first alley south'of'La,Salle'Street: This extension is to be made in order to take
care of the Indiana & Michigan Electric Company plant. This matter was referred to

Permission granted to the Central Union Telephone Company to set
five poles in the alley between Corby -Street and Howard Streets and St. Peter Street
and the alley east of Notre Dame Street, some to be set on north side of alley and
remove one cif your company poles nw on south side of alley.

Dear Sirs• -
-At-the direction of your Board I have had prepared three resolutions for
the paving of ' Eddy St. and Mishiawaka Ave. One resolution provides for the paving of
Eddy St, from Jefferson Blvd. to the south line of Mishawaka Ave., another provides
for the paving of Mishawaka Avenue from the east line of Eddy St. to the east line of
Fifth Street and the third for the paving of Mishawaka Ave. from the east line of
Fifth Street to the center of Nineteenth Street. These ° resolu.t ions have already been
published.
The property fronting on the east section of this work is appraised for
taxation at $249260.00. The pavement on this section exclusive of the street and
alley intersections and the street car track will cost the property owners approximately
036,000 .00 This will make it necessary to secure a petition from eighty per cent of
the freeholders on this section of the street before the improvement man be made.
I also wish to call your attention to the water connections on the Street
I do not think that these have been taken care. of yet.

The bill amounted to $24.84. I would suggest -to your Honorable
Body that you take the matter up with the Honorable Board of Public Works, and
have a, lock :put- on this.door with about four keys to fit- lock, this will prevent
everyone from getting into this. room.

Attorney Stuart lMcKibbin appeared before the Board representing property
owners remonstrating against samd Improvement. Mr-. C . APT. Studebaker appeared for said
'improvement. The Board. ordered this hearing continued until Tuesday July loth. ,1917
at 7:45 P.M. until further action by the Common Council. (Attorney Seebirt took papers
in regard -to said improvement)

west side of Miami Street from alley north of Donald Street to Ewing Avenue, in the

The Board of Public Works at its Tuesday session decided to accept
your verbal proposition to repair and patch the pavement on Jefferson Blvd. from
the east end of Jefferson Street Bridge to the intersection of Lincoln Way East
for the sum of Two hundred ($200.00)Dollars, providing that the work is done
within Ten'(10) days,provided further, that you guaranty the same to be in repair
as per your verbal: conversation for. a per9od of one year.. The repairs to be
made of Tarvia Macadam. For any reason that you can not accept this proposition
at once please notify us at once.

LOCAL SEWER IMPROVEWNT RESOLUTION N0. 542.
Resolved by the Board of Public Works of the City of South Bemd, County
of St. Joseph, State of Indiana, That the construction of a local sewer, intended
and adapted only -for local use by the property holderwhose property abuts thereon, and
not intended or adapted for receiving sewerage from collaterell drains, ebe and the same
✓ is, hereby ordered in and along Howard Street from Notre Dame Avenue to a.point 15 feet
east of the east line of St. Louis Street as follows, to -wit: -
Beginning at the inter-
section of the center line .of Notre Dame Avenue and Howard Street; thence west along the
center line of Howard Street to a point 15 feet east of the east line of St Louis Street
with a 12 inch pipe sewer. Together with the necessary manholes, storm water inlets,
conduits flush tank and house connections to the curb line along the line of said improve-
ment all as is more particularly shown, and in accordance with the profiles, plans,
detail drawings and specifications on f it in the office of the Department of Public
Works of the City of South Bend, Indiana,, and said sower, with all itsappurtenances
shall be constructed in accordance with the profiles and specifications, now on file
in the office of the Department of Public Works of said City. The cost of said improve-
ment shall be apportioned against -and paid by the property holders whose property
abuts thereon, and upon the City of South Bend . if the City is benef itted by said improve-
ment, all according to the method and manner prob ided for in An Act of the General
Assembly of the State of Indiana, entitled " An. Act Concerning Municipal Corporations,"
approved March 6,1905. Assessments, it deferred, are to be paid in ten equal annual
installments, with interest at the rate of Six per cent per annum A bond or bonds
shall be issued to the contractor in payment for such work, unless the property owne rs
pay said assessments before said bond or bonds are issued. Under no circumstances shall
the City of South Bend be or be held responsible for any sum or sums due from said pro-
perty owner or owners for said work, or for the collection of same, or for the payment
-of any bond or bonds , certificate or certificates, issued to said contractor .in pay-
ment.for such work .except for such moneys as shall have been actually received.by the
City from the assessments for such improvement, or such moneys as said City is by said
above entitled Act required to pay. All proceedings had, and work done in the making
of said Improvement, assessment of property, collection of assessments and issuance of
bonds therefore, shall be as provided for in said above entitled Act.
Notice of this resolution shall be published on the 7th. day.of July
1917 and -on the -14th. day of. July 1917 in the South Bend Daily Tribune. This Board will giv
give a hearing on this resolution at its office in the City Hall on the 17th. day of
Ault' 1917 at 7:45 P.M.

STREET AND ALLEY IMPROVEMENT RESOLUTION NO..543.
Be It Resolved by the Board of Public Works of the City of South Bend, St
Jeeph County, State of _Indiana, that it is desired and deemed necessary to improve

Said avenue shall
e graded. , and the -roadway thereof.shall be paved; and also the roadway of certain
portions oif•. the• sere-ete and. alleys which enter or intersect said avenue shall be
graded.and paved. The paving material to be used in making said improvement shall be
Sheet Asphalt, Bitulithic, Asphaltic Concrete or Brick, and the foundation shall be
pertland cement concrete five (5) inches thick for the ,sheet asphalt, bitulithic
asphaltic ' conerete and brick` or rolled gravel six (6) inches thick for brick; also
cement shall be
constructed said avenue where same is not already constructed;
storm water inlets and conduits shall be constructed where necessary; all manholes
covers and storm water inlets shall be set to the proper grade and cement ma.rgin.al curb
shall be constructed at all streets and alleys where necessary; all as is more parti-
culary shown, and all' in accordance with the profiles, plans, detail drawings and
specifications, on file in the office of the Department of Public Works of the City of
South Bend, Indiana.
The cost of the improvement herein provided for, except street and alley
intersections, -shall be paid by special assessment to be levied upon the property specL
specially benefitted, to the amount that the same may be legally assessed therefor,
in accordance with an Act of the General Assembly of theState of Indiana, entitled
" An Act Concerning Municipal Corporations,"approved karch 6,1905•, and in accordance
with and pursuant to the provisions of all acts•amendatory and sugplme:htal thereto.
The cost of all street and alley intersections, including one-half of the
width of the improvement oppesite street and alleys which run into, but do not cross
said roadway herein proposed to be improved and that portion of such street or alley
abutting upon property belonging to said City, or upon property not subject to such
assessment, shall be paid by the City in cash out of its general fund, if able to do
so, or from a fund_ created by a special assessment to be levied under the provisions
of - Section 108 of the above entitled Act.
Assessments of ten dollars and more against each -lot, if deferred,.are to
be paid in ten equal annual installments, with intersect at the rate of Six per cent
per antrum. A'bond or bonds will be issued to the contractor to the amount of such
deferred assessments in pro rates payment for -such improvement. -

posed improvement, at which said Board of Public Works will hear all persons inter-
ested, or whose property is liable to be assessed for said improvement, and will decfie
whether the benefits to the property. liable to be assessed for said improvement
will equal the estimted cost thereof.
Be It -Further Resolved That notice of the time and place of such public
consideration be published and mailed in the manner provided by law. Notice of
this resolution shall be published on the 6th. day of July 1917 and on the 13th.
day of July 1917, in the South Bend Daily Tribune.

STREET OR.ALLEY IMPROVEMENT RESOLUTION NO. 544.
Be It Resolved by the Board of Public Works of the City of South Bend,
St. Joseph County, State of Indiana, that it is desired and deemed necessary to improve
'Eddy Street and Mishawaka Avenue from Jefferson Boulevard -to the center of Nineteenth
Street as follows,to-wit:-
Said street and avenue shall be graded, nd the roadway thereof,
shall be paved; and also the roadway of certain portions of the streets and -alleys which
enter or intersect'said street and avenue shall be graded and paved, The paving
material to be used in making said improvement shall be Sheet Asphalt, Bitulithic, Asphalt]
Concrete or Brick, and the foundation shall be portland cement concrete five (5) inches
thick for sheet asphalt, bitulithie, asphaltic concrete and brick or rolled gravel six (6)
inches thick for brick; also cement curb shall be constructed along said street a!,d
avenue where same is not already constructed; storm water inlets and enduits shall be
constructed where-neoessary all manhole covers and inlets shall be set to the proper
grade and cement marginal curb shall be constructed at all street s and alleys where
necessary; all as is more particularly shown, and all in accordance with the profiles,
plans, detail drawings and specifications on file in the office of the Board of Public
Works of the City of South Bend, Indiana.
The cost of the improvement herein provided for, except street°and alley
intersections, shall be, paid by assessment to be .levied upon the property specially luene-
fitted, to the amount that the same may be legally assessed therefor, in accordance with
an Act of the General Assembly of the State of Indiana, entitled " An. Act Concerning
Municipal Corporations," appoved Mareli 6,1905, and in accordance - with and pursuant to
the provisions of dll acts amendatory and supplemental thereto.
The cost of all street and alley .intersections, .ine.luding one-half of the
width of the improvement opposite street and alleys which run into,, but do not cross said
roadway herein proposed to be improved and that portion of such street or alley abutting
upon pro erty belonging to said City, or upon property not subject to such assessment, shal
be paid by the City in cash out 8 its general fund if able to do so, or from a fund
created -by a special assessment to be levied under the provisions of Section 108 of the
above entitled Act.
Assessments of ten dollars and more against each lot, if deferred, are to
be paid in ten equal annual installments, with interest at the rate of Six per cent
per annum. -A bond or bonds will be issued tothe contractor to the amount of such de-
ferred assessments in pro rats payment for such improvement.
