in their way when they were ready to grade said streets, as the said J. U. Studebaker "estate had been notified to remove same. Petition received for an electric light at corner of Dayton Street and ]Marine Street. Same read and placed on file. The approTing of the Bond - of the White Construction Company was deferred by the Board until Wednesday September 19th.,1917 at 10:00 A.I. Clerk instructed to notify Ur. White to be present at said session. SIDEWALK IMPROVEIVMTT RESOLUTION NO. 558AZ Resolved by the Board of Pu blic Works of the City of South Bend, St. Joseph ,,-'County, State of Indiana, That it is deemed necessary to improve the north side of Li ncoln Way West from Olive Street to Fremont Street as follows, to -wit: -- By constructing cement sidewalk on the noth side of said Lincoln Way Nest from Olive Street to Fremont Street; all as is more particularly shown, and all -in accordance with the irofiles, plans, detail drawings and specifications on file in the office of the Department of Public Works of the City of South Bend, Indiana, in accordance with the profiles, details, drawings and specifications on file in the oftdes of the Department of the Board of Public Works of said City; and such improvement is now ordered. The cost of said improvement, including the cost of strut and alley inter- sections , shall be assessed upon the real estate abutting on said Lincoln Way hest ill according to the method and manner provided for in an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations, " approved March 6,1905, and in accordance with and pursuant to the provisions of all amendatory and=supple- mental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred, are to be paid in ten equal annual installments, with interest at the rate of six per cent per annum. A bond or bonds shall be Ingygd Jorghe contracto r in payment of such work, unless the property owners pay Saud assessment before said bond or bonds are issued. Under no circumstances shall the City of south Bend, be or be held responsible for any sum or sums due from said property owner or owners for said work or for the collecti of the same, or for the payment doe of any bond, bonds, certificates or certificates, issed to said contractor in payment for such work, except for such mneys as shall have been actually received vy the City fromthe assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessment of property, colle ction of assess- ments and issuance of bonds therefor, shall be as provided for in said above entitled Act and amendments thereto. Notice of this resolution shall be publislmdd or. the 19th. day of September 1917 and on the 25th. day of September 1917 in the South Bend Daily Tribune, This Board will give a hearing on this resolution in its office in the City Hall on the 2nd. day of October 1017 at 7:45 P.U.
