Mr. W. B. Brady, of the W. B. Brady Construction Company with Attorney
Towne:ley appeared before the Board in regard to contract for, pavement on Eddy
Street and Mishawaka Avenue from Jefferson Blvd. to Nineteenth Street. Attorney
M. U. Towneley stated that Mr. Brady feels that he would have to do this work at
a loss and he'feels that this contract should be set aside.and the matter let come t
to a new letting. Property owners residing on Mishawaka Avenue and Eddy Street
with their attorney L,. H. Hammond of Lambert and Hammond appeared before the Board
and the matter of contractor wanting to give up contract or. Eddy Street and Mishawak
Avenue pavement was discussed., The Board after due consideration decided to defer
this matter°until Wednesday June 27th.,1917 at 10:00 A.M. This was done to give
the property owners attorney, fir. L. H. Hammond more chance to look over pro-
ceedings in regard to said contract above mentioned.
Permission granted the Indiana & Michigan Elec Co mpany to reset
a line of poles on Portage Avenue between Kinyon Street and River View Cemetery
jointly with the Central Union Telephone Company.
The following communication received read add this work to be done
under the City Eng ineer ' s instructions and specifications,
South Bend, Ind. June 19,1917.

Since we as Mr. H. B. Whites Agents are entemplating the laying of
sidewalks and curb stones on Bowman , Donald, Fox and Leer Streets where out
property faces such streets, we respectfully request your authorization for these
V improvements at the street intersections.
We have let contracts at exceptionally low prices on this work, and
trust that you will take advantage of same.
Kindly advise us if You wish, the contractor to keep a record of these
intersections, dr if you wish , to take the City : Eng ineer ' s figures, when submitting
a bill to you for this work.
Thanking you for past courtesies and trusting that you will give this
matter due attention, we are, °

STREET OR ALLEY TYPROVEMENT RESOLUTION NO. 535.
BR�IT.RESOLVED<BY THE BOARD OF PUBLIC WORKS of the City of South Bend,
St. Joseph County, State of Indiana, That it is desired and deemed necessary to improve
Jefferson Boulevard from the east line of the Jefferson Boulevard Bridge to the east line
of Lincoln Way Fast as follows, to -wit: -
To inorove Jefferson Boulevard from the East end
of the Jefferson Boulevard Bridge over the St-. Joseph River to the easterly line of
Lincoln Way East; by -resurfacing the roadway., The present wearing surface on said
boulevard shell be taken up and removed from the street. The pavingmaterial to be used
in resurfacing said boulevard sill be sheet asphalt, bitulithie, e,s-0 altic concrete or
brick, and shall be laid on the present concrete foundation; also cement curb shall be
constructed along said boulevard where same is not already constructed; storm water
inlets and conduits sha 1 be constructed where necessary; all manhole covers and inlets
shall be set to the proper grade and cement marginal curb shall be constructed at°all
street and alley intersections where necessary; all as is more particularly shown,
and all in accordance with the _orof Iles, plans, detail drawings,and Specifications on file
in the office of the Board of Public Works of said City.
The cost of the improvement herein provided for, except street and alley
intersections, shpIl be paid by secial assessment to be levied upon for property en-cfally
henefitted, to the *,mount that the same - may be legally assessed therefor, in accordance
with`an Act of the General Assembly of the State of Indiana, entitled " An Act Conderning
M nicip�-,l Corporations, " approved March 6,1905, and in accordance with and pursuant to the
provisions of all acts amendatory and supplemental thereto.
The cost of all street and alley intersections, including one-half of the
width of the improvement opposite street and alleys which run into,.but do not cross said
roadway herein proposed to be improved and,that portion of such street or alley abutting
upon property belonging to said city, or upon property not subject to such assessment,
shall be paid by the City in cash out of its general.fund, if able to do so, or from a,
fund created by a gpecial assessment to be levied under the provisions of Section 108 of the
above entitled Act.
Assessments of ten dollars and more against each lot, if deferred, are to
be paid in ten equal annual installments, with interest at the rate of Six per cent per
annum. A bond or bonds will be issued to the contractor to the amount of such deferred
assessments in pro rata payment for such improvement.
Under no circumstances shall the City of South Bend be, or -be held responsi-
ble fv any sum or sins due from said property owner or owners for said work, or for the
collection of the same, or for the payment for any bond, bonds, certificate or certificates,
issued to said contractor in payment for such work, exce;Dt for such moneys as shall have
actually been received by the City from the assessments for such improvement, or such
moneys as said City is by said entitled Act and amendments and supplements thereto required
to pay. All proceedings had, and work done in the making of said improvement, assessment
of property collection of assessments and issuance of bonds therefor, shall be as provided
for in said above entitled Act, and Acts amendatory thereof, and supplmenAtal thereto.
BE IT FURTHER kESOLVED BY THE BOARD that :as they desire to save time and
expense they have decided to accept waivers from property owners abutting said improvement,
waiving all objections to the fact that no advertisement for hearing was published as
required by law, a -ad that no notices were mailed to the ,wn.ers of property and that no
haaring was had by said Board.
Adopted this 21st.1, day of June 1917.
