July 1917. Mr. H. A. Wood appeased before the Board in regard to improvements in Marquette Park, which was rec'ent'ly' pl-atted.' ' Mr. Lorenz Lederer of W. La Salle• Avenue• appeared before the Board and requested that his part of shed which extends out in William Street -alley which is now being paved be left as. it n-ow stands.. The same was not granted. Mr. Wm. Jackson residing. on L.inc,oln. Way West appeared before the Board requested that all building extending out in William Street alley should be moved. Mr. Swartz presented the following petition and th Board ordered a resolution ordered on b.he same. To vacate the, foilowing° described° property in the City of South Bend, St. Joseph County, Indiana to wit:-- A strip• of land along the N. W. corner of lot 13 and along the S. W. corner of lot 12 in Chapin's Sub . Division of Bank out lots 1 and 2 all all in the southeasterly alley situated on the west side of said lots according to the plans hereto attached marked exhibit A. and we agree to paid all costs of said vacation proceedings. The Board ordered that a telephone be placed in the Crematory, e o Petitions received for a pipe sewer on E. Dayton Street from Marine Street to lst. alley west of Leer Street, also a petition for the vacation of part of Huey Street from Lincoln May West to south to conform with rest of street. L Same were referred to the C ity Civil Engineer for a report, Mr. R. C. Stephenson of the St. Joseph Loan and Trust Company appearo5d ,before the Board and filed the following assignments of the W. Brady Construction Company, hereby transfer, sells and assigns th THE ST. JOSEPH LOAN AND TRUST COMPANY of South Bend, Indiana, all its rights, titles and interest in and to five certain contracts, made and executed by and between the City of South Bend, Indiana, and the. W. B. Brady Construction Company for the paving of the following streets, and which contracts are dated respectively as follows,: For paving Euclid Avenue from La Porte to Walnut St. dated Oct. 24,1916. LaPorte Avenue from Wash. Ave to Linden Ave. dated Mar.28,191 Fuerbringer St, from Cottage Grove to. Sherman Ave. dated May2,191 Franklin Street from Indiana Ave. to Calvert St: dated May2,1917 Calvert Street from Miami St. to High Street dated May 2,1917. Leer St. from Lincoln Way E. to Calvert St, dated May 15,1917. and the said construction company hereby transfers and assigns to . the said Trust Company all money and bonds that shall hereafter be due from the said City of South Bend to the said Construction Company -on said contracts, and the said Trust Company is hereby authorized to receive said money and bonds, and the receipt of the said Trust Company therefor shall fully discharge the City of South Bend from any further liability to the said W. B. Brady Construction Company. The consideration for the foregoing assignment is that the said Trust Company has agreed to advance to the said Construction Company certain sums of money that may be required during the construction of the said work, and the foregoing assignment is made to secure the said St. Joseph Loan & Trust Company for -all amounts so advanced and loaned to the said W. B. Resolved by the Board of Public Works of the City of South Bend, St. Joseph County, State of Indiana, That it is deemed necessary to improve Campau Street from Arthur Street to the east City Limits, as follows, to -wit: By grading said street from property line to property lines to the established grade, by curbing the roadway with cement curb, also by grading parkway in center of said street and by constructing cement curb along said parkway; all as is more particularly shown, and all in accordance with the profiles, plans, detail drawings and specifications on file in the Office of the Department of Public Works of the City of South Bend, Indiana in accordance with the 16pofile, details, drawings and specifications on file in the office of the Department of Public Works of said City; and such improvement is now orderd. The cost of said improvement, including the cost of street and alley intersections, shall be assessed upon the real estateabutting on said Campau Street, all according to the method and manner provided for in an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations, " approved Uarch 6,1905, and in accordance with and pursuant to the provisions of all amendatory and sunplmental acts thereto, passed by the General Assembly of the State of Indiana, Assessments, if deferred, are to be paid in ten equal annual installments: with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment of such work, unless the property owners pay said assessment b fore said bond or bolds are issued Under no circumstances shall the City of South Bend,,'; be, or be held responsible for any sum or sums due from said property owner or owners for said work, or for the collection of the same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for suchwork, except for such moneys as shall have been actually received by the City from the assessments bor such improvement, or such moneys as said City is by said above entitled Act required to pay All proceedings had, and work done in 'the making of said improvement, assessment of property, collection of assessments and issue issuance of bonds therefor, shall be as provided for in said above entitled°Act and amendments thereto.
