U. Bingham of the St. Joseph Loan & Trust Company with two others a )geared before the Board in regard to defective sewer connection at Sibley property owned by Gish Estate on -South Michigan Street. The Board instructed City Engineer to get a report from Hoban & Roach of how much to repair same, and have same for evening session. , Mr. Goo. M. Urey, Sexton of the City Cemetery'appeared before the Board and requested an increase in his salary to $1200.00 a year. The same was no granted. the Board took up the matter of poles on Eddy Street and Mishawaka Avenue and discussed the same with the White Construction Company representatives. Also brought up matter of curb on Mishawaka Avenue. The Board adjourned to take trip over said avenue to see conditions as they'aJ?e on the ground... The following contractand bond approved. Concerning the Improvement on the roadwpry of Niles Avenue from Howard Street to Leeper Avenue'in pursuance to resolution No. 551.°the Board finds that no petition has been filed with said Board by a majority in number of the freeholders residing on said street to be improved request.ng that it be improved with a different kind of pavement than the kind heretofore adopted by the Board in its preliminary order; Rnd the City Engineer reports that theWilliston Construction Company is the lowest and best bidder for the kind of pavement heretofore adopted by the Board and the Board find that said Williston Con- struction Company is the lowest and best bidder abd hereby lets the contract for said improvement to him, and all proceedings heretofore had in this matter are hereby confirmed and ratified. All members present. Hearing had on impvovement Resolution No. 556 for the pipe sewer on Soring Street from Walsh Street to Arthur Street, in the City of South Bend, Indiana. Vol Upon said hearing no remonstrators appeared and no written remonstrance was filed. And the Board being fully advised in .the premises, decides that the benefits to property liable to be assessed for said'improvements are equal to the estimated cost of the same, as reported by the City Civil Enginee, andtthereupon takes final action on said resolution as ori.gi rally adopted, and the same is hereby in all things, rat i- f ied c onf irmed and approved. The following assignment for Williston Construction Company Was approved by the Board, South Bend, Indiana Sept., 4,1917. FOR VALUE RECEIVED, The Williston Construction Company hereby transfers, sells and assigns to the ST. JOSEPH LOAN & TRUST COMPANY of South Bend, Indiana, all its right, title and interest in ---and to a certain contract made and executed by and between the City of South Bend, Indiana, and the Williston Construction Company, for the paving and improving -of Howard Street in the City of South Bend, Indiana, which contract is dated, lat. day`of August 1917, and the said Construction. Company hereby transfers, sells and assigns to the said +rust Company all money and bonds that shall hereafter be due from the City of South Bend, to the said construction Company, and the saud +he St. Joseph Loan & Trust Company is hereby authorized to receive said money and the said bonds, and the receipt of the said Trust Company therefor, shall fully discharge the City ofSouth Bend, -from any further liability to the said Williston Construction Company.
