The Board has ordered that notices of such awards -of damages and assessmet

several pieces of property which is affected by the said appropriatinn proceedings.
Thereupon the Board nroceeded'to award the damages sustained and tie
assess the benefits accruing to each piece of property upon said list.
It was thereupon, upon moTion duly made and seended and unanimously
adopted, resolvad that said list, bogether with the amounts of benefits and
damages and net benefits and net damages therein set forth as to the several parcels
of land' be adopted acid that the respective amount of benefits contained in said
list be and are here by assessed against the several tracts of land as specifically
set forth in said list, and that the respective amounts of damages contained
in the said list be and are hereby awarded to the several tracts of land as specti-
c ia,lly set- forth -in- sa.°id- •list; and- hhat the 3=tt net b-enef its- or• net. damages, > as- the
case may be as to the respective tracts of land, contained in said list are hereby

The Board hereby further sets off the benefits and damages each against the other
where both benefits and damages are assessed, against the same piece of property, tract
.of land or` interests, and hereby fixes the said respective net benefits as theamount
that shall be paid by the respective olmners as benefits, and further hereby fixes the
respective net damages as to the several tracts as the amount that shall be paid to the
owners of the respective tracts as damages.

nth. day of 7 at 7:45 P.M. was fixed as the day on which this Beard will
receive or hear remonstrances from persons with regard to the amount of their respective
awards or assessments, and the Clrk of this Board was instructed to prepare and cause to be
duly and legally given, notices to the owners of each parcel pf propert y, shoeing the
amount of the assessments or awards, with a description of the property affected, and
the date of said hearing.

valley w(st of Lafayette Street from Monroe Street to South Street, -under Improvement
Resolution No. 494. In the City of South Bend, Indiana.
_ Resolved, that notices as to the amounts of assessments be published for
six c onse cut ive days. in the South Bend Daily Tribune, c ommenc ing on.the 6th. day of
August 1917 stating that this Board will give a hearing on the amount of such assessments
at its office in the City Hall on the 21st . day of August 1917 at 7: 45 P.M.
Resolved further, that the 'entire work under the above contract be accepted
and approved and the final estimated thereon allowed.
Engineer filed assessment roll and final estimate for Resurfacing pavement
on La Porte Avenue°from°Washington Avenue to Linden Avenue, under Improvement Resolution
✓No. 475. In the City of South Bend, Indiana.
Resolved, that notices as to the amounts of assessments be published for
six consecut ive days in the South Bend Daily Tribune, commenc ing ,on the 6th. day of
August 1917 stating that this Board will give a hearing on the amount of such assessments at
its office in the City Hall on the 21st. ,day of August 1917 at 7: 45 P.M.
Resolved further, that the entire work under the above contract be
accepted and approved and the final estimate thereon allowed.
The following release approved by the Board.
Reslblvddthat Harvy L. Hager has filed new excavation bond in.this department
effective June 12th.,1917 , and the London and Lancashire Indemnity Company of America
is hereby released from any and all liability under its bond for -said Harvey' L. Hager
covering his excavation license to the City of South Bend , Ini3n4 accruing on and after
June 12th.,1917.

Hearing had or, assessment roll and final estimate for grade, curb
and walk on Donald Street from Uimai Street,to High Street, under Improvement
Resolution No. 508. In the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no written remon-
strance was filed. The Board therefore find that the property assessed in said roll
filed July 10th.,1917 is benefitted in the amount if assessments as shown on said
rolloV and the Board further find that the assessment rolls filed July loth.,
1917 and the final estimate allowed July 16th.,1917 should be -and the same is hereby
in all things ratified, confirmed and approved.
Hearing had on Grade, curb and walk and Gravel roadway on Dubail
Avenue from Marine Street to Leer Street, under Improvement Resolution No. 467.

In the above matter no remonstrators appeared and no written remon-
strance was filed. The Board therefore find that the property assessed in said roll
filed July 10th.,1917 is benefitted in the amount of assessments as shown on said
rolls , and -the Board further find that the -assessment rolls filed July 10th.,
1917; and the final estimate alklowed July loth. ,1917 should be and the same is
hereby in all things tat if ied, confirmed and appDuvdd.

Monroe Street to South Street, under Improvement Resolution No. 446. In the City of
South Bend, Indiana.
In the above matter no remonstrators appeared and no written remon-
strance was filbdd. The Board therefiore find that the property assessed in said
rolls filed July 10th.,1917 is benefitted in the amount of assessments as shown
on said rolls and the Board further find that the assessment rolls filed July 10th.,
1917 and the final estimate allowed July 10th.v1917 shuidd be and the same are hereby
in all things ratified, confirmed and approved.
Hearing had on assessment roll and final estimate for concrete
pavement on Portage 970urt-�tboAshland Avenue, under Imprvement Resolution.No. 482. In
°/ the City of South Bend, Indiana.
In the above matter no remonstrators appeared and no written
remonstrance was filed. The Board therefore find that the property ,assessed in said
rolls filled July 10th.,1917 is benefitted in the amount of assessments as shown
on said rolls, and the Board further find that the assessment roll filed July 10th.,
1917 and the final estimate allowed July 10th.,1917 should be and the same is hereby
in all things ratified, confirmed and approved.
Deferred hearing had on improvement Resolution Ito. 543 for the
pavement on Dubail Avenue from Michigan Street to 11imi Street, in the City of South
Bend,, Indiana.
Upon said hearing remonstrators appeared but no further written
remonstrance was filed. The Board being fully advised in the premises, decides that
the benefits to property liable to be assessed for da.id improvements are equal to
the estimated cost of the same, as reported by the City Civil Engineer, and thereupon
takes final action on said resolution as originally adopted, and over-ruleld said
remonstrance and the said resolution is hereby in all things ratified, confirmed and
approved.
Resolved further, that notices be published onthe lst. day of
August 1917 and on the 8th. day of August 1917 in a newspaper of general circulation
in said City, stating that this Board will receive bids for the construction of
said improvement up to 10:00 A.M. on the 14th. day of August 1917 The Board
reserves the right to reject any and all bids.
The bill of W. W. Sibly PUmber ^Tas ordered turned over to
`� The city attorney for collection from J. H. Cahill, contractor on Michigan Street
Trunk sewer, for placing a new tap in place of defective tap.
Central Union Tel. Company ordered to remove pole owned by their
c ompagy which is in the*way of a garage at' the rear of 111 E. Tutt Street, same to be
removed at- onace &nd said company to use Indiana & Michigan E ec. Company pole which
a-' stands about fifteen feet north of thier pole.
The following bills were approved by the Board.
Bill of H. N. Barnes for relaying brick in first alley west of Lafayette
Street between South Street and Monroe Street, additional to contract price of said
pavement improvement.
Bill of H. N. Barnes for relaying brick and 60 ft. of curb returns
at 27 cents per foot on William Street alley between Colfax Avenue .to Michigan Avenue
additional to contract price.
Concerning the improvement of the roadway of Howard Street from Notre
Dame Avenue to Niles Avenue in in pursuance to resolution No. 527 the Board finds that
no petition has been filed with the said Board by a majority in number of the freeholders
residing on said street to be improved requesting that it be improved with a different
kind of pavement than the kind heretofore adopted by the Board in its preliminary order;
and the City Engineer reports that Williston Construction Company is the lowest and
best bidder for, the kind of pavement heretofore adopted by the Board, and the Board finds
that said Williston Construction Company is the lowest and best bidder and hereby lets
the contract for said improvement to him, and orders that said improvement be made with
Asphaltic Concrete and all proceedings heretofore had in this matter are hereby confirmed
and ratified.

The Board -finds that bids received for pipe sewer on Chestnut Street from
Napier Street toL. S. & M. S. Ry. Company above the estimated cost, and resolved further
that notices be published on the 1st. day of August 1917 and on the 8th. day of August
1917 in a newspaoer of general circulation in said City, stating that this Board will
receive bids for the construction of said improvements up to 10:00 A.M. on the 14th.
day of August 1917 at 7:45 P.U. The Board reserves the right to reject any and all -bids.

LOCAL SMVER IMpROVEIENT RESOLUTION N0. 553.
Resolved by the Board of Public Works of the City of South Bend, County
p/ of St. Joseph, State of Indiana, That the construction of a loeil sewer, inteded
and adapted only for locAl use bythe property holders: -hose property abuts theren,
end not intended or adapted for receiving sewerage from collateral drains, be and
the Same is, hereby ordered in and along Fellows Street fror: Haney Avenue to a.
point 30 feet north of the north line of the first alley north of Haney Avenue
as fellows, to -wit:
Beginning at the intersection of the center line of Haney
Avenue and Fellows Street; thence north along the center line,of Fellows Street
to a point` -30 feet north of the north line of the first lley north of Haney Avenue
with a. 10 inch vitrified pipe sewer. Together with the necessary manholes:, storm
water inlets, conduits and house connections to the curb line along the line of
said improvement; all as is more particularly shown, and all in accordance with the
profiles, plans, detail drawings and specif ications. on file in the office of the
Department of Public Works of the City of South Bend, Indiana; and said sewer, with
.all its appurtenances shall be constructed in accordance with the profile and sceci-
cat ions now on file in the office of the Department of Public Works of said City.
The cost of said improvement shall be'apportioned against and paid by the property
holders whose property abuts thereon, and upon the City of Soth Bend if the City
is benefitted by said improvement, all according to the method and manner provided
for in Act of the General Assembly of th State of Indiana, tntitled " An Act
Concerning Municipal Corporations, " approved March 6,1905. Assessments, if deferred
are to be raid in ten equal annual installments, with interest at, the rate of Six
per cent per annum. A bond or bonds s -,all be issued to the contractor in -payment for
such work, unless the property ovmers pay said assessments before said bond or
bonds are issued, Under'no ciruu stances shal the City of South Bend be or be held
responisble for any sum or sums due from said property owner or wwners for said work
or for the collection of same, or for the payment of any bond or bonds, certificate
or certificates, issued to said contractor ir, payment for such work, except for
such moneys as shall have been aetua,'�_-ly received by the City from the assessments
for such improvement, or such moneys as said City is by sadd above entitled Act
required to pay. All proceedings had, and work done in the making of said igiprove-
ment, assessment of .property, collections of assessments and issuance of bonds there --
for shall be as provided for in said above entitled Act.
Notice of this resolution shall be published on the 2nd. day of August
1917 and on the 9th. day of August 1917 in the South Bend Daily Tribune. The
Board will give a. hearing on this resolution at its off ice in the City Hall on the
14th. day of August 1917 at 7:45 P.M.
