Board met in regular session at 10:00 A.M. Mr. John B. Weber absent.
Mr. Harry.A. good appeared before the Board and presented plat,of
Marguette Park, The Boardinstructed Mr. H. A. Wood to have some changes made before
would be accepted. °
° Mr. Myron Campbell appeared before the Board with Mr. Philip Goetz and
Mr. Bowsher and v6kbal v ob l ectcd to defective condition of concrete pavement
in alley west of '_`a -in Street between Marion Street and Madison Street. The Board
informed above named parties that they would take a trip ofer said pavement and
investigate the same, this morning.

Complaint hbout guy awe and guy stub at 1345 E. Dubail Avenue, being
in the way of garage. Pole and awe inspectr reported as follows on same,
This a Central Union Telephone Co. pole. A hew garage is being built
in the read of the lot and this guy wire is in the way, and a pole should be set
at the second lot east on the dividing line and place a slug east of the pole
to be set.
Complaint filed by S. C. Lontz & Son about guy wire in rear of 220
s outh St. Louis B1.vd. which in the way of entrance to garage. Pole and wire inspector
reported as follows on same:
This a Home Telephone Company guy wire. This guy wire
should be placed on a pole farther to the west and the slug should be placed west
of the next pole west of the cable pole.

Replying to yours of June 7th. advising us that is necessary that we
complete the underground work in the alley between Division and Monroe Sts. and
Michigan and Rt. Joseph Sts., south of Monroe St., thence east to Fellows St., thence
south on Fellows St. east on Monroe St., to the first alley.
✓ In this connection I wish to advise that my copies of working plans do not
call for -the installation of the underground conduit mentioned above. I have forwarded
your letter -to our.Indianapolis, Ind., office and asked that they advise me
regarding same.

to as the "City"), under and by virtue of an Act of the General Assembly of the State of Indi-
ana, entitled ",An Act Concerning Municipal Corporations," approved March 6, 19o5, and all

and"the plans, profile and specifications on file in the office of the Department of Public Works, which said resolu-
tion, plans, profile and specifications are made a part hereof as fully and effectually as if copied and set out herein
at full length.
The contractor further expressly covenants and agrees that in the prosecution of said work. all proper skill
and care will be exercised; that he will properly guard and protect all excavations and dangerous places, and will
use all due and proper precaution to prevent. injury to any person or property; that in the event of .any injury
or damage resulting from the work or resulting from any matter or thing connected therewith or arising there-
from, to -any person or property, he will pay and liquidate the same at his own expense, and assume the liability
therefor; and in the event of any claim or claims being made or any action or actions being brought against the
city by reason or on account of or growing out of said work or its construction, the said contractor will at his
own expense defend the same, and will pay any judgment recovered therein, and will in all respects fully indemnify
and save harmless said city, its officers, agents or representatives from all cost, expense, payment or judgment
recovered in connection with such claim or claims, action or actions.. And if within ten days after apy such
action is begun, the city shall notify the contractor of the pendency thereof., then anyjudgment rendered against
the city shall be conclusive against the contractor and against the surety on his construction bond, as to the
amount, liability and other matters pertaining thereto.
And the contractor agrees to maintain said improvement and make such repairs as may be necessary for the
period and in the manner as fixed by the specifications, and to secure the maintenance and repair thereof to file
with the Board of Public Works a bond with sufficient surety thereon and in an amount as fixed by the specifi-
cations. And in doing such repair work the contractor and the surety on his guarantee bond shall be subject
to the same liability to the city and any other -person for any injury or damage to any person or property in the
same manner and to the same extent as is fixed in the last preceding paragraph covering the construction work.
And it is further agreed by and between said parties that the acceptance of the work provided for in this
contract, or the payment thereof, shall not constitute a waiver on the part of the city of any of the provisions of
this contract, nor shall it release said contractor or the sureties on his bond for the faithful performance thereof;
nor shall the acceptance be prima facie evidence of the performance of any provision of this contract, except to
the extent of entitling the contractor to the contract price therefor.
The contractor agrees to pay far all labor and materials used or furnished to be used in the making of such
improvement and in the performance of this contract, whether done or furnished for him, or his agent, assignee,
successor or subcontractor; and the city may reserve out of any allowance -made on. any estimate in favor of the
contractor, or his assigns, or ,out of the amount due him ,or his assigns_ upon: ahe..completion of the work; so.
much as may be necessary to pay=all laborers or material,inen for amounts--due-them for_;work done or mater-gals,

F The contractor agrees to remove all rubbish, earth, and unused material in the streets or sides thereof upon
the completion of the improvement or the repairing thereof.
The work of making such'improvement shall be completed according to the terms of this contract on or

unless the time for the completion of the.same shall be extended in writing by the Board of Public Works. And
it is -agreed that any such extension of time, or any alteration of this contract or of the mangier or method of
doing such work shall in no way affect the duties, obligations or liabilities of the contractor or his sureties.
It is agreed that the contractor shall not assign this contract, or sublet the work or any part thereof to be
done hereunder, without the written consent of the Board of Public Works.
It is further agreed and stipulated that the contractor shall give to residents of said city and county prefer-
ence in the employment of all labor necessary in the performance of this contract, and failing to do so, shall for-
feit to the city the sum of ten dollars for each failure to observe this stipulation
And upon.the performance of all the terms and conditions of this contract, and things to be done and per-
formed by said contractor= he said city agrees to cause the cost of doing such work to be assessed, collected and
paid to said contractor in the manner fixed ,`by -the statute governing the making of such improvements.
To each of the conditions and stipulations of this contract, including all and singular the provisions and terms
of the plans, profile, specifications and resolution aforesaid, the undersigned binds himself or.itself, and the re-
spective successor or assigns of such parties.

Councilman Seifert appeared before the Board in regard to petitions
on file for water mains on Eighteenth Street River Park, also water mains
on north St. Peter Street, north from South Bend Avenue, This matter was referred
to the Water Dent.,
Engineer filed assessment for pipe sewers on Rush, Fellows,Milt.on,
Columbia, Carroll and St. Joseph Streets and Benton Court from Calvert Street
to St. Joseph Street, under Improvement ResolutIon No. 464. In the City of
South Bend, Indiana.
Resolved, that notices as to the amounts of assessments as required
by statute, be published on the 15th. day of June 1917 and or, the 22nd. day. of
June 1917 in the South Bend Daily Tribune, st ating that thisBoard will give a
hearing on the amount of such assessments at its office in the City Hall on the
26th. day of .June 1917 at 7:.45 P.M.
Resolved further, that the entire work under the above contracts
be accepted and approved and the final estimate thereon allowed. Notice of this
resolution shall be published on the 15th: day of June 1917 and -on the 22nd. day
of June 1917 inthe South Bend Daily Tribune, stating that this Board will give
a hearing on the acceptance of such work at its office in the City Hall on the.

STREET OR ALLEY IMPROVEMENT RESOLUTION NO. 529.
Be It Resolved by the Board of Public Works of the City of South
Bend, St. Joseph County, State of Indiana, that it is desired and deemed nec-
essary to improve Mimi Street from the north line of Fox Street to the north
line of Ewing Avenue as follows, -to; wit: -M
Said street shall be graded, and the
roadway thereof shall be paved; and also the roadway of certain portions of the
streets and alleys which enter.or intersect said street shall be graded and
paved. The paving material to be used in making said improvement shall be sheet
asphalt, Biulithic, Asphaltic Concrete or Bricks and the foundation shall be
portland cement concrete five (5) inches thick for sheet asphalt, bitulithic,
asphaltic concrete and brick or rolled gravel six (6) inches thick fiRr brick;
also cement curb shall be constructed along said street where same is not already
constructed; storm water inlets and conduits shall be constructed where necessary
all manhole covers and inlets shall be set to the proper grade acid cement
marginal curb shall be constructed at all streets and alleys where necessary; all
manholes covers and inlets shall be set to the proper grade and cement marginal
curb shall be constructed at all streets and alleys where necessary; all as is
more particularly shown, and all in accordance with the profiles, plans, detail
drawings and specifications on file in the Office of the Board of Public Works
of said City.
The cost of the improvement herein provided for, except street and.
alley intersections, shall be paid by special assessment to be levied upon the
property specially benefitted, to the amount that the same may be 1egally assessed
therefor, in accordance with an Act of the General Assembly of the State of
Indiana, entitled " An Act Concerning Municipal Corporations, " approved March
6,1905, and in accordance With and pursuant to the provisions of all acts
amendatory and supplemental thereto-.
The cosy of street and alley intersections, including one-half of
the width of the improvement opposite street and alleys -which run into, but do
not cross said roadway herein proposed to be improved and that portion of such
street or alley abutting upon property belonging to said City or upon property
not subject to such assessment, shall be paid by the City in cash out of its
gerere.1 fund, if able to do so, or from a fund created by a special assessment
to be levied under the provisions of Se ction 108 of the above entitled Act.
Assessments of ten dollars and more against each lot, if deferred, are to
be paid in ten equal annual installments, with interest at the rate of Six per cent
per annum. A bond or bomds wil be issued to the contractor to the amount of such
deferred assessments in pro rata payment for such improvement,
Under no circumstances shall the City of South Bend be , or be held
responsible for any sum or sums due from said property owner or owners for said work
or for the collection of the same, or for the payment of any bond, bonds, certificate
or certificates, issued to said contractor in payment for such work, except for -such
moneys .as shall have actually been received by the City from the assessments for such
improvement, or such moneys as said City is by said entitled Act and amendments and
supplments thereto required to pay. A'.11 proceedings had, and work done in the making
of said improvement, assessment f property, collection of assessments and issuance of
bonds therefor, shall be as provided for in said above entitled Act, and Acts amendatory
thereof and supplemental thereto.
BE IT FURTHER RESOLVED, That the Board of Public Works fix the loth. day of
July 1917 at the hour of 7: 45 P.M. at the office of the Board of Public Works, of this
City, as the time and place for the public consideration -of said proposed improve-
ments, at which. said Board of Public Works will hear a1.1 persons interested, or whose
property is liable to be assessed for said improvement, and will decide whether the bene-
fits to the. property liable to be assessed for said improvement will equal the estimated
cost thereof. °
°BE IT FURTHER RESOLVED That notice of the time and place -of such public
consideration be published and mailed in the manner provided by law. Notice of this
resolution shall be published on the 14th. day of June 1917 and on the 21st. day of
June 1917,An in the South Bend Daily 'tribune.

SIDEWALK IMPROVEMENT RESOLUTION NO. 530,
y� RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OP SOUTFT BEND,
ST. JOSEPH COUNTY, STATE OF *INDIANA, That it is deemed necessary to improve Fox
Street from Miami Street to the west line of Oak Park 4th. Addition as fallows,. to -wit: -
By grading said street from property line to property line to the
established grade, curbing the roadway with cement curb and constructing cement side-
walk on both sides Df said Fox Street. All as shown on the plans, and in accordance
with the profiles, detail drawings and specifications on file in the Office `of the
Department of Public Wrks of the City of South Bend, Indiana, in accordance with the
profile, details, drawings and specifications on file in the office of the Department
of the Board of -Public Works of said City; and such improvement is now ordered.
The cost of said improvement, including the cost of street and alley
intersections, shall be assessed upon the real estate abutting on said Fox Street all
according to the method and manner provided for in an Act of the General Assembly of the
State of Indiana, entitled " An Act Cneerning Municipal Corporations," approved March
6,1905, in accorddnce withand pursuant to the provisions of all amendatory and supple-
mentalacts thereto, passed by the General Assembly of the State of Indiana. Assessments,

By grading the west side of said street from the property

west .side. of said Street; all as is more particularly shown, and all in accordance
with the profiles, plans, detail drawings and spec if icat ions on. f ile in the office
of the Board of Public Works of City in accordance with the profile, details, drawings,
and specifications on file in the office of the Department of Public Works of said
City; and such improvement is now ordered.

Resolved by the Board of Public Works of the C ity ' of South Bend,., St.
abseph County. State of Indiana, That it is deemed. necessary `to improve
Seventeenth Street from Mishawaka Avenue..to the Grand Trunk Western Ry. Company
as follows, to -wit: -
By grading said street from property line to property
line to theestablished grade, curbing the roadway with cement curb and con-
structing cement,sidewalk op both sides of said Seveneteenth Street...All as
shown on the plans and in accordance with the profiles and detail drawings
and speef icat ions on file in the office of the Department of Public Works of the
City of South Bend, Indiana) in accordance with the profile, details and drawings
and specifications on file Fn the office of -the Department of Public Works of said
City; and such improvement is now ordered:
The cost of said improvement, including
the cost of street and alley intersections, shall be assessed upon the real estate
abuttng on said leventeenth Street all according tothe method and ammner provided
for in an Act of the General Assembly of the State of Indiana, entitled an Act
Concerning. Municipal Corporations, approved March 6,1905, anal Iin a ccordance with
and pursuant to the provisions of 611 amendatory and supplmental acts thereto,
passed by the General Assembly of the State of Indiana. Assessments, if deferred
are to be paid in ten equal annual installments, with interest at the rate of Six
per cent per annum. A bond or bonds shall be issued to the contractor in payment
of such work, unless the property owners nay said assessment before said bond or
bonds are issued. Under no circumstances shall the City of South Bend, be or be
held responsible for any sum of sums due -from said property owner or owners for
said work, or for the collection of the same, or for the payment of any bond,
bonds, certificate or certificates, issued to said contractor in payment for. such
improvement, arr such moneys, as said City is by said above entitled Act required
to pay. All proceedings had, and work done in the making of said improvement,
assessments of property, .collection of assessments, afld issuance of bonds therefor,
shall beas provided for in said above eneitlted Act and amendm6nts thereto.
Notice of this resolution shall be published on the 14th. day of June
1917 and on the 21st. day of June 1917 in the South Bend Daily Tribune. This Board
will give a hearing on this resolution in its office in the City Hall on the 3rd .
day of July 1917 at 7:45 P.M.

Leer Street from Calvert Street to Ewing Avenue as follows, to -wit:_
