The Board ordered an extension off of the Home Telephone company now located in the Central Pumping station., into, the City Crematory building. Thee -Clark instructed to notify the South Bend. 'Home Welephone Company of such ekt ens ion, Property orders appeared, before the Board in regard to an extension of Chestnut Street pip6 sower,from Napier Stereet to the New York Central:Ry. Co. right of way. Resolution adopted for same. Mr. G. -R. Summers with Mr. Max Adler appeared before the Board and requested that some lights be placed on E. Washington Avenue from Michigan Street Ao Lincoln Way East. The Board took said matter under advisement. Mr. F. I. Hardy, Mgr. of the Chicago, South Bend & Northern Indiana Ry. Company appeared before the B@ard� in regard to resurfacing of Jefferson Blvd., ✓ bridge. Mr. F.--I. Hasty submitted the following verbal proposition to the Board. That he would agreed to repair with Tarvia that part of Jefferson Blvd. from the east end- of' Bridge to iAters,ection of Lincoln Way East for the sum of / Two hundred ($200,00)Dollare andkeep same in repair. Board took trip of over d streets in Mishawaka and this City with Mr. Hardy to investigate same klnd of work. The Honorable Board of Public Works, South Bend, Indiana, tsar Sirs:- Mr. irs:- Mr. Heber Harter in constructing the pavements in Harter Heights is not raising the pavements at the street intersections at the crosswalks, but is running the gutter straight through. This is a type of construction different from that in general use in the City, and I would like to have the opinion of the Board in regard to _the matter If they do not approve of the type of construction being used, it should be changed before the work had gone too far, and so cause a great deal of expense in. making . the necessary changes. It is the orders of the Board -of Public Works, that you have this pavement laid the same as in other places in the City, making a raise in the pavements at the street and alley intersections, so that the pavement be on the level with the sidewalks. ' VERY TRULY, BY ORDER OF THE BOARD Mr. Geo. M. Urey, City Cemetery Sexton appeared before the Board and Lookup matter of a raise in price for digging graves. Same was not granted. The City Civil Engineer F. J. Anderson took up the matter with the Beard of whether or not the City should inspect pavement* materials in Harter Heights. The Engineer was instructed to have I. Van Trump inspector on gather asphalt pavements in the City inspect pavement materials in Harter Heights. Concerning the imor-ovement of the roadway of Milton Avenue from High-Street`to Miami Street with asphalt, asphaltic concrete, Bitulithic or brick in pursuanceto resolution No. 522 this beAng the day aet for preliminary award designating the kind of pavement, the Board at 10:00 A.M. on the 'l9th. day of June 1917 publicly ✓ opened, read anal eons idered all bids'. And thereupon the Board designated Asphaltic Concrete as the kind of pavement with which said street is to be improved and fixes the 7th. ddy of July 1917 at 10:00 A.M. as the time when petitions for changing the kind of pavement must be filed, the the Board hereby continues this matter until the ioihday of. July 1917 at 10:00 A.M. and all bids are hereby referred to the City Engineer for tabulation and report as to the lowest ana best bid. STREET ORALLEY NPROVEMENT ENSOLUTION NO. 536." ✓ BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF'THE CITY OF SOUTH BEND, St Joseph County, State of Indiana, that it is desired and deemed necessary to improve Portage Avenue from Keller Street to the north City .limits as follows,to-wit:- Sa id Portage Avenue shall be graded t.o thee eatabl.ished grade; and also the roadways of certain portions of the streets and alleys which enter or intersect said avenue shall be graded; also cement curb shall be constructed along said avenue where same is 'riot `alread constructed, all as is more particularly shown, and in accord- ance with tie' profiles, plans, detail drawings and specifications on file in the office of the offfice of the Board of Public Works of the City of South Bend, Indiana. The cost of the improvement herein provided for, except street and alley intersect ions, shall be paid by special assessment to be levied upon the property specially benefitted, to the amount that the same may be legally assessed therefor, in accordance with an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations, " approved March 6,190% and in accordance with an pursuant to the provisions of all acts amendatory and. supplemental thereto. The cost of all street and alley intersections, including one-half of the width of the improvement opposite street and alleys which run into, but do not cress said roadway herein proposed to be improved and that portion of such street oralley wbutt1ng.u69noprcperty belonging to said City, or upon property not subject to such assessment, shall be paid by the City in cash out of its general fund, if able to to se, or from a fund created by a special assessment to be levied -under the provisions of Section 108 of the above entitled Act. Assessmenrs of ten dollars and more against each lot, if deferred, are -to be paid in ten equal annual installments , with interest at the rate of Six per cent per annum. A bond or bonds will be issued to the contractor to the amount of such deferred assessments in pro rat& payment for such improvement. Under no circumatanees shall the City of South Bend be, or be held responsible for any sum or sums due from said property owner or aAmera for said work, or=..for the collection of the same, or for the payment of any bond,: bonds, certificate or certificates, issued to said contractor in paymatt for such work , except for such moneys as shall have actually been received by the City from the assessments for such improvement or such moneys as said City is by said entitled Act and amendments and supplements thereto required to pay. All proceed ngs had, and work done in the making of said improvement, assessment of property, collection of assessments and issuance of bond therefor, shall be as provided for in said above entitlted Act, and Acts amendatory thereof and supplemental thereto. BE IT FURTHER RESOLVED, That the Board of Public Works fix the 24th. day of July 1917 at the hour of 7:45 P.M. at the office of the Board of Public Works of this City, as the time and place for the public consideration of said proposed improve- ment, at which said -Board of Public Works will hear all persons interested, or whose property is liable tobe assessed for said improvement, and will decide whether the benefits to the property liable to be assessed for said improvement will equal the- esti- mated cost thereof. BE IT FURTHER RESOLVED, That notice of the time and place of such public Consideration be -published and mailed inhhe manner provided by law. Attorney Vitus Jones, Attorney fo1-t1scHarter Realty Company appeared before the Board in regard to the cha of crosswalk approaches in streets in Harter Heights Addition,, -where contractor he laid pavement and sidewalks. This matter was referred to the CityEngineer to instruct contractors 'about how to lay same and to Y make the necessary adjustments. The matter . of having Niles Avenue between Howard Street and Napoleon Blvd. widened from twenty (20) feet to'Twenty five (25) feet was taken up with the Board by,Attor..ney Jones. No action taken on same.' Barnes of the County of St. Joseph State of Indiana as principal, and Charles Suabediseseen and T. C. Barnes of the County of St.- Joseph and State of Indiana as susret ies, , are held and firmly bound to the City of South Bend, Indiana,, in the sum of Seven hundred and thirty five Dollars ($732.00) for the payment -of which, well and truly to be made, we jointly and severally bind ourselves,,our heirs, executors adminstra,tors and assigns, firmly by these presents.
