07/10/1917 Board of Public Works Minutes
Board met in regular session at 10:00 A. U. Mr. J. B. Weber absent. Mr. H. M. Romberg of Fort Wayne Indiana, representing the American Telephone and Telegraph Company appeared before the Board and.filed the following request to s'et poles. ` American Telehpone and 'Telegraph Company request p-rmission to set poles and connecting wires thereupon in and across Gertrude Street from Prairie Avenue to the Southern City Limits in accordance with the terms and conditions and orov is ions of Ordinance No. 909 adopted June 13th., 1893. The Board granted permission as follows: - To build telephone and telegraph line onthe west side of Gertrude Street from Prairie Avenue to Ewing Avenue and request that said company use jointly the poles already standing.on the west side of Gertrude Street with the South Bend Home Telephone Company, and if present poles are to small to replace same with larger poles and remove small poles. Atty. L. Remine appeared before the Board in regard to ten day notice bet to the Ryan Estate to remove that part of brick bulding which extend out on William Street.. alley, and asked permiss ion to be released from 'taking said part of building down. The same was not granted. Building Commissioner C. A Perkins appeared before the Board and filed following communication; application and notice to companies that Walter Woodka for moving house at 1032 W. gash. Ave. To the Honorable Board.of Public Works., . Gentlemen: - v This move necessitates moving over asphalt pavement on W..Washington Avenue for a distance 0appraximately 400 feet. The law prohibits moving over asphalt pavements between May 1st., and November lat., (Section #457 paragraph #1861 Building Code.) The building is of me idum wieght and if moved at -night on planks it is likely that no damage to the _pavemaht will occur. A permit was refused July 3rd.1917.. Respectfully, The samswas read and placed on file. C. A. Perkins. Concerning the improvement othe roadway of Milton Street from Miami Street to High Street in purasance to resolution No. 522 the petition of freeholders residing on said street is considered and the report of the City Engineer is received and all evidence is heard, and the Board finds that said pet it ionerg c ons itute a majority ' in number of the freeholders residing upon said street to be improved, and that said petition is suffic&dnt. And it is therefore considered and adjudged that said improvement be made *-Ith Asphaltic Concrete the kind of pavement requested in said petition; and the City Engineer repotts that Western Construction Company is the lowest and best bidder for said kind of pavement, and the Board so finds, And lets the contract for said improve- ment to him, and orders that said improvement to be made with Asphaltic Concrete and all proceedings heretofore had in this matter are hereby confirmed and ratified. Bill of Hoban & Roach for the amount of $3.49 for 13.33 sq. yds. of Brick pavement taken ap and relaying @ 30 rents at east and west ends of Portage Court was approved by the Board. ° Board ordered that a five day notice be sent to Lorenz Lederer to remove part of his building which extends out in William` Street off of La Salle Avenue. According to law. Twenty#d ay notice ordered sent to the School Trusttees to repair defectir sidewalk walk or construct new sidewalk in front of old High school lot on West Wa.shin§ton Avenues according to law. ° Deferred hearing on Improvement Resolution No. 520 for pavement on Alley north of Washington Avenue from William Street to Taylor Street, in the City of South Bend, Indiana.. In the above matter no remonstrators'appeared and no further written remonstrance was filed. And the Board being fully advised in the premises, decides; that the benefits to property liable tobe assessed for said improvements are equal to the estimated cost.of said improvement, as reported by the City Civil Engineer, and thereupon takes final action on said resolution Fs originally adopted, and the_same is hereby in all things ratified, c onf irmed and ' approved, Resolved further, that notices .be published on the 27th. day of July 1917 and on the 3rd. day of August 1917--in the South 'Bend Daily Tribune in sadd City, stating that this Board will receive bids for the construction of said iipprove- ment up to 10.00 A.M. on the 7th. day of August 1917. The Board reserves the -right to reject any and all bids. ° In regard to complaint about covering well on Shively property on Niles Avenue, Street Commissioner reports that Officer Jennings reports that he ' investigated same and he himself filled and covered up hole, so same is not dangerous now. Resolved by the Board of Public Works of the City of South Bend, County of St. Joseh, State of Indiana, That the construction of a local sewer, intended and adapted for local use by the pro erty holders w#ase property ibuts thereon, and not v intended or adapted bor receiving sewerage From collateral drains,be and the same is hereby ordered in and along Pleasant Street from Ninth Street to Eighth Street as f ollows, to -wit: Beginning, at the intersection of the center line of Pleasant Street to a point 20 f -et east df the east line of Eighth Street with a 12 inch vitrified pipe sewer. Together with the necessary manholes, inlets, conduits and house con- nections.to the curb line along the line of said .improvement,.all as is more particularly •shown, and all in accordance with the plans, profiles, detail drawings and specifications on file in the Office of the office of the Department of Public Works of the City of .South Bend, Indiana, and said sewer, with all ihs appurtenances shall be constructed in accordance with the profile and specifications now on file in the office of the Department of Public Works of said City., The cost of said improvement shall be apportioned against and paid by the property holders those property abuts thereon, and upon the City of South Bend if the City is benefitted by said improvement, all according to the method and amnner provided for in Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Muunic ip 1 Corporations," approved Uarch 6,1905. Assessments, if deferred,, are to be paid in ten equall annual installments with interest at the rate of Six per cent per annum, A bond or bonds shall be issued to the contractor in payment for such work, unless the property owners pay said assessments before said bond or bonds are issued . Under no circumstances shall the City of South Bend be or be held- responsible for ny sum or sums due from said property owner or woners for said work, or for the collection of same, or for thepayment of any bond or bonds, certificate or certificates, issued to said contractor in payment for such work, except for such moneys as shall have been actually received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled Act reuired to pay. WHEREAS , the Board of Public Works on the loth, day of July 191-7 did adopt a resolution ordering and repairing ,the permanent improvement of Howard Street from Niles Avenue to Notre Dame Avenue, -by paving hhe roadway of the same, and WHEREAS, the City Civil Engineer has prepare add filed in the office of this Board a report showing the number and -location of the service pipes, mains, conduits, laterals and connections which are, or will be necessary to accommodate the abutting property and the owners thereof with gas, water, sewer, andother con- veniences and necessaries; and also said City -Civil Engineer has prepared and filed in said office specifications showing the material to be used and the manner of laying said service pipes, mains, conduits, laterals and connections from the mains to the points insid of the curb l ines. THEREFORE, be it resolved by the Board of Public Works of the City of South Bend, Indiana, that the report of the City Civil Engineer is adopted, and said report and the specifications prepared and filed by him are made a part of this rezolu tion as fully and effectually as if copied herein at full length; and it is further ordered that =11 of such private conne ations with the sewer; gas and water mains,. be made in said street by bringing them inside the curb lines thereof. And be it further resolved that notice by publication for two successive days in the South Bend Tribune, a newspaper of general circulation printed and published in .the City of South Bend, Indiana, be given to the owners of the property abutting upon said street to be improved directing them to make such sewer and water connections on or before the- lst. day of August 1917, and that if .said. -connections 'are not made on or before said time and in accordance with the specifications and report on file in the office of the Board of Public Works, then ad, said Board wi 11 cause the same to be made and will assess the cost thereof against, the property abutting upon said street, and shall do all other things pertaining thereto according to the provisions and requirements of ordinance No; ° 1842 adopted by the Common Council of the City of South Bend on July 24,1916, and of all other ordin aces and laws relating thereto., And be it further resolved and ordered that after 20 dpys period has elapsed for the making of said connections by the property owners, a notice shall be' published for two weeks, once each week, in the South Bend Tribune, a newspaper of general circulation published in said City, requesting bids from contractors for the making of such connections as have not been made by the property owners, and such notice shall fix a day, not earlier than ten days after'the first of such publication when bids shall be opened and a contract let for the doing of said work, And be if further ordered that the Northern Indiana Gas and Electric Company, which hoids a franchise from, and is empowered by said City to furnish art if ieal gas to the citizens thereof, and is engaged in said business in said City, is hereby directed to make and install all service connections with its mains in said street in accordance with the provisions of Ordinance No. 1555, adopted June 27,1910. and such other ordinances.or laws applicable thereto; which connectli are shown upon the report of the City Civil Engineer and which are hereby declared to be necessary to supplying gas to the owners of property abutting upon said street. Where as, the Board of Public Works on the 12th. day of June 1917 did adopt a resolution ordered and requiring the permanent improvement of Miami Street from Fox Street to Ewing Avenue by paving the roadway of the same, and WHEREAS, the City Civil Engineer, has prepared and filed in the office' of this Board a report showing the number and location of the service pipes., igains, conduits, laterals, and connections which are , or will be necessary - to accommodate the abutting property and the owners thereof with gasi sewer, water and other conveniences and necessaries; and also said City Civil Engineer has pl:p prepared and filed in said office specifications showing the material to bel used and the manner of laying said service pipes, mains, conduits laterals and connection from the mains to the points inside of the curb lines THEREFORE, be it resolved by the Board of Public of theCity of South Bend, Indiana, that the re-)ort of the City Civil Engineer is adopted, and said' report and the specifications prepared and filed by him are made a part of this resolution as fully and effectually as, if copied herein at full length; and it is further ordered that all of such private connections with the sewer, gas and water czains be made in said street by bringing them inside the curb lines thereof., And be it further resolved that notice by publication for two succesive days in the South Bend Tribune , a newspaper of general circulation be printed and published in the City, of South Bend, Indiana, be. given to the owners cf the property abutting upon said street to be improved directing them to make such sewer and water connections on or before 1st. day of August 1917 and that is said, connections are not made on or before said time and in accordance with the s-0eci- fications: and report on file in the office of the Beard -of Public Works, then. said Board will cause the same to be made and will assess the cost thereof against the property abutting pon said street, an sahll do all other things pertaining thereto according to the provisions and requirements of Ordinance No. 1842 adopted - by the Common Council of the City of South Bend on July 24,1916, and of all other ordinances and laws relating thereto.
